RESOLUTION NO. 5296
BEING A RESOLUTION AUTHORIZING
EXECUTION OF WILLIAM ERRICO AND
LORETTA A. ERRICO AGREEMENT.
WHEREAS, there has been submitted to the City Council by William
Errico and Loretta A. Errico an agreement for the development of their
real property in accordance with prescribed conditions; and,
WHEREAS, by the terms of said agreement, and concurrently herewith,
they have submitted a grant deed of certain portions of their property
for street purposes;
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of
Campbell that the Mayor be and he is hereby authorized to execute the
said agreement on behalf of said City; and,
BE IT FURTHER RESOLVED that the grant deed submitted in connection
therewith be and the same is hereby accepted.

KNOW ALL MEN BY THESE PRESENTS:
Whereas, The City Council of the City of Campbell, State of
California, and WILLIAM ERRICO and LORETTA A. ERRICO
(hereinafter designated as "principal") have entered into an
agreement whereby principal agrees to install and complete certain
designated public improvements, which said agreement, dated
, 19_, and identified as No. McG. (168)
is hereby referred to and made a part hereof; and
Whereas, Said principal is required under the terms of said
agreement to furnish a bond for the faithful performance of said
agreement.
Now, therefore, we, the principal and PACIFIC INSURANCE COMPANY
, as surety, are held and
firmly bound unto the City of Campbell, hereinafter called "City",
in the penal sum of THREE THOUSAND SEVEN HUNDRED FIFTY-------------

United States, for the payment of which sum well and truly to be
made, we bind ourselves, our heirs, successors, executors and
administrators, jointly and severally, firmly by these presents.
The condition of this obligation is such that if the above f
bounded principal, his or its heirs, executors, aruninistrators,
successors or assigns, shall in all things stand to and abide by,
and well and truly keep and perform the covenants, conditions and
provisions in the said agreement and any alteration thereof made
as therein provided, on his or their part, to be kept and performed
at the time and in the manner therein specified, and in all respects
according to their true intent and meaning, snd shall indemnify and
save harmless said City, its officers, agents and employees, as
therein stipulated, then this obligation shall become null and
void; otherwise it shall be and remain in full force and effect.
As a part of the obligation secured hereby and in addition to
the face amount specified therefor, there shall be included costs
and reasonable expenses and fees, including reasonable attorney's
fees, incurred by City in successfu~ enforcing such obligation,
all to be taxed as costs and included in any judgment rendered.
The surety hereby stipulates and agrees that no change,
extension of time, alteration or addition to the terms of the
agreement or to the work to be performed thereunder or the
specifications accompanying the same shall in anywise affect its
obligations on this bond, and it does hereby waive notice of any
such change, extension of time, alteration or addition to the terms
of the agreement or to the work or to the specifications.

1. Property to be fenced and landscaped as Indicated and as added in "red"
on plans.
2. Landscape plan indicating type of plant material, location of hose bibs
or sprinkler system and type of fencing to be submitted for approval
of the Planning Director at time of appl ication for building permit.
3. Landscaping shall be maintained in accordance with the approved
landscape plan.
4. Faithful performance bond in the amount of $5,000 to be posted to
insure landscaping, fencing and striping of parking area within three
(3) months of completion of construction, or applicant may file written
agreement to complete landscaping, fencing and striping of parking
area prior to final Building Department clearance.
5. Revised elevations to be approved by the Planning Director.
6. Driveway design and materials to be approved by Planning Director.
The appl icant is notified as part of this appl ication that he is required
to meet the following conditions in accordance with provisions of Ordinances of the
City of Campbell.
A. All parking and driveway areas to be developed in compl iance with
Section 21.50 of the Campbell Municipal Code. All parking spaces to
be provided with appropriate concrete curbs or bumper guards.
B. Underground util ities to be provided as required by Section 20.16.070
of the Campbell Municipal Code.
C. Plans submitted to the Building Department for plan check shall
indicate clearly thelocation of all connections for underground utilities
including water, sewer, electric, telephone and television cables, etc.
D. Sign appl ication to be submitted in accordance with provisions of the
sign ordinance for all signs. No sign to be installed until application
is approved and permit issued by the Building Department.
E. Ordinance No. 782 of the Campbell Municipal Code stipulates that any
contract for the collection and disposal of refuse, garbage, wet garbage,
and rubbish produced within the 1 imits of the City of Campbell shall
be made with Green Valley Disposal Company. This requirement appl ies
to all single family dwellings, multiple apartment units, to all
commercial, business, industrial, manufacturing, and construction
establ ishments.
F. Trash container(s) of a size and quantity necessary to serve the
development shall be located in area(s) approved by the Fire Department.
Unless otherwise noted, enclosure(s) shall consist of a concrete floor
surrounded by a sol id wall or fence and have self-closing doors of a
size specified by the Fire Department. All enclosures to be constructed
at grade level.

J. Execute an agreement, post bonds, and agree to sign a petition
to form an assessment district to improve Union Avenue.
K. Obtain an excavation permit for any work within the street right-of-way.
L. Relocate driveway to maintain minimum distance of 5 feet from property
line.
FIRE DEPARTMENT
M. Provide 2A-IOBe fire extinguishers.
N. Provide a manual fire alarm system.
O. Provide an on-site hydrant system connected to the street main.
The appl icant is notified that he shall comply with all appl icable Codes
or Ordinances of the City of Campbell which pertain to this development
and are not herein specified.
