BEING A RESOLUTION OF THE PLANNING COMMISSION
OF THE CITY OF CAMPBELL APPROVING A MODIFICATION
TO A PREVIOUSLY-APPROVED CONDITIONAL USE PERMIT
TO ALLOW AN ADDITION TO AN EXISTING VETERINARY
HOSPITAL ON PROPERTY LOCATED AT 3265 S.
WINCHESTER BOULEVARD IN A C-2-S (GENERAL
COMMERCIAL) ZONING DISTRICT. APPLICATION OF DR.
KAREN LANGEMAN. FILE NO. M 97-01.
After notification and public hearing, as specified by law, and after presentation by the
Community Development Director, proponents and opponents, the hearing was closed.
After due consideration of all evidence presented, the Planning Commission did find as
follows with respect to application M 97-01.
1. The proposed project meets the development standards of the C-2-S zoning district.
The project is compatible with the existing building and site, subject to the
conditions of approval.
The proposed landscaping of the site will contribute to the quality of the
development and enhance the neighborhood.
The veterinary hospital has operated at the subject property since 1982, and the
operational characteristics will remain the same.
The proposal provides 11 parking spaces which exceeds the ordinance requirement
for parking.
Based upon the foregoing findings of fact, the Planning Commission further finds and
concludes that:
1. The proposed project is consistent with the General Plan and the local zoning
ordinance, and;
2. The proposed project as conditioned will aid in the harmonious development of the
immediate area;
The establishment, maintenance or operation of the use applied for will not be
detrimental to the health, safety, peace, morals, comfort, or general welfare of
persons residing or working in the neighborhood of such proposed use, or be
detrimental or injurious to property and improvements in the neighborhood or to the
general welfare of the City.

The proposed site is of adequate shape and size to accommodate the yards, walls,
fences, screening, landscaping and other development features required in order to
integrate said use with uses in the surrounding area.
The applicant is hereby notified, as part of this application, that he/she is required to meet
the following conditions in accordance with the Ordinances of the City of Campbell and
the State of California. Additionally, the applicant is hereby notified that he/she is
required to comply with all applicable Codes or Ordinances of the City of Campbell and
the State of California that pertain to this development and are not herein specified.
Approved Project: Approval is granted for a Modification allowing an expansion of a
veterinary hospital facility on property located at 3265 S. Winchester Boulevard.
Project approval shall substantially comply with project plans prepared by DAVECO
Associates dated 2/20/97 except as modified herein in the Conditions of Approval.
Approved Use: The approved use of the property is for veterinary care services for
small animals. The use and building shall comply at all times with Section 21.22.040
(Q) of the C-2-S zoning ordinance as specified below:
A. A maximum of 3-5 animals may be kept overnight on the premises for treatment
purposes only.
B. The entire clinic shall be maintained within the enclosed building.
C. The building shall be soundproofed. Sound levels shall not exceed 65 decibels
audible to the exterior of the building. Air conditioning shall be provided to
prevent the necessity of opening windows and doors for ventilation purposes.
D. The facility shall not be closer than 50 feet from the nearest residential property.
E. The facility shall be maintained free of objectionable odors and be operated in
compliance with health standards for such clinics.
F. Hours of operation are approved by the Planning Commission and specified
below. Emergency calls after hours shall not be prohibited.
G. The facility shall comply with all state, county, and city ordinances which pertain
the use or zone where the facility is located.

Development Approval Expiration: The Modification approval (M 97-01) for this
project is valid for a period of one year from the Planning Commission approval. All
conditions of approval specified herein must be completed within one year fi.om the
date of approval or the approval shall be void.
Landscaping: Applicant shall submit four (4) sets of a revised landscaping plan
which includes one (1) 48" box tree within the front on-site landscape bed. Planting
details and the irrigation system shall be submitted to the Community Development
Department for review and approval prior to the issuance of building permits.
Landscape plans shall be prepared in conformance with the City's Water Efficient
Landscape Guidelines (WELS).
Signage: Signage is not approved as part of this application. Any exterior building
signage shall require a sign permit and approval as required by Chapter 21.53 (Signs)
of the Campbell Municipal Code.
Grading and Drainage Plan: Prior to issuance of any building permits for the site, the
applicant shall conduct hydrology studies as necessary, prepare grading and drainage
plans, and pay fees required to obtain necessary grading permits.
The plans shall provide for on-site retention of nmoff fi.om a 100 year storm
frequency minimum, or positive surface runoff to Winchester Boulevard, or other
drainage concept subject to review by the Building Official and City Engineer. Plans
must comply with the 1994 Edition of the UBC.
Standard Street Improvements: Prior to issuance of any building permits for the site,
the applicant shall prepare plans, pay fees, post securities, and provide insurance as
required to obtain an encroachment permit to construct improvements in the public
right-of-way. Plans shall be prepared by a registered Civil Engineer licensed in the
State of California, and shall include improvements such as under sidewalk drains and
other improvements to be constructed in the public right-of-way as shown on the
approved grading and drainage plans.
10. Completion of Public Street Improvements: Prior to issuance of occupancy for the
site, all improvements within the public right-of-way as required by the encroachment
permit must be completed and accepted by the City Engineer and the applicant must
provide the one-year maintenance security.

Dedication to Ci _ty: Prior to issuance of any building permits for the site, the applicant
shall dedicate an additional 3' of property frontage to provide 45' of public right-of-
way from the existing centerline on Winchester Boulevard. Applicant shall prepare
all documents necessary to record the dedication and submit to the City for review,
acceptance and recording.

Mr. Tim J. Haley, Associate Planner, presented the staff report as follows:
Applicant is seeking a Modification to a Use Permit to allow a 695 square foot addition to
a veterinary hospital located south of Hacienda Avenue on Winchester Boulevard which
will result in the removal of some parking and a large tree.
· The Use Permit was granted in 1982 to allow the use of a residence as a veterinary clinic.
· Staff has recommended a slightly different elevation from SARC which requires an offset
of the building addition. SARC is supportive of the applicant's proposal without the offset.
· Staff finds that parking is adequate with 6 required and 11 provided.
· The General Plan and Zoning for the site are compatible with the use.
· The building materials will match existing materials, wood siding and an asphalt shingle
roof.
· Staff recommends that the Commission adopt a Resolution approving this application.
Chairwoman Kearns asked about the differences in the from elevations.
Mr. Tim J. Haley stated that staff was considering the appearance of the building from the
roadway as it is approached from the north. Without the offset, the building consists of one
large blank wall.
Commissioner Alne presented the Site and Architectural Review Committee report:
· The only issue is the minor offset recommended by staff.
· SARC found that the only advantage was an aesthetic one while the disadvantage is the
disruption of the internal layout of the addition.
· SARC recommends that the applicant's layout be approved without the offset.

Commissioner Lindstrom asked Mr. Davis which plan he supports.
Mr. Von Davis replied that the could make either plan work. There is more square footage
available without the inclusion of an offset. Stated that he could understand what staff was
trying to accomplish by requiring the offset.

DISCUSSION
Applicant's Proposal: The applicant is requesting approval of a modification to allow a
695 square foot building addition to an existing 1,080 square foot veterinary located at
3265 S. Winchester Boulevard.
Background: A use permit application and site and architectural review was approved by
the Planning Commission August 10, 1982 allowing an office conversion an existing
single family residence into a veterinary hospital with a footprint of approximately 1,100
square feet. The proposed building expansion is requested to comply with State of
California requirements for separating various services performed at veterinary hospitals.
The building addition and floor plan will meet State code requirements for veterinary
hospitals, and City standards as specified in Section 21.22.040 of the zoning ordinance.
ANALYSIS
General Plan Consistency: The General Plan designation for the site indicates
commercial land uses according to the land use element of the General Plan. The
proposed use of this property is consistent with the commercial land use designation.

Zoning Consistency: The zoning designation for the site is C-2-S (General Commercial).
Veterinary hospitals are permitted in the C-2-S zoning districts with a conditional use
permit, and compliance with the conditions for veterinary clinics as specified in Section
21.22.040 (Q) of the zoning ordinance. The proposal is consistent with the zoning
designation, subject to approval of the modification and the conditions of approval.
Use: The use has operated at this location since 1982, and complied with veterinary care
facility requirements for Campbell when the facility was established. The proposed
expansion is also subject to the standards for veterinary facilities clinics as specified in
Section 21.22.040 (Q) of the zoning ordinance which is summarized below:

The adjacent uses consist of commercial uses to the north and the south of the site, and a
residential use to the west approximately 54 feet from the building. The proposed
expansion will accommodate additional floor area needed to perform services at the
hospital, and the use will continue to operate completely within the enclosed building.
There are no outside facilities associated with the existing or proposed use. The
operational characteristics consist of veterinary care for small animals exclusively.
Overnight care is provided consistent with the previous use permit approval when
medical services are provided. Additional operational characteristics and hours are:

Site Design: The proposed building expansion is concentrated at the front of the existing
building, and along the northern side of the building and terminates into a concrete block
fire wall on the northern property line. The concrete block wall is required to build up to
the property line. A 36" diameter fir tree will be removed to accommodate the building
expansion, and the handicap ramp at the front of the building. Ten parking spaces are
provided at the rear portion of the property, and one handicap parking space is located
near the front entrance of the building adjacent to the proposed handicap ramp. An
existing 6' high concrete block wall along the rear property line was required as a
condition of approval for the Use Permit application, and will remain. The building
expansion has been sited to comply with State code requirements for interior floor space
arrangement while retaining sufficient area to accommodate the parking needed to serve
the use.
Design: The existing building consist of a one story rectangular building (44' x 24') with
horizontal wood siding, wood casement windows, and a composition shingle roof. A
portion of the front addition (28'D x 35'W) is partially offset from the fire wall to
accommodate a hip roof element which provides articulation to the front elevation.
Building materials for the proposed addition are consistent with the existing building. To
enhance the elevations, a wood trellis element is featured at the front and rear building
elevations. Metal railing is indicated at the handicap ramp, however, staff recommends
the use of wood railing to provide consistency and architectural continuity with
predominant building materials.
Parking: The parking requirement for medical offices is six parking spaces per doctor.
The proposed use employs 1.5 full time veterinarians and requires 9 parking spaces. The
site plan indicates 11 parking spaces exceeding the parking requirement however, the
applicant indicates that the additional parking is necessary to provide parking facilities for
patients and staff.
Landscaping: Properties located in C-2-S zoning district require that 10% of the net site is
developed with landscaping. The location of the building expansion will remove existing
landscaping areas including a large tree. The proposed landscape areas meet the
ordinance requirement for landscaping of 10%. A condition of approval requires the
submittal of a landscape plan. Staff recommends that the landscape plan include one 48"
box tree to replace the existing tree that will be removed with this project.
Compatibility: Based on the current proposal, staff is supportive of the proposed
expansion, and finds that the project is compatible with the surrounding land uses, subject
to the attached conditions of approval.
SITE AND ARCHITECTURAL REVIEW COMMITTEE
The Site And Architectural Review Committee (SARC) meeting was held on February
13, 1997. The Committee's focus was the design concept of the front elevation. The
Committee reviewed staff's recommendation to offset the front portion of the addition

from the fire wall to create a hip roof element at the front elevation. The applicant Staff
indicated that a portion of the floor plan had to be revised to accommodate the front
elevation treatment. The Committee concluded that the treatment of the front elevation as
presented did not provide a significant difference to warrant its imposition on the
applicant. Therefore, the Committee expressed support for the applicant's initial proposal
to extend the roof line directly to the fire wall in a half gable approach. The exhibits
attached include the elevation design supported by the SARC Committee.

Landscape Guidelines (WELS).

Signage: Signage is not approved as part of this application. Any exterior building
signage shall require a sign permit and approval as required by Chapter 21.53 (Signs)
of the Campbell Municipal Code.

Grading and Drainage Plan: Prior to issuance of any building permits for the site, the
applicant shall conduct hydrology studies as necessary, prepare grading and drainage
plans, and pay fees required to obtain necessary grading permits.
The plans shall provide for on-site retention of runoff from a 100 year storm
frequency minimum, or positive surface runoff to Winchester Boulevard, or other
drainage concept subject to review by the Building Official and City Engineer. Plans
must comply with the 1994 Edition of the UBC.
Standard Street Improvements: Prior to issuance of any building permits for the site,
the applicant shall prepare plans, pay fees, post securities, and provide insurance as
required to obtain an encroachment permit to construct improvements in the public
right-of-way. Plans shall be prepared by a registered Civil Engineer licensed in the
State of California, and shall include improvements such as under sidewalk drains and
other improvements to be constructed in the public right-of-way as shown on the
approved grading and drainage plans.
10. Completion of Public Street Improvements: Prior to issuance of occupancy for the
site, all improvements within the public right-of-way as required by the encroachment
permit must be completed and accepted by the City Engineer and the applicant must
provide the one-year maintenance security.
11. Dedication to City: Prior to issuance of any building permits for the site, the applicant
shall dedicate an additional 3' of property frontage to provide 45' of public right-of-
way from the existing centerline on Winchester Boulevard. Applicant shall prepare
all documents necessary to record the dedication and submit to the City for review,
acceptance and recording.

Notice is hereby given that the Planning Commission of the City of Campbell has set the
time of 7:30 p.m., or shortly thereafter, on Tuesday, February 25, 1997, in the City Hall
Council Chambers, 70 North First Street, Campbell, California, for a Public Heating to
consider the application of Ms. Karen Langeman, on behalf of Porte Veterinary Hospital,
for approval of a Modification (M 97-01) to allow an addition to an existing veterinary
hospital on property located at 3265 S. Winchester Boulevard in a C-2-S (General
Commercial) Zoning District. This project is Categorically Exempt.
Interested persons may appear and be heard at this heating. Please be advised that if you
challenge the nature of the above project in court, you may be limited to raising only
those issues you or someone else raised at the Public Heating described in this Notice, or
in written correspondence delivered to the City of Campbell Planning Commission at, or
prior to, the Public Heating. Questions may be addressed to the Community

Decisions of the Planning Commission may be appealed to the City Council. Appeals
must be submitted to the City Clerk in writing within 10 calendar days of an action by the
Commission.
