OF THE CITY OF CAMPBELL GRANTING A
REINSTATEMENT (PLN2000-113) TO ALLOW THE
MODIFICATION TO A SITE AND ARCHITECTURAL
APPROVAL TO ALLOW A 695 SQUARE FOOT ADDITION TO
AN EXISTING VETERINARY CLININC ON PROPERTY
LOCATED AT 3265 WINCHESTER BOULEVARD IN A C-2-S
(GENERAL COMMERCIAL) ZONING DISTRICT.

After notification and public hearing, as specified by law, and after presentation by the
Community Development Director, proponents and opponents, the hearing was closed.
After due consideration of all evidence presented, the Planning Commission did find as follows
with respect to application PLN2000-113'
There have been no changes in the General Plan and the zoning of the property since the
previous approval of the project.
There have been no changes in the development standards or regulations that would
warrant change to the conditions of approval, other than the request for an extension of
time.

The applicant is requesting the extension of time to facilitate the completion of the
project.
There have been no changes in the proposed project other than the request for an
Extension of time.
Based upon the foregoing findings of fact, the Planning Commission further finds and concludes
that:
1. The proposed project is consistent with the General Plan and the local zoning ordinance.
2. The proposed project as conditioned will aid in the harmonious development of the
immediate area.

The establishment, maintenance or operation of the use applied for will not be detrimental
to the health, safety, peace, morals, comfort, or general welfare of persons residing or
working in the neighborhood of such proposed use, or be detrimental or injurious to
property and improvements in the neighborhood or to the general welfare of the City.

The Reinstatement (PLN 2000-113) and extension of time to the Modification (M 97-01)
for this project is for a period of two-years fi:om the date of the Planning Commission
approval.
5. The proposed site is adequately served by streets of sufficient capacity to carry the kind
and quantity of traffic the proposed use would generate.
6. The proposed site is adequate in size and shape to accommodate the proposed project and
will integrate well with the existing uses in the surrounding area.
The applicant is hereby notified, as part of this application, that he/she is required to meet the
following conditions in accordance with the ordinance of the City of Campbell and the State of
California. The lead department with which the applicant will work is identified on each
condition where necessary. Additionally, the applicant is hereby notified that he/she is required
to comply with all applicable Codes or Ordinances of the City of Campbell and the State of
California that pertain to this development and are not herein specified:
COMMUNITY DEVELOPMENT DEPARTMENT:
1. Development Approval Expiration: Approval is granted for a Reinstatement (PLN 2000-113)
of Modification (97-01) for a two-year extension of time to allow the remodeling and
addition of a 695 square foot building addition to an existing 1,080 square foot veterinary
hospital located on property located at 3265 S. Winchester Boulevard. The extension will
expire on October 10, 2002.
Previous Conditions: All conditions of approval of the previously approved Reinstatement (R
98-01) and Modification (M 97-01) as approved by Resolution No. 3151 and Resolution No.
3074 shall remain in effect, except as modified by conditions herein.
PUBLIC WORKS DEPARTMENT:
3. Proof of Ownership: Prior to issuance of any grading, drainage, or building permits for the
site, the applicant shall provide a current preliminary title report, grant deed, or other
satisfactory proof of ownership.
o
Right-of-Way for Public Street Purposes: Prior to issuance of any grading or building
permits for the site, the applicant shall cause additional Right-of-Way to be granted for
Public Street Purposes along the Winchester Boulevard frontage to accommodate 45 foot half
street. The applicant shall cause all documents to be prepared by a registered civil
engineer/land surveyor, as necessary, for the City's review and recordation.
Street Improvements: Prior to issuance of any grading or building permits for the site, the
applicant shall execute a street improvement agreement and shall cause plans for public
Street Improvements to be prepared by a registered civil engineer, pay fees, post security and
provide insurance necessary to obtain an encroachment permit for construction of the
standard public street improvements, as required by the City Engineer. The fee for a non-
utility encroachment permit is $245.00. The plans shall include the following:

a. Reconstruction of the existing driveway approach in compliance with current ADA
requirements.
b. Construction of undersidewalk drains as appropriate.
c. Construction of 10-foot sidewalk.
d. Construction of curb and gutter as necessary.
e. Construction of conforms to existing public and private improvements as necessary.
6. Water Meter(s) and Sewer Cleanout(s): Existing and proposed Water Meter(s) and Sewer
Cleanout(s) shall be installed on private property behind the public right-of-way line.
o
Utilities: All new on-site Utilities shall be installed underground per Section 20.36.150 of
the Campbell Municipal Code for any new or remodeled buildings or additions. Applicant
shall comply with all plan submittals, permitting, and fee requirements of the serving utility
companies.
Utility Installation Plan: Prior to issuance of building permits for the site, the applicant shall
submit a Utility Installation Coordination Plan and Schedule for approval by the City
Engineer for installation of street improvements and/or abandonment of all utilities. Streets
which have been resurfaced within the previous 5 years will require boring and jacking for all
new utility installations. Applicant shall also prepare pavement restoration plans for approval
by the City Engineer prior to any utility installation or abandonment.
Grading and Drainage Plan: Prior to issuance of any grading or building permits for the site,
the applicant shall conduct hydrology studies based on a 10 year storm frequency, prepare an
engineered Grading and Drainage Plan, and pay fees required to obtain necessary grading
permits. The plans shall comply with the 1998 edition of the California Building Code
including Chapters 10, 11, 18, 33, and Appendix Chapter 33.
10. Storm Drain Area Fee: Prior to issuance of any grading or building permits for the site, the
applicant shall pay the required Storm Drain Area fee which is $2,500 unless previously paid.
11. Storm Water Pollution Prevention Measures: Prior to issuance of any grading or building
permits, the applicant shall comply with the National Pollution Discharge Elimination
System (NPDES) permitting requirements and the California Storm Water Best Management
Practices handbook prepared by the Storm Water Quality Task Force, Santa Clara Valley
Water District and the City of Campbell Municipal Code regarding Storm Water Pollution
Prevention.
12. Site Plan: Upon submittal of a formal application, the developer shall provide a complete
and accurate Site Plan in accordance with the Planning Division's checklist.

Public Heating to consider the application of Dr. Karen Langeman,
on behalf of Porte Veterinary Clinic, for approval of a Reinstatement
(PLN2000-113) to allow the Modification to a Site and Architectural
Approval to allow an addition to an existing veterinary clinic on
property located at 3265 Winchester Boulevard in a C-2-S (General
Commercial) Zoning District. This project is Categorically Exempt.
Planning Commission decision final in 10 days, unless appealed in
writing to the City Clerk.
Ms. Sharon Fierro, Community Development Director, presented the staff report as follows:
· Stated that a Use Permit (UP82-16) was approved in 1982 allowing the establishment of a
veterinary clinic on this site.
· Advised that in 1997, the applicant obtained an approval for a 695 square foot addition to the
building on this site. The building is a conVerted former residence. This addition was never
constructed and the approval expired.
· An 18-month Reinstatement was approved in March 1998. This Reinstatement expired in
September 1999, without the addition being constructed.
· Advised that the applicant is now asking for another Reinstatement, good for two years. The
proposal, for an addition at the front of the existing building, on the south property line, is
consistent with existing requirements and has not changed from the original submittal and
approval.
· SARC did not review this project as there are no changes proposed, just an extension of time.
· Staff recommends approval.
Commissioner Lowe asked how many Reinstatements are allowed.
Ms. Sharon Fierro:
· Advised that there are no limits to the number of times a Reinstatement can be requested.
Each time a Reinstatement is sought, a Public Heating is held and a review of current
requirements is considered. The Reinstatement is not guaranteed if requirements change.
· Added that this is still an acceptable project.
Commissioner Lowe asked why the applicant wants a two-year approval instead of 18 months.
Ms. Sharon Fierro informed that one of the reasons additional time is needed is the difficulty in
securing a contractor during these busy times, particularly for smaller additions such as this one.

Commissioner Doorley asked whether two parking spaces would be lost as a result of the
addition.
Ms. Sharon Fierro replied yes.
Commissioner Doorley asked whether all the spaces are compact spaces.
Ms. Sharon Fierro replied that some are compact and others standard.
Commissioner Doorley asked if a handicapped parking space is provided.
Ms. Sharon Fierro assured the Commission that the Building Department verifies compliance
with ADA requirements, which would include the provision of sufficient handicapped parking.
Commissioner Lindstrom sought clarification that there are no changes from the original
approval and that the project meets all current codes.
Ms. Sharon Fierro stated that this project has neither any changes from the original approval nor
deviations from code.
Commissioner Doorley advised that looking at the site plan he can see only 10 spaces not the 11
required.
Ms. Sharon Fierro pointed out that the eleventh space is the handicapped space located at the
front of the building.

DISCUSSION
Applicants' Proposal: The applicant is requesting approval for a reinstatement and a two-year
extension of Modification (M 97-01) allowing a 695 square foot building addition to an existing
1,080 square foot veterinary hospital located at 3265 S. Winchester Boulevard. The applicant
stated that she originally postponed the remodeling of the veterinary hospital due to financial
reasons. As contractors are busy at this time, she is requesting approval for a two-year extension
to give her adequate time to hire a contractor.

ANALYSIS
Background: In 1982 the Planning Commission approved a Conditional Use Permit (UP 82-16)
for a veterinary hospital on the site. In 1997, the Planning Commission granted approval of a
Modification (M 97-01) to the previously approved Conditional Use Permit allowing a 695
square foot addition to the existing veterinary hospital. The addition was not built within a year
of the Modification approval, so the applicant requested an extension of time for the
Modification approval. On March 24, 1998 the Planning Commission approved an extension of
time (R 98-01) to the Modification approval for 18 months. The extension expired on September
24, 1999. At this time, the applicant is requesting a reinstatement of the expired approval, and an
extension of time of the Modification approval (M 97-01) for two years.
Reinstatement/Extension of Time for the Modification: The application for an Extension of time
to a previously approved Modification (M 97-01) includes no changes from the previous
approval. If approved for two years, the Planning Commission approval will expire on October
10, 2002.
General Plan Designation: The site has a Commercial General Plan designation. The General
Plan designation for this site has not changed and the proposed use of the property is consistent
with the current land use designation.
Zoning Designation: The Zoning designation for the site is C-2-S (General Commercial). The
Zoning of the subject property has not changed since the modification was approved. The project
is consistent with the Zoning.
Site and Building Design: The proposed building expansion is located at the front of the
existing building, and along the southern side of the property line. The existing building is a one
story rectangular structure with horizontal wood siding, wood casement windows, and a
composition shingle roof. The addition is consistent with the existing building in terms of scale,
design, and building materials. The applicant is not proposing any changes to the original plans
that were previously approved by the Planning Commission for Modification M 97-01.
Site and Architectural Review Committee: The Site and Architectural Review Committee did
not review this application given that the applications entail only a request for an Extension of
time to the previously approved Modification. No other changes are requested of the previous
approvals.

Re: Expansion of Veterinary Hospital 3265 Winchester Boulevard
Dear Sharon,
I recently had an appointment with Dr. Karen Langeman to check one of my pets. At that
time, she mentioned that she intends to expand her facility in the near future. Dr.
Langeman received approval from the Planning Commission a few years ago
(Modification to existing Use Permit), and subsequently applied for and received one
Extension of Time for the Modification. She believes the extension has now expired. I
was the project planner the first go around, and became one of her clients during the
process. Her practice has grown and she feels that now is the time to pursue the
expansion.
Since this process is a bit unfamiliar to her, I volunteered to make an inquiry on her
behalf. We are hoping that the previous Conditions of Approval for the Modification to
Use Permit are still valid. Could you please confirm this and let me know? If any new
requirements are in effect could you please enumerate what additional conditions apply
so that I can assist her. Hopefully, this will be a simple process so she can pursue the
expansion in a timely manner.
