BEING AN ORDINANCE OF THE CITY COUNCIL OF
THE CITY OF CAMPBELL APPROVING PLANS, ELE-
VATIONS, DEVELOPMENT SCHEDULE AND CONDITIONS
OF APPROVAL FOR CONSTRUCTION OF AN OFFICE
BUILDING TO BE LOCATED AT 1550 S. WINCHESTER
BLVD. IN A CPD (CONDmUNIUM PLANNED DEVELOP-
MENT) ZONING DISTRICT. (APPLICATION OF MR.
AL SWEARINGEN, ZC 82-07.)
The City Council of the City of Campbell does ordain as follows:
SECTION ONE: That the Zoning Map of the City of Campbell, being a
part of the Campbell Municipal Code, together with amendments thereto,
is hereby changed and amended by adopting Exhibit A entitled Plans and
Elevations, Exhibit B entitled Development Schedule, Exhibit C entitled
Map of Said Property, and Exhibit D entitled Conditions of Approval, as
per the application of Mr. Al Swearingen on property location at 1550 S.
Winchester Blvd. Copies of said exhibits are on file in the Office of
the Planning Department.
SECTION TWO: This ordinance shall become effective thirty days
following its passage and adoption and shall be published once within
fifteen days upon passage and adoption in the Campbell Press, a news-
paper of general circulation in the City of Campbell, County of Santa
Cl ara.

The applicant is notified as part of this application that he/she is required
to meet the following conditions in accordance with Ordinances of the City of
Campbell and Laws of the State of California.

All parking and driveway areas to be developed in compliance
with Section 21.50 of the Campbell Municipal Code. All
parking spaces to be provided with appropriate concrete curbs
or bumper guards.

Underground utilities to be provided as required by Section
20.16.070 of the Campbell Municipal Code.
Plans submitted to the Building Department for plan check shall
indicate clearly the location of all connections for underground
utilities including water, sewer, electric, telephone and
television cables, etc.
Sign application to be submitted in accordance with provisions
of the sign ordinance for all signs. No sign to be installed
until application Is approved and permit issued by the Building
Department. (Section 21.68.030 of the Campbell Municipal Code.)

Ordinance No. 782 of the Campbell Municipal Code stipulates that
any contract for the collection and disposal of refuse, garbage,
wet garbage and rubbish produced within the limits of the city
of Campbell shall be made with Green Valley Disposal Company.
This requirement applies to all single-family dwellings, multiple
apartment units, to all commercial, business, Industrial,
manufacturing, and construction establishments.

Trash container{s) of a size and quantity necessary to serve the
development shall be located In area{s) approved by the Fire
Department. Unless otherwise noted, enclosure{s) shall consIst
of a concrete floor surrounded by a solid wall or fence and
have self-closing doors of a size specified by the Fire Department.
All enclosures to be constructed at grade level.

Applicant shall comply with all approprIate State and City require-
ments for the handicapped.

Noise levels for the interior of residential units shall comply
with minimum State (Title 25) and local standards as Indicated
In the Noise Element of the Campbell General Plan.

The Community Development Department has reviewed your request dated March 7, 1996 and
has discussed this request with the City Attorney. Based upon this review and discussion the
following determination has been made:
1) If you wish to maintain the current designation as a condominium office and the current
zoning of Condominium Planned Development(C-PD), you may process a tract map converting
the 27 units into one condominium unit. This map should be processed through our Public Works
Department. Please contact Harold Housley regarding this process at 866-2158.
2) If you wish to eliminate the reference to this building as a condominium office and to change
the underlining zoning from (C-PD) to Neighborhood Commercial(C-1-S) it will be necessary to
process a zone change application. A copy of a zone change application has been enclosed. This
process would take approximately three months. Please contact me at 866-2144, if you wish to
pursue this direction.

ASSIGNMENT OF LEASE
This agreement is made and entered into on May 31, 1987
by and between Val C. McMurdie and Deanne K. McMurdie,
husband and wife, hereinafter referred to as "Assinors" and
Donald E. Raymond and Lydia A. Raymond, husband and wife,
hereinafter referred to as "Assinees".
RECI'l'ALS:
A. Pursuant to an agreement entered into on March 2,
1987, Assinees received a assignment of all of Assinors
contract right to purchase from Mercury Savings and Loan the
improvements on the real property commonly describe as
1550 S. Winchester Blvd., Campbell, CA., and more
particularly described in Exhibit "A", attached hereto and
made a part hereof, consisting of a commercial office
building of 6000 square feet subject to a 40 year ground
lease executed by Matilda Bianchi, as Ground Lessor and
Mercury Savings and Loan Association as Lessee recorded on
April 23, 1987 as Instrument Number 9243231 in the official
records of Santa Clara County, California.
B. Pursuant to the request of Mercury Savings and Loan
Association, the purchase escrow was closed on April 23, 1987
vesting title in Donald E. Raymond and Lydia A. Raymond,
husband and wife, as community property, and Val C. McMurdie
and Deanne K. McMurdie, husband and wife, as community
property, and the Ground Lessor consented to the assignment
of the Ground Lease from Mercury Savings and Loan Association
to the aforesaid parties by a consent agreement recorded on
April 23, 1987 as Instrument Number 9243234 in the official
records of Santa Clara County, California.

following street improvements:
I. Remove all curb, gutter, sidewalk and driveway approaches
and replace to City standards, including a handicap ramp
and street trees.
2. Wedgecut the existing pavement on Rosemary, apply pavement
reinforcing fabric, and overlay with 0.12 feet of asphalt
concrete.
