After notification and public heating, as specified by law, and after presentation by the Community Development Director, proponents and opponents, the heating was closed. After due consideration of all evidence presented, the Planning Commission did find as follows with respect to application PLN2001-50: The proposed general off-sale liquor license is consistent with the commercial land use designation of the General Plan and the C-2-S (General Commercial) zoning designation for the site with approval of a Use Permit. 2. The existing caf~ and delicatessen with a general off-sale liquor license is compatible with the surrounding development and uses. The proposed addition of a general off-sale to the caf~ and delicatessen does not represent an expansion of the existing use and the current on site improvement have addressed the parking and landscaping needs of the property. Winchester Blvd. - Russian Caf6 and Deli Page 2 DISCUSSION Applicant's Proposal: The applicant, Efim Brisker, is requesting approval of a Conditional Use Permit (PLN 2001-50) to allow a general off-sale liquor license in conjunction with an existing caf6 and delicatessen. The caf6 and delicatessen is located on the east side of South Winchester Blvd. mid block between East Hamilton and Latimer Avenues. The site is surrounded by an office building to the north, restaurants to the south, multiple-family residences to the east and Campbell Shopping Center/Home Church to the west. Background: The existing caf~ and delicatessen currently maintains a beer and wine license and has operated at this location for the past fourteen years. This license and use was established prior to the requirement for a conditional use permit and has been operated by the current owner and applicant. ANALYSIS General Plan Designation: The General Plan land use designation for the project site is Commercial. The proposed addition of a general off-sale liquor license is incidental to the primary use of the existing caf6 and delicatessen and the requested use is consistent with the commercial land use designation of the site. Zoning Designation: The zoning designation for the project site is C-2-S (General Commercial). The existing caf~ and delicatessen is a permitted within the C-2-S zone. The addition of a general off-sale liquor license requires approval of a conditional use permit. Conditional Use Permit The applicant is requesting approval to allow the addition of general off sale liquor license to their existing caf6 and delicatessen. Attachment No. 3 describes the applicant's request to allow a general-off sale liquor license, so that they may provide liquor products that are now available from the former Soviet Union. The description provides further that they intend to maintain the current caf6 and delicatessen operation. The retail portion of the business occupies approximately 700 square feet of the 2200 square foot building. Staff is supportive of the applicant's request and considers the general off-sale liquor license incidental to the primary caf6 and delicatessen use. As such, a condition of approval restricts the size of the retail area for liquor sales to 350 square feet. Operational Hours: The applicant's description indicates that their operational hours will remain from 11 a.m. to 8 p.m. These hours are typical of retail uses and customary to a commercial property. Liquor Establishments: Staff has prepared the attached exhibit that illustrates the various liquor establishments within the vicinity of the project. The establishment of a general off-sale liquor license in conjunction with this caf6 and delicatessen does not represent an over concentration of such establishments. Police Department Review: The Campbell Police Department has reviewed the application and has no concerns or objections to the addition of a general off-sale liquor license at this location. We have operated this business for the past fourteen years, originally as the Continental Deli and more recently as the Russian Cafe and Deli. During this period we have had a beer and wine license. Our customers often request Vodka and Cognac from the former Soviet Union, because it is now available in the United States.
