After reviewing the matter with tile City's Engineering Department, it is my opinion that at this time it would be impossible forthe City to give you a statement that the property affected is being taken under threat of condemnation. Apparently, at the time of the discussion of acquisi- tion there was no follow-up on the matter of the acquisi- tion of your property for street widening. As it now stands, your property is probably being accessed to the center of the roadway, and you are paying t~~es thereon. It would therefore seem advisable for your company to give the City a deed of the portion affectee by the widening, and thereby relieve your company of the t~~ imposed by reason of ownership to the center of the street. Bonacin., City Attorney 607 First National Bank Building San Jose, California Dear Joe: We have reviewed our records concerning the Union Oil site at Latimer Avenue and Winchester Boulevard as a result of your letter dated December 6. We find that the service station was built and improved in the middle 1950's when requirements as to dedication etc., were only then being formulated. Mr. Mike Vigilant has informed me that it was not uncommon, at that time, to allow this sort of thing without picking up a deed. Then, in 1962, when we were putting together our LID No.3, which improved portions of Winchester and also Latimer Avenue, we discovered that the property in question had not been acquired. Since Mr. M. Casalina was working with our LID No. 3 acquisitions in this area, he was directed to attempt to get this one, for the record, as a simple dedication. The current letter from Union Oil apparently arises out of that contact, albeit, some four years later. We did not pursue the matter, particularly, in 1962 because; the street improvements were in, the property was in public use, and the acquisition was not considered important except as a matter of record. Now they are aSking us to go on record with a threat of eminent domain and While we could do so in the interest of satisfying their request for "certain tax advantages," our statement would certainly not represent our true intentions. We don't care about the property. Isn't it true that we have acquired it anyway, through adverse possession? One very definite advantage the owner would gain, simply by dedication, would be a reduction of his assessed valuation, since the County now bases its evaluation on the property Which includes the streets-out to center line. Bonacina, City Attorney -2- December 27, 1965 The other advantages, apparently referred to in Mobil's letter, are probably related to this business of charitable deduction which we recently discussed by telephone. As I explained, I'm not sure that the I.R.S. sanctions this idea since we have heard from them in regard to Orsi's attempt to use it. They have not, as yet, indicated that they will agree to it. In conclusion, then, I would suggest that we n2i provide a statement such as is requested. If we did, it would seem that we should offer a similar arrangement to all Developers who are involved in street dedications. The matter is, however, left to your discretion. I find upon examining the.e plans that they were not drawn tor the location conte.plated, in fact they are not drawn tor any location within the city limits of Campbell. They are apparently for the pur- pose of obtaining peraits to construct a .ervice station at the corner of Santa Clara-Los Gatos Road and Dorcich Street, a location which does not lie within the city limits. On drawing Ho. F8A944, which contains the plot plan for the proposed station at Santa Clara-Los Gatos Road and Dorcich Street, item .0. 8 under general notes reads as follows: "General contractor ahall install 1200 gallon .eptic tank aDd leaching lines in accordance with Santa Clara County require.ents." It i. obvious that the.e plans were not drawn for any location within the City of C._pbell and there- fore 1 would reco..end in accordance with Rule No. 8 of the Commission that the chairman reject this petition and plan and return the same to the applicant with a statement as to the reason for rejection.
