to his lot in Campbell across his lot in San Jose. If you recall, a draft conditional certificate of
compliance was prepared requiring that Winston show proof of legal access to his lot in Campbell. San
Jose's response does not look favorable toward a San Jose solution for access.

Thank you for your Preliminary Review application dated May 18, 2002. The purpose of this
letter is to clarify the planning issues raised in your proposal regarding the properties identified
by Assessor's Parcel No. 282-17-020, 1321 Porgy Ct., located in the City of San Jose and the
adjacent parcel identified by Assessor's Parcel No. 282-17-018 located in the City of Campbell.
Landlocked Parcel in City of Campbell APN 282-17-018
To determine the legality of the landlocked parcel, staff requested the applicant obtain a
certificate of compliance from the City of Campbell for parcel.-\PN 282-17-018. To date, staff
has not received a copy of the requested certificate of compliance.
Staff spoke with City of Campbell staff regarding the subject parcel, and understand the parcel
was not approved by a parcel map as required by the Subdivision Map Act and City of
Campbell's Subdivision Ordinance. Campbell staff confirmed parcel lacks access in
contravention of the Subdivision Map Act and is not currently recognized as a legal lot.
Access Request to APN 282-17-018 via 1321 Porgy Ct., San Jose APN 282-17-020
Preliminary Review PRE 02-144 requested The City of San Jose consider a 10 foot access
easement via 1321 Porgy Ct. to the landlocked parcel in Campbell. The requested access
requires annexation of the parcel in Campbell to San Jose and a City of San Jose municipal
boundary change.

The existing City of San Jose boundary is logical and staff finds no justification for the proposed
boundary change to include APN 282-17-018 within the jurisdiction of the City of San Jose.
Additionally, S. 20.110.050 of the City of San Jose Zoning Code does not permit a covenant of
easement to provide access without an associated planning permit.
I trust this letter has clarified the issues associated with these properties. As requested, I have
enclosed the plan submitted with your preliminary review application. Should you have
additional questions or concerns regarding this property, please do not hesitate to contact me.

entitled, "Tract No. 1949", which Map was filed for record in the Office of the Recorder of
the County of Santa Clara, State of California on April 24, 1962 in Book 146 of Maps, at Page
5, Santa Clara County Records; thence from said point of beginning along the easterly line of
Lot 14 south 0 deg. 30' 00" east 132.00 feet to the southeasterly corner thereof; thence along a

We, Winston F. Chew and Johanna 1. Chew, declare:
1. On or about November 27, 1996, we acquired title to Santa Clara County
Assessor's Parcel Number 282-17-18 (hereinafter referred to as the "Subject
Lot"). Subsequently, on or about April 10, 1997, we transferred title in the
Subject Lot to the Chew Trust, of which we are the trustees. At present, title is
still held by the Chew Trust.
2. At the time that we originally acquired title to the "Subject Lot," and as of the
time that we transferred title to the Chew Trust, we were unaware and had no
suspicion that the Subject Lot had been created without compliance with the
applicable laws and regulations of the City of Campbell. Prior to acquiring
title to the Subject Lot, and transferring it to the Chew Trust, we were neither
advised by anyone of the possibility that the Subject Lot had been illegally
created, nor did any information reviewed by us indicate that the Subject Lot
might have been illegally created.
We declare under penalty of peIjury under the laws of the State of California that
the foregoing is true and correct.
