BEING A RESOLUTION ACCEPTING PUBLIC
IMPROVEMENTS OF TRACT NO. 7071
WHEREAS, the City Council has been advised by the City~
Engineer that all improvements in Tract No. 7071, 70-90
Shelley Avenue, have been completed in accordance with
that agreement entered into September 6, 1983, concern-
ing said tract; and,
WHEREAS, the City Engineer recommends acceptance of the
tract and improvements;
NOW, THEREFORE, BE IT RESOLVED by the City Council that
Tract No. 7071, together with all improvements thereon,
be, and the same are hereby, accepted, and that the City
Engineer is hereby ordered to record a Notice of Com-
pletion of said improvements.

Installation of a sanitary sewerage system to serve all lots within the sub-
division in conformance with the proposed plans of the County of Santa Clara
Sanitation District No.4. Sanitary sewerage service to be provided by said
District No.4.
Installation of a water distribution system to serve all lots within the sub-
division in conformance with the plans of the San Jose Water Works.
Water service to be provided by said water company. Fire hydrants and appurte-
nances shall be provided and installed at the locations specified by the
Fire Chief, Fire Department, City of Campbell. Fire hydrant maintenance
fees shall be paid to City at the rate of $195 per fire hydrant.
Subdivider shall create or provide any public service easement and any other
public utility and/or public service easements as may be necessary for the
installation of any and all public utilities and/or facilities.
Compliance with the provisions of Title 20, Subdivisions of the Campbell
Municipal Code.

Agreement for Tract 7071.
Please note that the C C &Rs specifically exclude Lot #11 (see
Section loll), which is the single family home with the pool;
therefore, we have drawn up a Landscape Maintenance Agreement
for this lot.
It is our intention to grant a 3 foot easement along the western
property line between the single family home and the PD to the
Homeowners Association of the PD. We will build a fence on a
portion of this easement, and it will be the property of the
association to insure maintenance, etc.

If ZC 81-02 is recommended for approval, that the Planning Commission find the
proposed tentative subdivision map in accord with the General Plan and recommend
that the City Council approve the map subject to the attached conditions.
STAFF DISCUSSION
This item is directly related to ZC 81-02, application of Mr. Gary Stokes
on behalf of Cal-Com Leasing and Development, Inc., for a zone change and
approval of plans, elevations and development schedule to construct 10
townhomes.
One of the conditions of approval for ZC 81-02 requires the applicant to
file and process a tract map. If the Commission has recommended approval
of the zone change application, then it would be appropriate that the subject
tentative map be recommended for approval.
The proposed tentative map would allow the construction of 10 new townhomes
on this site, which is consistent with the General Plan designation of Low-
Medium Density Residential (6-13 units per gross acre) for this area.

No sewers are available, therefore, in order to determine the amount
of drainfield required for a septic tank system, percolation tests
will be necessary.
Individual sewage disposal requirements have been determined for this
site. A septic tank permit will be issued for construction of a
system which must then be built in conformance with Bulletin "A" or
local ordinance. lineal feet of subsurface leaching line with
room for 100% expansion and a gallon capacity tank will be
required.
Existing septic tank(s) must be pumped and backfilled in accordance
with Environmental Health standards. A bond in the amount of $
