All existing structures shall be secured by having windows boarded up and doors sealed shut, or be demolished or removed from the property (Section 11.201 and 11.414, 1985 Ed. Uniform Fire Code). All structures shall also be required to be maintained free of graffiti. Should graffiti appear on the building, enclosure walls and/or trash enclosure, the applicant shall take measures to immediately remove the graffiti. 10. Location of Mechanical Equipment: No new roof-mounted and/or ground level mechanical equipment, i.e. air conditioning units, shall be located on or adjacent to the building without providing screening of the mechanical equipment from public view. Screening material and method shall require review and approval by the Community Development Director prior to the installation of such mechanical equipment. 11. Utility Boxes and Back-Flow Preventers: If applicable, the applicant shall submit a plan prior to installation of PG&E utility (transformer) boxes and San Jose Water Company back-How preventers, indicating the location of the boxes and screening (if the boxes are above ground) for approval by the Planning Division. 12. Trash Disposal/Recycling: The applicant shall provide details regarding the design and location of trash disposal/recycling facilities necessary to serve the uses to be reviewed and approved by the City prior to the issuance of building permits for the project. The design of the trash enclosure shall match the building in terms of color and finish. 13. Signs: Any signs proposed to be erected on site shall require approval of a Sign Permit. A Sign Permit may be granted upon complete submission of a Sign application and approval by the Community Development Department, in accordance with the City's Sign Ordinance. No sign shall be permitted until the application is approved and a permit issued. 14. Noise: Any noises, sounds and/or voices, including but not limited to amplified sounds, loud speakers, sounds from microphones, audio sound systems, music and/or public address system, generated by uses within the building shall not be audible to a person of normal hearing acuity from any residential property and shall not disturb adjacent retail uses. It is difficult to put percentage of usage by function because our world is very dynamic. However, the best guess today is as follows: 1. Hospitality Room, Fellowship Hall (also known as the youth center) consisting of two buildings with these four addresses: 1739, 1755, 1757,1763 S. Winchester Blvd. All of these rooms are used throughout the week varying from 8:30am to 10pm. They are used for meetings, classes, dinners, breakfasts, hospitality for visitors on Sunday, wedding receptions and funerals on occasion. They are not used every day or every night. Koffee house on Friday nights from 7:30pm to 1O:00pm. Youth ministry has Bible studies, game nights, music rehearsals, etc. throughout the month. Senior Pastors from differeI?-t churches meet for lunch here every month. Singles ministry, Women's ministry, Men's ministry all meet in these rooms weekly. Community groups use these facilities for meetings, such as Kiwanis, neighborhood watch groups, etc. Other small churches have dinners and meetings here. Cub and Boy Scouts meet in the classrooms once a week on Wednesday 7:00pm to 9:00pm Pioneer Family Academy meets here on Tuesday and Thursday from 9:00am to 2:30pm. These are children that are being home schooled by their parents. We give out food on Fridays between 10:00am and 1:00pm. We use the classrooms on Sunday from 9:00am to 1:00pm. We understand the applicant intends to purchase additional properties and prepare a master plan for their properties. The Planning Division wants the portion of the property fronting on Winchester Boulevard for commercial purposes. Therefore, the Public Works Department is not recommending major reconstruction of the street frontages and consolidation of the properties, as part of the current application under consideration for a two year use permit. PUBLIC WORKS DEPARTMENT CONDITIONS OF APPROVAL Preliminary Title Report: Prior to issuance of any permits, the applicant shall provide current Preliminary Title Reports for the properties.
