Subject: Vacation of Westmont Avenue
We have reviewed your letter, dated August 14, 1996, relative to the proposed vacation of Westmont
Avenue adjacent to the Granados property and make the following comments:
A. The I5-foot-wide strip of land which you propose to convey to the abutting owner is encumbered
with an existing pipeline easement in favor of the District. Your conveyance document should
address this easement and indicate that the District will not compensate the owner for damages
or improvement costs in the event that we must enter the property to repair the existing pipeline.
No trees may be planted in the easement, and a District permit must be obtained prior to any
landscaping or placement of any structures including fences within the easement.
B. Because this approach will not result in any sale proceeds being distributed to the District and the
District will incur processing costs, the District should receive one-half of the processing fee
referred to in your letter to be charged by the City in connection with transfers of title to the
adjoining owners.
If this request is acceptable, please send me a copy of the proposed deed language that you will use, and
I will have it reviewed by District Counsel.

Dear Ms. Tippits:
We have a request from a Mr. Robert S. Granado of 1325 Westmont Avenue, asking that the
City vacate a portion of the right-of-way which the Santa Clara Valley Water District granted
to the City. Please refer to the attached Grant Deed and Agreement. The City would like to
vacate as much right-of-way as possible and we wish to do so with your consent.
We are enclosing a set of improvement plans for City Project 82-4, Westmont-Lovell Storm
Drain which show the following information as to existing utility facilities:
1. A 2" gas main at 14 feet south of centerline
2. A 6" VCP sanitary sewer main 3.5 feet north of centerline
3. A 39" RCP storm drain main at 8 feet north of centerline
4. An existing aerial PG&E/Pac Bell/TCI facilities pole line at approximately
14.4/14.9 feet north of centerline
5. A 19 1/4" FKCL water main at 18 feet north of centerline
6. A 42" RCP Santa Clara Valley Water District facility at 27 feet north of
centerline
The proposed typical cross-section for the north side of Westmont A venue is for face of curb
at 18' from centerline; back of sidewalk at 23' from centerline; right-of-way line at 28' from
centerline. The 5 feet from back of sidewalk to right-of-way line can be used for street lighting,
street trees, and utilities. Please see the attached "San Tomas Street Design Standards, Minor
Collector" detail.
The City's request to the District is to allow the City to vacate as much right-of-way as possible
from a point 28 feet north from centerline to the north.

The detail included with your letter of April 11 for the street improvements on Westmont Avenue
is acceptable. The street right of way would be increased to a 30-foot-wide half street with a
7-foot-wide park strip and a 4.5-foot-wide sidewalk. The District's 42-inch diameter pipeline
would be located under the sidewalk.
Street trees should be of a small variety with limited root structure such that excavation of the
pipeline would not damage the trees.
Conveyance of the remaining fee title right of way back to the District would be acceptable.
Other comments regarding the right of way included in our letter of March 3 still apply as does
our request for information regarding the easement adjacent to Smith Creek.

Enclosed please find a proposed detail for Westmont Avenue between San Tomas Aquino
Road and Smith Creek. This detail was prepared to accommodate the District's 42-inch
pipeline in this area. The proposal includes an 18-foot street section, a 7-foot park strip,
and a 45' wide sidewalk. The sidewalk is constructed over the pipeline, which will protect
it from street lights and street trees. Please review this detail and return any comments
which you have to me.
The property owner has expressed interest in acquiring the excess right-of-way on Westmont
Avenue. H this project proceeds, the City plans to vacate any excess right-of-way back to
the Water District. The District can then sell it directly to the property owner.

Preliminary Tentative Map - 1113 Crockett Avenue
The District has reviewed the subject map and your inquiry regarding acquisition of public right
of way on Westmont Avenue by the subdivision owner. Our comments regarding the possible
transfer of ownership of a portion of this right of way would apply to all properties along
Westmont Avenue between Smith Creek and San Tomas Aquino Road.
The District's Page Ditch is located within a 42-inch diameter pipe, the center line of which is
27 feet north of the center line of Westmont Avenue. This pipeline is not shown on the
preliminary tentative map prepared by Nowack and Associates. The 42-inch storm drain shown
on the map is, in fact, the City's 39-inch RCP storm drain.
As per our discussion, the City's standard for the street at this location is a 28-foot-wide half
street, consisting of 18 feet of roadway, 5 feet of sidewalk, and 5 feet for utilities, lights and
street trees. Using this standard, the utilities, light standards, and trees would be directly over
the District's pipeline. As this pipe only has about 2 1/2 feet of cover, the placement of trees and
light standards over the pipeline is not acceptable. We suggest that the street layout be modified
within this area to accommodate the District's facility. Widening of the street right of way such
that the sidewalk or preferably a planter strip is over the pipeline would be one option. The
pipeline should remain within the street right of way. A street width of 32 feet as shown on the
map may meet our requirements.
Excess fee title right of way now owned by the City could be transferred to the subdivision
owner; however, the District would retain its existing easement. It may be possible to quitclaim
5 feet of the District's easement to the property owner subject to compensation and approval by
our Board of Directors.

The deed in which the District transferred fee title to this property to the City in 1990 includes
a provision that, if the property is sold to a third party, proceeds of the sale are to be transferred
to the District. We believe that the property must be sold so as to not constitute a gift of public
funds and that it must be sold at fair market value.
The preliminary tentative map shows an easement adjacent to Smith Creek for conducting water
for irrigation or other purposes. The easement was acquired in 1904 by the Orchard Irrigation
Company, which was subsequently transferred to this District. If available, we would like to
receive a copy of the owner's title report to verify ownership of this easement.
Please provide a sketch of alternatives which meet the City's and District's requirements relative
to the street layout and pipeline for our review and comment.

Dear Ms. Tippets:
Enclosed please find a Preliminary Tentative Map for the property at the northwest corner
of Westmont Avenue and Crockett Avenue. The developer is proposing to acquire 13' of
public right-of-way along the Westmont Avenue frontage of the property. Based on street
standards recently adopted for this area by the City Council, the half-street width of
Westmont Avenue must be only 28', which would allow the developer to acquire 17' along
the frontage. The Water District deeded this area to the City for street purposes, and
therefore appears to be entitled to the property should it be vacated by the City. We are
requesting that you review this map, and state your agency's position regarding the vacation
of this property by the City, and the possible acquisition by the owner of this subdivision.
The same situation exists on the north side of Westmont Avenue between Crockett and San
Tomas Aquino Road, so please make your comments pertinent to this entire area.

Subject: Vacation of Westmont Avenue
We have reviewed your letter, dated August 14, 1996, relative to the proposed vacation of Westmont
A venue adjacent to the Granados property and make the following comments:
A. The 15-foot-wide strip of land which you propose to convey to the abutting owner is encumbered
with an existing pipeline easement in favor of the District. Your conveyance document should
address this easement and indicate that the District will not compensate the owner for damages
or improvement costs in the event that we must enter the property to repair the existing pipeline.
No trees may be planted in the easement, and a District permit must be obtained prior to any
landscaping or placement of any structures including fences within the easement.
B. Because this approach will not result in any sale proceeds being distributed to the District and the
District will incur processing costs, the District should receive one-half of the processing fee
referred to in your letter to be charged by the City in connection with transfers of title to the
adjoining owners.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CAMPBELL
VACATING EXCESS RIGHT-OF-WAY ON WESTMONT AVENUE
ADJACENT TO APN # 403-10-038
WHEREAS, on August 7, 1990, the Santa Clara Valley Water District (SCVWD)
executed a Grant Deed conveying a certain 45 foot wide strip of land on the north side of
Westmont Avenue westerly of San Tomas Aquino Road to the SCVWD flood control easement
to the City of Campbell for public street purposes; and
WHEREAS, the City accepted the right-of-way which was consistent with the long range
plans for Westmont Avenue; and
WHEREAS, the City's subsequent adoption of the San Tomas Area Neighborhood Plan
which classified Westmont Avenue from San Tomas Aquino Road to Harriet Avenue as a minor
collector street and revised the long range plans for Westmont Avenue to be a 28 foot half street
right-of-way, resulted in an excess street right-of-way of 17 feet maximum; and
WHEREAS, there have been several inquiries and one application from current and
potential land owners requesting the vacation of the excess street right-of-way;
WHEREAS, the SCVWD has agreed to the vacation of the excess right of way by the
City directly to the adjacent property owners based on the following conditions:
1. The vacated right of way will be encumbered by an easement in favor of the
SCVWD.
2. The City's conveyance document must indicate that the SCVWD will not
compensate the owner for damage or improvement costs if the SCVWD needs to
enter the property to repair the pipeline.
3. No permanent improvements can be installed in the easement without a permit
from the SCVWD.
4. If the City sells the property, the proceeds should be given to the SCVWD.
5. If the City collects a fee for processing the Application for Vacation of Excess
Right-of-Way, one half of the proceeds should be given to the SCVWD.
6. The width of the street vacation should not exceed 15 feet.
7. The future street improvements should be constructed as generally shown on the
attached Exhibit "B".
WHEREAS, this vacation is made pursuant to Chapter 4, Summary Vacation, of Part 3
of Division 9 of the California Streets and Highway Code; and
WHEREAS, the property to be vacated is described on the attached legal description and
shown on the attached plat "Exhibit A" reserving therefrom a public use/public utility easement
for the benefit of the City of Campbell and the existing pipeline easement for the benefit of the
SCVWD; prohibiting the installation of trees or placement of any structures including fences
within the easement without a permit from the SCVWD; allowing the SCVWD the right to
access, maintain, repair and/or replace the existing pipeline without compensation to the property
owner for damages or improvement costs over, under, and upon said property; and
WHEREAS, the property to be vacated constitutes excess street right of way not required
for street or highway purposes; and
WHEREAS, from and after this date that this resolution is recorded, the street portion
or portion thereof vacated no longer constitutes a public street;
NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Campbell
does hereby vacate the excess right-of-way on Westmont Avenue adjacent to APN# 403-10-038,
authorizes the Public Works Director to execute the necessary documents for vacation of this
excess right-of-way, and authorizes the City Clerk to record this Resolution.

We have a request from a Mr. Robert S. Granado of 1325 Westmont Avenue, asking that the
City vacate a portion of the right-of-way which the Santa Clara Valley Water District granted
to the City. Please refer to the attached Grant Deed and Agreement, The City would like to
vacate as much right-of-way as possible and we wish to do so with your consent.
We are enclosing a set of improvement plans for City Project 82-4, Westmont-Lovell Storm
Drain which show the following information as to existing utility facilities:
1, A 2" gas main at 14 feet south of centerline
2. A 6" VCP sanitary sewer main 3.5 feet north of centerline
3. A 39" RCP storm drain main at 8 feet north of centerline
4. An existing aerial PG&E/Pac Bell/TCI facilities pole line at approximately
14.4/14.9 feet north of centerline
5. A 19 1/4" FKCL water main at 18 feet north of centerline
6. A 42" RCP Santa Clara Valley Water District facility at 27 feet north of
centerline
The proposed typical cross-section for the north side of W estmont Avenue is for face of curb
at 18' from centerline; back of sidewalk at 23' from centerline; right-of-way line at 28' from
centerline. The 5 feet from back of sidewalk to right-of-way line can be used for street lighting,
street trees, and utilities. Please see the attached "San Tomas Street Design Standards, Minor
Collector" detail.
The City's request to the District is to allow the City to vacate as much right-of-way as possible
from a point 28 feet north from centerline to the north.

That certain 45 feet wide parcel of land labeled "Santa Clara Valley Water
Conservation District", the southerly line of which parcel is the centerline of
Westmont Avenue (formerly Lovell Avenue) as said parcel and avenue are shown on
the map of "Munro Tract" Tract No. 117 a copy of which map was filed for record
on November 21, 1939 in the office of the Recorder of Santa Clara County in Book

The detail included with your letter of April 11 for the street improvements on Westmont Avenue
is acceptable. The street right of way would be increased to a 3Q-foot-wide half street with a
7-foot-wide park strip and a 4.5-foot-wide sidewalk. The District's 42-inch diameter pipeline
would be located under the sidewalk,
Street trees should be of a small variety with limited root structure such that excavation of the
pipeline would not damage the trees.
Conveyance of the remaining fee title right of way back to the District would be acceptable.
Other comments regarding the right of way included in our letter of March 3 still apply as does
our request for information regarding the easement adjacent to Smith Creek.

Preliminary Tentative Map - 1113 Crockett Avenue
The District has reviewed the subject map and your inquiry regarding acquisition of public right
of way on Westmont A venue by the subdivision owner. Our comments regarding the possible
transfer of ownership of a portion of this right of way would apply to all properties along
Westmont Avenue between Smith Creek and San Tomas Aquino Road. .
The District's Page Ditch is located within a 42-inch diameter pipe, the center line of which is
27 feet north of the center line of Westmont Avenue. This pipeline is not shown on the
preliminary tentative map prepared by Nowack and Associates. The 42-inch storm drain shown
on the map is, in fact, the City's 39-inch RCP storm drain.
As per our discussion, the City's standard for the street at this location is a 28-foot-wide half
street, consisting of 18 feet of roadway, 5 feet of sidewalk, and 5 feet for utilities, lights and
street trees. Using this standard, the utilities, light standards, and trees would be directly over
the District's pipeline. As this pipe only has about 2 1/2 feet of cover, the placement of trees and
light standards over the pipeline is not acceptable. We suggest that the street layout be modified
within this area to accommodate the District's facility. Widening of the street right of way such
that the sidewalk or preferably a planter strip is over the pipeline would be one option. The
pipeline should remain within the street right of way. A street width of 32 feet as shown on the
map may meet our requirements.
Excess fee title right of way now owned by the City could be transferred to the subdivision
owner; however, the District would retain its existing easement. It may be possible to quitclaim
5 feet of the District's easement to the property owner subject to compensation and approval by
our Board of Directors.

The deed in which the District transferred fee title to this property to the City in 1990 includes
a provision that, if the property is sold to a third party, proceeds of the sale are to be transferred
to the District. We believe that the property must be sold so as to not constitute a gift of public
funds and that it must be sold at fair market value.
The preliminary tentative map shows an easement adjacent to Smith Creek for conducting water
for irrigation or other purposes. The easement was acquired in 1904 by the Orchard Irrigation
Company, which was subsequently transferred to this District. If available, we would like to
receive a copy of the owner's title report to verify ownership of this easement,

to the street layout and pipeline for our review and comment.

standards recently adopted for this area by the City Council, the half-street width of
Westmont Avenue must be only 28', which would allow the developer to acquire 17' along
the frontage. The Water District deeded this area to the City for street purposes, and
therefore appears to be entitled to the property should it be vacated by the City. We are
requesting that you review this map, and state your agency's position regarding the vacation
of this property by the City, and the possible acquisition by the owner of this subdivision.
The same situation exists on the north side of Westmont Avenue between Crockett and San
Tomas Aquino Road, so please make your comments pertinent to this entire area.
