The photos also demonstrate that the planters become a dumping ground for discarded cups, napkins, cigarette butts, and other unsightly debris. 3. It is our goal to provide a clean and safe environment free of debris, dirt and water hazards, as well as maintain a professional appearance at all times. It is obvious from the photos that our competitor does not steam clean it's common area on a regular basis as we do. I feel that the installation of the planters would be co~t~roductive to our goals of cleanliness and safety. There is going to be (1) one (6) six yard dumpster with the measurements of 6'10" long by 5'-0" high by 6'-0" wide. In the near future they (Drinx) will be adding with (3) three 105-gallon recycling bins, glass, plastic, and paper. These bins are approximately 32" wide by 4'-6~ high by 24" wide. W~th the added recycling center there is a need to increase the size of the trash enclosure from 9'-7" by 9'-7" to 11'-4" by 11'-4". Having the recycling center allows drinks to recycle all of the used plastic or glass flavoring bottles, milk jugs, boxes that the supplies come in, etc. Without the recycling center all of those items that could be easily recycled are, instead, thrown away, thus taking up all of our landfill space. Having an allocated spot in the trash area hides the large and bulky bright blue bins that would otherwise be placed outside the rear door of the building. Below you will find a small sketch of approximately how the trash area will be laid out. This arrangement may change due to where doors and such are located. Therefore, we will replant (2) two of the trees near the rear of the proposed building on the edges of the aisle (one on either side of the Dumpster area). #5d Keeping in line with 5c we will use another (2) two of the trees that we are removing and replanting them in the planting islands on the east edge of the parking aisle (in the new island that will be replacing the existing Drinx Kiosk). In addition we will be adding another small island, to match existing islands located throughout the parking lot: It measures approximately 9'-0" x 5'-0". It will contain (1) one of the existing trees to be removed and some jasmine for ground cover. This was shown on sheet C-1 but not on C-2 in the previous submittal. I have made the appropriate changes to sheet C-2 to match the drawing on sheet C-1. So, the total number of trees to be removed will be (7) seven and we will be replanting (5) five of them, therefore we will be loosing a total of (2) two trees. If for some reason the re-planted trees do not take to their new location, they will be replaced with 24" box Ornamental Pear or Flowering Cherry trees. #7 The parking lot lights have been discussed and we have come to the conclusion of re-using the light that will be removed, in order to make way for the new Drinx kiosk, and placing it in the exact position noted on the plans. It doesn't have to be placed in a concrete island, du to the fact that we are mimicking other lights in the parking lot. #9 Regarding the trash disposal/recycling Drinx has requested that there be enough room for recycling bins and a dumpster. Please see the attached letter addressed to Sharon Fierro. The project is adequately served by streets of sufficient capacity to carry the kind and quantity of traffic such uses would generate. Extended hours of operation: The permitted hours of operation are from 5:00 a.m. to 11:00 p.m. daily. If the Community Development Director receives substantiated complaints regarding noise or impacts associated with early hour operations, the Director may limit the operational hours of the business within 10 days written notice. 3. Architectural Details: Plans submitted for building permits shall change the color of the awning from beige to maroon to match the color of the roof of the adjacent shopping center. 4. Signs: No signing is permitted as part of the development applications approved herein. A new parking lot light that matches the existing lights in the parking lot shall be installed-at the edge of parking aisle after demolition of the existing kiosk. Restoration of parking and tree: The parking aisle where the existing kiosk is located must be returned to its original condition through the replacement of the parking space striping, planting island, trees, and parking lot light within thirty (30) days of final occupancy of the proposed building. This condition is subject to extension by the Community Development Director if adverse circumstances arise. Conditions of Approval: Plans submitted for Building Permits shall include a sheet that contains a copy of the Conditions of Approval. 12. Permits required: A building permit application shall be required for the proposed structure. The building permit shall include Electrical/Plumbing/M~hanical fees when such work is part of the permit. · 13. Demolition of existing building: The applicant shall obtain a demolition permit to remove the existing building within thirty (30) days of issuance of final occupancy. This condition is subject to extension by the Community Development Director if adverse circumstances arise. 14. Size of Plans: The maximum size of construction plans submitted for building permits shall be 24-inches by 36-inches. The minimum size is 18-inches by 24-inches. 15. Calculations and Details: Provide calculations and details required for review and approval by the Building Division, prior to issuance of building permits. 16. Construction Mitigation Measures: The applicant shall implement measures including the following: Ao Construction activities will be limited to daytime hours of 8:00 am to 5:00 p.m. weekdays and 9:00 a.m. to 4:00 p.m. Saturdays. Construction is prohibited on Sundays and Holidays unless an exception is granted by the Building Official. B. No pile driving is allowed for construction of the project. C. Ail internal combustion engines for construction equipment used on the site will be properly muffled and maintained. D. All stationary noise generating construction equipment, such as air compressors and portable power generator, will be located as far as practical from the existing businesses. E. All active construction areas shall be watered at least twice daily. F. Cover all trucks hauling soil and other loose materials stationed or prior to leaving the site. Campbell Avenue: · Expressed concerns about traffic and pedestrian safety on Campbell and Leigh Avenues. Stated that a crosswalk is needed at Campbell and Leigh Avenues. At the present time, the nearest crosswalks are at Hamilton Avenue in one direction and Dry Creek Road in the other direction, both of which are quite a distance away from Campbell and Leigh Avenues. · Advised that he and his wife must cross this busy street (Leigh Avenue) each day as they walk to church. · Described a recent accident, which occurred when an inattentive driver rear-ended a car that had stopped to allow he and his wife to cross. · Said that they are only able to cross one half the road at a time and must wait at the middle of the road for the second half to clear enough to cross. · Questioned the purpose for the concrete barrier on Arroyo Seco which causes additional traffic onto Campbell Avenue. · Advised that he and his wife have difficulties leaving their driveway due to the amount of traffic. · Asked the City for help with these concerns. Mrs. Eloise Adamo, 1470 E. Campbell Avenue: · Suggested the posting of "No Left Turn" signs from Campbell Avenue onto Leigh Avenue. · Said that limiting such left turns from 6 to 9 a.m. and from 3 to 7 p.m. might prevent some accidents. Commissioner Francois asked Mrs. Adamo whether she felt that a crosswalk across Leigh Avenue near Campbell Avenue would be helpful. Mrs. Eloise Adamo replied that she felt such a crosswalk would be helpful as currently the only crosswalks are at Hamilton Avenue and Dry Creek Road. Ms. Sharon Fierro, Interim Community Development Director, advised that she will forward the Adamo's concerns over to the Public Works Department and ask Public Works Staff to contact the Adamo's directly to discuss options. PUBLIC HEARING Chairperson Gibbons read Agenda Item No. 1 into the record. PLN2000-02 Martin, T. Public Hearing to consider the application of Mr. Terry Martin, on behalf of Mr. Keon Vossoughi, for approval of a Modification (pLN2000-02) to a previously-approved Conditional Use Permit for the relocation and reconstruction of a drive thru espresso drink kiosk (Drinx) on property located at 2415 S. Winchester Boulevard in a C-2-S (General Commercial) Zoning District. This project is Categorically Planning Commission Minutes of February 8, 2000 Page 3 Exempt from environmental review. Planning Commission decision final, unless appealed in writing to the City Clerk within 10 days. Ms. Darcy Smith, Planner I, presented the staff report as follows: · Stated that the applicant is seeking a Modification to a previously-approved Conditional Use Permit to allow the relocation and construction of a kiosk located in the parking lot of Campbell Plaza at 2415 S. Winchester Boulevard. · The project is consistent with the General Plan designation (Commercial) and Zoning (C-2- S/General Commercial). · Advised that the applicant has worked extensively with staff in developing the plans for this project. Additions will include a bathroom and additional counter space, two drive-up windows and one walk-up window facing Winchester. The proposed building materials match the existing shopping center with beige stucco and red roofing material. The new location of the kiosk is 60 feet south of the existing structure. The existing structure will be removed and landscaping installed to match the existing shopping center landscaping. The new location will allow improved circulation in the parking lot. The project site is across the street from the future VTA Light Rail Station. Advised that there is no loss of parking with this project and that the center actually has a surplus of 144 parking spaces. The applicant is also seeking a change in operational hours so that they can open at 5:30 a.m. instead of 6 a.m. Staff recommends the adoption of a Resolution approving this project subject to the Conditions of Approval. Commissioner Lowe sought clarification that parking is not impacted by this project. Ms. Darcy Smith advised that there is no net loss of parking. Chairperson Gibbons asked whether signage was a part of this application. Ms. Darcy Smith replied that signage is not a part of this application. The signs depicted on the drawings are simply schematics. Signage will need to be evaluated separately. Mr. Keon Vossoughi, Owner, Drinx, 2415 S. Winchester Boulevard: · Advised that his new building has been designed with ease of maintenance in mind and the addition of planters is of concern. · Asked that the requirement for planters be eliminated. · Asked that the Commission remove the requirement for the placement of a trash receptacle at the bus stop some distance away from his business. · Asked that the Commission allow the installation of 15 gallon trees in lieu of 24-inch box. · Requested a starting time of 5 a.m. instead of 5:30 a.m. Planning Commission .Minutes of February 8, 2000 Page 4 Commissioner Lindstrom presented the Site and Architectural Review Committee report follows: · Advised that SARC reviewed this project on January 25, 2000, and was supportive. · Asked the applicant exactly what changes he was seeking in the Conditions of Approval. Mr. Keon Vossoughi · Replied that he is seeking operational hours beginning at 5 a.m. · Stated that overflow water from the planters would make a mess of his driveways. · Asked that the planters and the requirement for off-site trash receptacle be eliminated and that the replacement trees be 15 gallon instead of 24-inch box. Commissioner Lindstrom asked why Mr. Vossoughi did not make this request at SARC rather than at this late stage in the process. Mr. Keon Vossoughi replied that the planters do not fit well into the design of his project. Commissioner Francois asked if there is a trash receptacle near the Drinx building. Mr. Keon Vossoughi replied that there is a trash receptacle at his building. Added that his business is a 100% "to go" business. Commissioner Lowe asked what percentage of the business is walk up. Mr. Keon Vossoughi replied that two to three percent of his business is walk up. Generally, the walk up business includes the employees of the shopping center. Commissioner Hemandez asked the applicant if he objected to all four planters. Mr. Keon Vossoughi replied that he was opposed to all four planters. Also asked to be allowed to plant perennials instead of annuals. Commissioner Francois stated that he was not opposed to 15-gallon trees and the use of perennials. Mr. Keon Vossoughi stated that he was interested in low maintenance landscaping. Ms. Darcy Smith: · Stated that staff can support operational hours beginning at 5 a.m. · Advised that she had visited another site designed by this project's architect which incorporated the use of planters. · Stated that Mr. Vossoughi's concerns about overflow from watering the plants causing a mess in his driveway can be resolved with the use of drip catchers below the pots. · Advised that the City's Tree Protection Ordinance requires that when mature trees are removed, they must be replaced with like sized trees. Commissioner Hemandez asked who would be responsible for emptying the trash receptacles, particularly the one at the bus stop. Ms. Sharon Fierro, Interim Community Development Director, replied that the applicant would be required to empty the trash receptacles. Added that the bus stop is a logical walking path for patrons to this project. Commissioner Keams reiterated that the 24-inch box tree is the standard for the replacement of mature trees. Mr. Keon Vossoughi stated that the Campbell Plaza has several businesses with "to go" products including Safeway. Questioned why he would be the one required to place and maintain a trash receptacle off site. Chairperson Gibbons closed the Public Hearing for Agenda Item No. 1. Commissioner Lowe: · Stated that the planters are necessary. · Said that one trash receptacle (on site) would be adequate. · Supported the requirement for 24-inch box trees. · Said that a starting time of 5 a.m. is acceptable. · Agreed that perennials would be fine instead of annuals. Commissioner Francois: · Agreed with Commissioner Jones and Commissioner Lowe. · Stated that the applicant should not have the burden alone as other businesses in the center also have "to go" products. · Said that 15-gallon replacement trees are not consistent with the Tree Ordinance. Commissioner Keams asked whether the Commissioners were recommending no trash receptacles. Commissioner Jones stated that he supported no trash receptacles unless problems occur and trash from this business becomes an issue. Chairperson Gibbons asked staff if the applicant had objected to the 24-inch box trees previously. Ms. Darcy Smith, Planner I, replied that the applicant had not objected previously. Commissioner Jones suggested that the size of the planter boxes be left to the discretion of staff. Ms. Darcy Smith, Planner I, clarified that the planter size is two feet high and two feet in diameter. Chairperson Gibbons asked where the planters are to be placed. Ms. Sharon Fierro, Interim Community Development Director, replied that two would be at the front of the building and two at the rear of the building for a total of four. Commissioner Lindstrom: · Supported a 5 a.m. start time. · Said that staff can work with the applicant on the planter sizes and location. · Agreed that 24-inch box trees would be required. · Advised that a trash enclosure is already part of this project. Adding a trash receptacle at the bus stop can be revisited in the future but should be considered an obligation of the shopping center as a whole and not just this merchant. Commissioner Lowe questioned why not place a trash receptacle near the Drinx building. Commissioner Francois replied that the applicant is currently operating without a trash receptacle and that it works out fine. The location proposed is approximately 60 feet south of the existing location at the easterly end of a parking aisle. The proposed building will have two drive-up windows and a walk-up window facing Winchester Blvd. The proposed building will continue to provide similar service to the existing operation. The new building will provide a bathroom for employees and customers and change the interior layout to meet the requirements of the Santa Clara County Environmental Health Department. The applicant is also requesting a change of business hours from the existing approval to allow the business to open a half-hour earlier at 5:30 a.m. Location: The Campbell Plaza Shopping Center is located on the west side of Winchester Blvd south of its intersection with Budd Avenue. The 11.3-acre shopping center is surrounded by commercial uses and single-family residences to the north, commercial auto repair uses and multiple family residences to the south, multiple family residences to the west and a church and commercial uses to the east. The project site is located in the southeastern portion of the parking lot approximately 30 feet west of Winchester Boulevard. The building is surrounded on all four sides by commercial uses. It is directly across the street from the future Santa Clara Valley Transportation Authority (VTA) Winchester Light Rail Station and Park-N-Ride. The proposed building represents the smallest tenant space in the shopping center. Staff Report - Planning Commission Meeting of February 8, 2000 PLN 2000-02 2415 South Winchester Blvd. Page 3 Background: The Planning Commission approved a Use Permit (UP 68-12) for the establishment of the shopping center. The Planning Commission approved a freestanding building located in the parking lot of the shopping center for the sale of photographic development services and supplies in 1972. This approval was modified by the Planning Commission in 1983 to permit the establishment of a flower shop next to the existing retail building. These two buildings were removed and later replaced with the existing drive-through and walk-up espresso drink kiosk in 1993. ANALYSIS General Plan Designation: The project site is designated as Commercial on the General Plan Land Use Element Map. The existing use is consistent with the Commercial designation. Zoning Designation: The zoning designation for the project site is C-2-S (General Commercial). The proposed use is permitted through a previous approval for a drive-up commercial building on the site. Building Design: The applicant is proposing to construct a 260 square foot building consisting of an espresso drink preparation room, two (2) drive-up windows, one walk-up window and a bathroom. The tower element that is above the bathroom on the rear of the building conceals mechanical equipment. Wood braces, canvas awnings, and glass windows on three sides of the building create an attractive design. The proposed building matches the design of the shopping center using a beige stucco wall finish and a metal roof, trim, and awning matching the maroon color of the roofs of the surrounding shopping center buildings. The placement of the walk-up window facing Winchester Boulevard is oriented towards the pedestrian corridor of Winchester Boulevard. Parking and Circulation: The Zoning Ordinance requires the provision of 633 parking spaces for the existing shopping center. Currently 777 spaces are provided, resulting in an excess of 144 spaces. The project would result in the removal of ten (10) spaces from the aisle; however, ten (10) spaces would be replaced in the adjacent aisle after the demolition of the existing structure. There is no net loss of parking spaces. The proposed location will result in improved circulation within the parking lot. The existing structure is not centered in the parking aisle and impedes the flow of traffic within the parking lot. The proposed location of the new building is centered in the aisle and set back from the end of the aisle. The drive-through lanes are proposed to be well marked with stamped concrete and defined by concrete curbs. Although the proposed building may cause the stacking of vehicles as they wait behind other vehicles to pull up to the drive-through window, this stacking is likely to occur only during peak business hours (6 a.m. to 9:30 a.m.). Since most of the tenants in the surrounding buildings open at 10 a.m. or later, the stacking and increased traffic in the parking lot will not cause a significant impact on the shopping center circulation. Staff Report - Planning Coi,mission Meeting of February 8, 2000 PLN 2000-02 2415 South Winchester Blvd. Page 4 Landscaping: A condition of approval requires the applicant to restore the parking aisle planter and construct new islands planters to enhance the project. Freestanding planters will also be required on the concrete pads in front and behind the building. The development of this proposal will require the removal of three trees from the existing parking aisles. In addition, two trees will be removed from the existing trash enclosure area in order to restore the parking spaces in the aisle where the kiosk is currently located. The applicant is proposing to plant two trees at the rear of the new building site and will be required to plant two trees in the parking aisle planter that will be located at the site of the existing kiosk. Trash Enclosure: A condition of approval requires the provision of a trash enclosure to accommodate both disposal and recycling needs of the commercial use. This trash enclosure must match the building in terms of color and finish. An on-site trash receptacle must also be provided for walk-up patrons. Operational Hours: The existing approval restricts business hours from 6 a.m. to 11 p.m. The applicant is requesting extension of these hours from 5:30 a.m. to 11 p.m. The business currently closes at 8 p.m. The peak business hours are from 6 a.m. to 9 a.m, when the other tenants in the shopping center are closed. The opening of this business a half-hour earlier will not cause a disturbance to any residences or other uses since the business is not located near any residences nor any other uses that would be adversely effected by these early business hours. Site and Architectural Review Committee: This application was reviewed by the Site and Architectural Review Committee at its meeting of January 25, 2000. The Committee was supportive of the applicant's proposal subject to the requirement that the existing building be demolished and the parking and landscaping be replaced within 30 days of the granting of final occupancy of the new building. Dear Ms. Smith, In response to your comment letter dated Dec. 28 1999 we would like to clarifying the design program for the "Drinx" kiosk. Besides the obvious programmatic requirements of drive-through coffee service we had to consider the addition of a rest room for the employees and visual screening for mechanical equipment to serve the structure. This was accomplished by the creation of a "tower" element that is on the west side of the building away from Winchester Blvd. The space contains a restroom at floor level and the mechanical equipment in the upper portion of the structure. This configuration allowed us to create a building with a variation in scale such that it is pleasing to the eye from both Winchester Boulevard and the parking lot. If we had designed the building with the typical flat roof and parapet walls to screen equipment, the structure would have been a 14' tall box. The selection of the green roof came from the structures immediate surroundings. There are a large number of parking lot trees at this location and the building is set among the trees, not next to one of the existing structures. We also believe that the green roof is a complement to the dark mst color roof of the existing structures. It is also in keeping with the color scheme of the Drinx logo. Though we recommended the green roof and trim, per your request, we have also provided a color scheme with a rust colored roof and trim. The color scheme of the body of the kiosk is based on a Latte coffee with a darker bottom lighter middle and white top. This scheme also will help hide the auto traffic dirt on the lower portion of the building. In response to your comment regarding the height of the tower we would like to mention that it is serving as the mechanical space for the building. We have taken advantage of this by placing the Drinx logo on the north and south side of the tower. The painted metal roof, cement plaster finish, and simple rectangular shaped form included in your design are found at the shopping center.
