BEING A RESOLUTION OF THE PLANNING COMMISSION OF
THE CITY OF CAMPBELL APPROVING A SIGN APPLICATION
(PLN2001-57) TO ALLOW THE INSTALLATION OF TWO WALL-
MOUNTED SIGNS ON A NEWLY CONSTRUCTED DRIVE
THROUGH AND WALK-UP ESPRESSO DRINK KIOSK (DRINX)
ON PROPERTY LOCATED AT 2415 S. WINCHESTER
BOUELVARD IN A C-2-S (GENERAL COMMERCIAL) ZONING
DISTRICT. APPLICATION OF MR. KEON VOSSOUGHI, ON
BEHALF OF DRINX. FILE NO. PLN2001-57.
After notification and public heating, as specified by law, and after presentation by the
Community Development Director, proponents and opponents, the heating was closed.
After due consideration of all evidence presented, the Planning Commission did find as follows
with respect to application PLN2001-57:
1. The proposed signs are architecturally compatible with the building in terms of style and
design.
2. The proposed sizes of the wall signs are proportional to the building.
3. The site is unusually difficult to locate in comparison to similar uses due to the location of
the kiosk in the middle of a shopping center parking lot.
4. The business would not be adequately identified with only one wall sign due to the proximity
of the building to the street frontage and the small size of the kiosk.
Based on the foregoing findings of fact, the Planning Commission further finds and concludes
that:
1. The proposed wall signs are consistent with the purposes of the Sign Ordinance by
preserving and improving the visual character of the community.
The use for which the sign is to be erected would not be adequately identified and is
unusually difficult to locate in comparison to similar uses without exceeding the standards of
the Sign Ordinance.
3. The proposed signs will not be detrimental to the public welfare or persons in the
neighborhood or the City as a whole and allows for reasonable business identification.

The applicant is hereby notified, as part of this application, that he/she is required to meet the
following conditions in accordance with the ordinances of the City of Campbell and the State of

both signs shall not exceed 39.2 square feet.

Public Hearing to consider the application of Keon Vossoughi for approval
of a Sign Exception (PLN 2001-57) to allow the installation of two wall
signs on a new drive-through and walk-up espresso drink kiosk located at
2415 Winchester Boulevard in a C-2-S (General Commercial) Zoning
District.
STAFF RECOMMENDATION
That the Planning Commission take the following action:
Adopt a Resolution, incorporating the attached findings, approving a sign exception (PLN 2001-
57) allowing two wall signs, subject to the attached Conditions of Approval.
ENVIRONMENTAL DETERMINATION
This project is categorically exempt under Section 15301, Class 1 of the
Environmental Quality Act (CEQA); therefore, no environmental action is required.

DISCUSSION
Applicant's Proposal: The applicant, Mr. Keon Vossoughi, on behalf of Drinx, is requesting
approval of a Sign Exception (PLN 2001-57) to allow the installation of two (2) wall signs on the
faCade of a new drive-through and walk-up espresso drink kiosk on South Winchester Blvd. The
applicant is permitted only one (1) wall sign under the Sign Ordinance regulations.
Background: The Planning Commission approved a Modification (PLN 2000-02) to a previously
approved Use Permit (UP 68-12) to allow the relocation and reconstruction of an existing drive-
through and walk-up espresso drink kiosk (Drinx) on February 8, 2000. No signage was
approved in conjunction with this application, although the signs were shown on the elevation.

The project site is located in the southeastern parking lot of the Campbell Plaza Shopping Center,
which is located on the west side of Winchester Blvd south of its intersection with Budd Avenue.
The 11.3-acre shopping center is surrounded by commercial uses and single-family residences to
the north, commercial auto repair uses and multiple family residences to the south, multiple
family residences to the west and a church and commercial uses to the east.
ANALYSIS
Sign Proposal: The proposed wall signs will be mounted on the building tower walls. The two
proposed wall signs are identical and each measure 19.6 square feet. The total sign area is 38.2
square feet. The applicant is requesting that the Planning Commission grant the Sign Exception
because without the two signs his business would be difficult to locate and would negatively
affect the viability of his business. Due to the small size of the building and the location of the
kiosk in the parking lot of the shopping center near the street, staff has determined that the
business would not be adequately identified with one sign on the front elevation of the kiosk
facing Winchester Boulevard.
Design: The proposed wall signs are circular plexiglass cabinet signs with internal illumination.
The sign background is white with a green outline and green letters. A coffee cup serves as a
graphic symbol. The sign design is considered to be architecturally compatible with the building
design and surrounding Shopping Center.
Sign Requirements: Under Section 21.53.090(D) of the Sign Ordinance a commercial business
is permitted one wall sign. Each business is permitted one square foot of sign area for each linear
foot of business frontage, with a maximum sign area of 50 square feet and a minimum sign area
of 20 square feet. Under these provisions, the applicant would be allowed one 20 square foot wall
sign that must be architecturally compatible with the building and of a similar design as other
businesses in the Campbell Plaza Shopping Center.
One freestanding sign is permitted for each commercial center. Although there is a freestanding
sign at the Campbell Plaza Shopping Center, the applicant's business is not identified on it.
Sign Exceptions: The Planning Commission may authorize additional signs when it determines
the following:
· The use or uses for which the signs are to be erected would not be adequately
identified; or
· The site is unusually difficult to locate in comparison to similar uses without
exceeding the standards provided in the Sign Ordinance.
Site and Architectural Review Committee: The Site and Architectural Review Committee
reviewed the proposed project at its meeting of May 22, 2001 and is supportive of the proposed
project.

Dear Planning Commissioners:
The construction of the Winchester light rail station that is presently
tmderway, is adversely affecting many business owners due to the fact that
in many cases, they must make costly adjustments in order to keep their
businesses viable. Specifically, my business "DRINX DRIVE THRU
ESPRESSO BAR", located at 2415 S. Winchester Blvd., in the Plaza
Shopping Center, is in the pathway of a future entrance to the center
proposed by public works. In order to protect the future of my business, I
am forced to relocate my building/kiosk approximately 50 feet from its
present location.
My request to you, the planning commissioners, is to allow me to place (2)
two signs on the new structure. In compliance with the sign ordinance, the
signs will not exceed forty square feet.
Nine years ago the city of Campbell issued me a permit allowing (4) four
signs with aggregate coverage allowed by the ordinance (sketch attached).
Without a minimum of (2) two signs on the new structure, the kiosk will be
difficult to locate and will negatively affect the viability of my business.
On May 3, 2001, senior planner Geoff Bradley and planner Darcy Smith
visited the new site and are well informed of my situation.

Proposal:
The applicant is requesting approval of a sign permit to allow the installation of two wall
signs. The proposed wall signs are circular plexiglass signs with internal illumination. They
are five feet in diameter and measure 19.6 square feet each.
Under the Sign Ordinance, commercial businesses are permitted one wall sign with an
area equal to one square foot of sign area for each linear foot of business frontage, on
which the sign is proposed to be located. No sign shall be greater than fifty square feet.
Each sign shall be allowed a minimum of twenty square feet.
One freestanding sign is permitted for each parcel of land or commercial center.
Section 21.53.030' Administrative procedures" of the Sign Ordinance states that the planning
commission may authorize more signs when it determines the following:
a. The use for which the signs are to be erected would not be adequately identified; or
b. The site is unusually difficult to locate in comparison to similar uses without exceeding the
standards provided in this chapter.
Issues or concerns:
Compatibility with existing shopping center signs. The Sign Ordinance requires
individual signs for occupants in the same shopping center shall be of the same design
insofar as possible.
Compatibility with building. The proposed sign appears to be too large for the
building wall that it is proposed to be located on.
