Dear Mr. Mortenson:
This letter wi II serve to confirm our telephone conversation of
May 26, 1960, concerning the pending appeal of the City of Campbell Planning Commission
decision of May 3, 1960, in re the application of Westside Development Company.
It is my understanding that after reviewing the additional information
that I submitted to you, you are in accord wlthour orinion that the second condition of the
Planning Commission in approving the application 0 Westside Development Company should
be deleted.
It is my understonding that you are to give your recommendations
to the City Planning Commission that this matter be deleted and that in the interim, the hearing
of the matter before the City Counci I will be deferred for a period of two weeks.
This wi II also confirm the fact that the property owners in the
Campbell Shopping Center intend to work out among themselves the necessary arrangement
for proper access to their parking area from Latimer Avenue.
It is my further understanding that if the Planning Commission accepts
your recommendation for the deletion of the second condition, the formal hearing before the
City Counci I wi II be dismissed.
Thank you very much for your courtesy and cooperation in this
matter. It has been a great pleasure working with you on thit matter.

At your regular meeting on May 3, 1960. "8" Approval was
granted to the West.ide Development Company for construction of
a combined commercial and office building to be constructed
at 341 North Winchester Road.
upon ~~e recommendation of this office, two conditions were
imposed. Condition #2. related to an access road from LatiJBer
Avenue to the applicant. property, has been protested and ~aled
to the City Council.
SUbsequent to approval by your body additional information
regarding right-ot-way and previous agreements between neighboring
property owners have been supplied to this office by the applicant.
After consideration of all the facts in this matter, it is felt
that it. would be advisable to remove this condition and allow the
various property owners in the area to provide for construction of
an equally-serviceable road in another location on the basis of
an existing agreement Which has not been, a8 yet., fully carried
out.
This office requests that it.s previous recommendation with
respect to condition #2 of the approval be withdrawn and recommends
that the Planning CommiSSion remove, in its entirety, condition #2
of the approval.

Decision of May 3, 1960 concerning the application
of Westside Development Company
Gentlemen:
On May 3, 1960, the Planning Commission of the City of Campbell
considered the application of Westside Development Company for liS Approval" of eight
retai I stores and sixteen offices to be located in the Lee Bros. Shopping Center located at
the corner of Winchester Road a"d Latimer Avenue. The Planning Commission approved the
application subject to two conditions. It is the second condition that we take exception
to and this appeal is made on that condition only.
The condition as set forth in the minutes of the Planning Commission's
meeting reads that an access road from Latimer Avenue to the parking area is to be paved to a
width of 30 feet and pavement section to be the same standard as for parking area.
It is the understanding of Westside Development Company that this 30
foot road which would extend approximately 100 feet from the Southerly edge of their property
to Latimer Avenue is required to be constructed in the same location as the temporary access
road presently being used in the area.
In checking the easements and right-of-ways that are pertinent to the land
of Westside Development Company property it is found that no such right-of-way exists '_ ver the
aforementioned existing road. In order to comply with the condition set forth by the Planning
Commission it would, therefore, be necessary for Westside Development Company to trespass on
the property located betwe8"lthe Southerly edge of their property and Latimer Avenue.
I am attaching to this letter a photocopy of an agreement dated June 12,
1958, which sets forth the easements and right-of-ways owned over and across said property by
Westside Development Company. There is also attached to this letter a photocopy of a plot
map showing the exact locations of the existing easements over all of the Campbell Shopping
Center properties and the approximate location of the existing access road from Latimer Avenue
to the parking lot.
You will note, in reading the agreement attached hereto, that on page
3, each of the property owners have agreed and bound themselves and their successors in interest
to pave and maintain the portions of the easements lying within the bounds of their respective
properties. Westside Development Company Intends to comply with their duties under that
agreement by pavIng the entire area in front of and in the rear of their proposed building. They
object to the requirement of the PlannIng Commission that they be required to pave an access

road over another property owner's land es:pecially since the other property owner is already
obligated by the agreement attached hereto to pave and construct access roads and parking
areas on his oWl property . As previouslyindicated, Westside Development Company also
object to the present condition inasmuch as it requires them to do an illegal act, namely I
trespass on another owner's land.
Wests ide Development Company, therefore, respectfully requests this
Honorable City Council to remove the requirement of the Planning Commission that such access
road be installed by them.
It should be pointed out at this time that the attached agreement was not
originally submitted to the Planning Commission with the application of Westside Development
Company. Reference to the agreement was made in the property description submitted but
unti I recently the true location of the right-of-ways over the adjoining land was not known to
the appellants herein. The appellants have heretofore contacted the City Engineer of the City
of Campbell, namely, Mr. Carl J. Mortenson, and it is hoped that a solution to the problem
may be reached directly through him without the necessity of a formal hearing before the
Honorable City Counci I. It is our understanding that all appeals must be fi led under your
ordinances within ten days from the date of decision of the Planning Commission and this appeal
is filed, therefore, simply to protect our rights under the time provisions. A carbon copy of
this letter, together with the attached agreement and plot map is being sent to Mr. Carl J.
Mortenson.
