BEING A RESOLUTION OF THE PLANNING COMMISSION OF THE
CITY OF CAMPBELL APPROVING AN EXTENSION OF TIME (R 98-01)
FOR A PREVIOUSLY-APPROVED MODIFICATION (M 97-01) TO
ALLOW AN ADDITION TO AN EXISTING VETERINARY HOSPITAL ON
PROPERTY LOCATED AT 3265 WINCHESTER BOULEVARD IN A C-2-
S (GENERAL COMMERCIAL) ZONING DISTRICT. APPLICATION OF
DR. KAREN LANGEMAN. FILE NO. R 98-01 (M 97-01).
After notification and public hearing, as specified by law, and after presentation by the
Community Development Director, proponents and opponents, the heating was closed.
After due consideration of all evidence presented, the Planning Commission did find as follows
with respect to application R 98-01 (M 97-01):
There have been no changes in the General Plan and the zoning of the property
since the previous approval of the project.

There have been no changes in the development standards or regulations which
would warrant change to the conditions of approval.
o
The applicant is requesting the extension of time to facilitate the completion of the
project.
Based upon the foregoing findings of fact, the Planning Commission further finds and concludes
that:
1. The proposed project is consistent with the General Plan and the local zoning
ordinance, and;

The proposed project as conditioned will aid in the harmonious development of the
immediate area;

The establishment, maintenance or operation of the use applied for will not be
detrimental to the health, safety, peace, morals, comfort, or general welfare of
persons residing or working in the neighborhood of such proposed use, or be
detrimental or injurious to property and improvements in the neighborhood or to the
general welfare of the City.
The proposed site is of adequate shape and size to accommodate the yards, walls,
fences, screening, landscaping and other development features required in order to
integrate said use with uses in the surrounding area.

The applicant is hereby notified, as part of this application, that he/she is required to meet the
following conditions is in accordance with the ordinance of the City of Campbell and the State of
California. Additionally, the applicant is hereby notified that he/she is required to comply with
all applicable Codes or Ordinances of the City of Campbell and the State of California that
pertain to this development and are not herein specified:
Approved Project: Approval is granted for a Modification allowing an expansion of a
veterinary hospital facility on property located at 3265 S. Winchester Boulevard. Project
approval shall substantially comply with project plans prepared by DAVECO Associates
dated 1/8/97 except as modified herein in the Conditions of Approval.
Approved Use: The approved use of the property is for veterinary care services for small
animals. The use and building shall comply at all times with Section 21.22.040 (Q) of the
C-2-S zoning ordinance as specified below:
A. A maximum of 3-5 animals may be kept overnight on the premises for treatment
purposes only.
B. The entire clinic shall be maintained within the enclosed building.
C. The building shall be soundproofed. Sound levels shall not exceed 65 decibels audible
to the exterior of the building. Air conditioning shall be provided to prevent the
necessity of opening windows and doors for ventilation purposes.
D. The facility shall not be closer than 50 feet fi.om the nearest residential property.
E. The facility shall be maintained free of objectionable odors and be operated in
compliance with health standards for such clinics.
F. Hours of operation are approved by the Planning Commission and specified below.
Emergency calls after hours shall not be prohibited.
G. The facility shall comply with all state, county, and city ordinances which pertain the
use or zone where the facility is located.

Development Approval Expiration: The Extension of Time approval (R 98~01) to
Modification (M 97-01) for this project is valid for a period of eighteen months from the
Planning Commission approval and will expire on September 24, 1999. All conditions of
approval specified herein must be completed within eighteen months from the date of
approval or the approval shall be void.
Landscaping: Applicant shall submit four (4) sets of a revised landscaping plan which
includes one (1) 48" box tree within the front on-site landscape bed. Planting details and
the irrigation system shall be submitted to the Community Development Department for
review and approval prior to the issuance of building permits. Landscape plans shall be
prepared in conformance with the City's Water Efficient Landscape Guidelines (WELS).
Silage: Signage is not approved as part of this application. Any exterior building
signage shall require a sign permit and approval as required by Chapter 21.53 (Signs) of the
Campbell Municipal Code.
Grading and Drainage Plan: Prior to issuance of any building permits for the site, the
applicant shall conduct hydrology studies as necessary, prepare grading and drainage plans,
and pay fees required to obtain necessary grading permits.
The plans shall provide for on-site retention of runoff fi'om a 100 year storm frequency
minimum, or positive surface runoff to Winchester Boulevard, or other drainage concept
subject to review by the Building Official and City Engineer. Plans must comply with the
1994 Edition of the UBC.
Standard Street Improvements: Prior to issuance of any building permits for the site, the
applicant shall prepare plans, pay fees, post securities, and provide insurance as required to
obtain an encroachment permit to construct improvements in the public right-of-way.
Plans shall be prepared by a registered Civil Engineer licensed in the State of California,
and shall include improvements such as under sidewalk drains and other improvements to
be constructed in the public right-of-way as shown on the approved grading and drainage
plans.

Completion of Public Street Improvements: Prior to issuance of. occupancy for the site, all
improvements within the public right-of-way as required by the encroachment permit must
be completed and accepted by the City Engineer and the applicant must provide the one-
year maintenance security.

Dedication to Ci _ty: Prior to issuance of any building permits for the site, the applicant shall
dedicate an additional 3' of property frontage to provide 45' of public right-of-way from
the existing centerline on Winchester Boulevard. Applicant shall prepare all documents
necessary to record the dedication and submit to the City for review.

· The Applicant is seeking an extension of time to a previously approved Use Permit which
would allow a 695 square foot building addition to an existing veterinary facility.
Additional time is requested since the bids for construction were higher than anticipated by
the applicant.
· Site is located on west side of Winchester Boulevard, south of Chapman Drive and north of
W. Parr Avenue.
· Adjacent uses include Controlled Manufacturing (to the east), Single Family Residential (to
the west) and General Commercial (to the north and south).
· The project is exempt from CEQA review.
· The project is consistent with the General Plan and C-2-S (General Commercial) Zoning
designations.
· The existing use was converted from a single-family home to a veterinary hospital.
· The proposed expansion is concentrated at the front of the existing building and along the
southern property line.
· The southern side of the addition terminates into a concrete block fire wall as required when
building up to the property line.
· Building materials are consistent with the existing materials.
· The building expansion complies with State requirements to separate various services
performed at veterinary hospitals.
· The required parking is nine (9) spaces. Eleven (11) spaces will be provided on site.
· Staffis supportive and recommends approval of this project.
Commissioner Gibbons asked if the surrounding neighbors have been notified of this application
for renewal of the previous approval.

DISCUSION
Applicant's Proposal: The applicant is requesting approval for an 18 month extension of time to
Modification (M 97-01) allowing a 695 square foot building addition to an existing 1,080 square
foot veterinary hospital located at 3265 S. Winchester Boulevard. The applicant stated that she
needs to postpone construction at this time because the bids for construction came in much
higher than expected.
Project Background: On February 25, 1997 the Planning Commission granted approval of a
Modification (M 97-01) to a previously approved Conditional Use Permit allowing an addition to
an existing veterinary hospital. Under the zoning ordinance, a Modification is valid for one year
from the date of approval. The subject application expired on February 25, 1998. The
application for an extension of time was received prior to the expiration date.

ANALYSIS
General Plan Designation: The General Plan designation for the site indicates commercial land
uses according to the land use element of the General Plan. The General Plan designation for
this site has not changed and the proposed use of the property is consistent with the current land
use designation.
Zoning Designation: The zoning designation for the site is C-2-S (General Commercial). The
zoning of the subject property has not changed since the modification was approved, and the
project is consistent with the zoning of the property.
Use: The use has operated at this location since 1982, and complied with veterinary care facility
requirements for Campbell when the facility was established. The proposed expansion is also
subject to the standards for veterinary clinics as specified in section 21.22.040 (Q) of the Zoning
Ordinance. There are no proposed changes to the use in conjunction with the request for the
extension of time. Detailed project information can be found in the attached original staff report.
Site and Building Design: The proposed building expansion is located at the front of the existing
building, and along the southern side of the property line. The existing building is a one story
rectangular structure (44' x 24") with horizontal wood siding, wood casement windows, and a
composition shingle roof. The addition is consistent with the existing building in terms of scale,
design, and building materials. The applicant is not proposing any changes to the original plans
that were previously approved by the Planning Commission for Modification 97-01. The
Planning Commission staff report for M 97-01is attached.
Extension of Time:. Approval of an extension would allow the applicant to begin construction of
the project within 18 months of the Planning Commission's approval, on or before Septmeber
24, 1999. Subject to the original conditions of approval, staff is supportive of the request for an
extension of time.
