In reference to your letter dated January 17, 1963, we
have reviewed the particulars involved and find the following:
1. That the twelve (12) foot parcel in quest.ion was in
the name of SCVNCD at the time the City included it as a
part of the Joachim condemnation,
2. That the City has acquired an easement for storm drain
purpose. over the l2-foot parcel from SCVWCD prior to the Joach~
condemnation. This easement is of record as document No. 1715780,
in Book 4583. Page 332, filed October 13, 1959.
3. That the 12-foot ~1ece is shown by the County Assessor's
aapa as being current.ly in the name of the City. This apparently
ia a result of our condemnat.ion on Joachim.
on the basia that the City, in Effect, dondemned Joachim for
property he did not own, it would aeem that the parcel remains in
the District's name, hO\IMver, for the record, the execution of the
enclosed document by the City would probably benefit all concerned.
It is returned herewith for your further action.

HHEREAS, there has been submitted to the City Council
of City of Campbell by Y. A. Tittle an Indenture tor the con-
veyance of certain lands by City of Campuell to the shid Y. A.

land and cannot be utilized for any municipal purposes, and it
is for tile best interests of the people of the City of Campbell
to convey the same, and

been'offered therefor, and the same sum is a reasonable and
adequate consideration for the same.
