Dear Mr. Reilly:
Thank you for your referral of a Special Permit application to allow the construction of a residential addition and
an attached second unit on the referenced property. As you are aware, the subject property is located within the
County's jurisdiction and within the City of Campbell's Sphere of Influence.
The City of Campbell has pre-zoned this property R-1-6 (Single Family Residential). Under Campbell's current
development standards a minimum lot area of 12,000 square feet is required for a secondary living unit. The
approval process for a secondary living unit requires approval of a conditional use permit by the Planning
Commission. If this project was in Campbell's jurisdiction, the proposed secondary living unit would not be
permitted due to a substandard lot area.
Additionally, the proposed remodel fails to comply with the following development standards of our residential
zoning districts:
· The minimum street side yard setback along Pope Court would 12 feet versus the 9.5 feet shown.
· The setback along the southern property line would be 9.5 feet versus 8 feet for the second story
addition, and
· The entry to the secondary unit should not be visible to the street, so that the residence maintains the
appearance of a single-family dwelling.
In the event this property is annexed to Campbell in the future, this property would become non-conforming in
respect to those items noted above.
