BEING A RESOLUTION OF THE PLANNING COMMISSION
OF THE CITY OF CAMPBELL, CALIFORNIA,
RECOMMENDING THE REINSTATEMENT AND
MODIFICATION TO A PREVIOUSLY-APPROVED USE
PERMIT TO ALLOW THE ESTABLISHM:ENT OF AN AUTO
SERVICE OPERATION ON PROPERTY KNOWN AS 1820 S.
WINCHESTER BOULEVARD IN A C-2-S (GENERAL
COMMERCIAL) ZONING DISTRICT. APPUCATION OF MR.
SETH BLAND, ON BEHALF OF OIL CHANGER, INC. FILE

After notification and Public Hearing as specified by law on the application of
Mr. Seth Bland, on behalf of Oil Changer, Inc., for reinstatement and
modification of a previously approved Use Permit to allow the establishment
of Oil Changers, Inc., on property located at 1820 S. Winchester Boulevard in
a C-2-S (General Commercial) Zoning District, as per the application filed in
the Planning Department on March 15, 1994; and, after presentation by the
Planning Director, proponents and opponents, the hearing was closed.
After due consideration of all evidence presented, the Planning Commission
did find as follows with respect to File No. R 94-01 1M 94-04:
1. The Campbell Municipal Code, Section 21.40.030, allows auto repair
facilities in C-2 zones upon approval of a Conditional Use Permit.
2. The site of the proposed use is designated for commercial use.
3. Minor alterations of existing facilities involving negligible or no
expansion of use beyond that previously existing are exempt from the
California Environmental Quality Act.
Based upon the foregoing findings of fact, the Planning Commission further
finds and concludes that:
1. The establishment, maintenance or operation of the use applied for will
not be detrimental to the public health, safety, pease, morals, comfort or
general welfare of persons residing or working in the neighborhood of
such proposed use or be detrimental or injurious to property and
improvements in the neighborhood or to the general welfare of the City.
2. The proposal meets the requirements of the Campbell Municipal Code,
Section 21.24.030, for approval of a Conditional Use Permit.

1. Approved Project: Approval is hereby granted for a Conditional Use
Permit to allow the establishment of an Oil Changers operation in an
existing building on Assessor's Parcel numbers: 279-38-014, -015. Project
approval shall substantially comply with the following:
A. Project to substantially comply with plans submittal dated March 15,
1994, prepared by Lynette Read, Consultant.
B. Applicant's business description per attachment number 3.
C. Operational hours:
Monday through Friday 8 a.m. to 7:30 p.m.
j Saturday 8 a.m. to 7 p.m.
Sunday 10 a.m. to 5 p.m.
2. Landscape Plan: Four copies of a landscaping plan, indicating type and
size of plant material and location of irrigation system, to be submitted to
the Planning Department and approved by the Community
Development Director prior to the issuance of building permits.
Landscaping plan shall adhere to the City of Campbell Water Efficient
Landscape Standards (WELS). Landscape plan to address the following:
A. Provision of a substantial buffer or screen along the easterly
property line.
3. Fencing Plan: Two copies of fencing plan to be submitted providing an
eight to ten foot screening wall along the easterly property line adjacent
to the service bays and extending 20 feet past either side of the service
bays to provide visual and sound screening of service bays.
4. Property Maintenance: The applicant is hereby notified that the property
is to be maintained free of any combustible trash, debris and weeds until
the time that actual improvements take place.
5. Parking and Driveway Areas: All parking and driveway areas to be
developed in compliance with Chapter 21.50 of the Campbell Municipal
Code. All parking spaces to be provided with appropriate concrete curbs
or bumper guards.
6. Utilities: Plans submitted to the Building Department for plan check
shall indicate clearly the location of all connections for underground
utilities including water, sewer, electric and telephone, etc.

7. Signs: Sign application to be submitted in accordance with provisions of
the Sign Ordinance for all signs. No sign to be installed until application
is approved and permit issued by Planning and Building Departments
(Section 21.53 of the Campbell Municipal Code).
8. Requirements for the Handicapped: Applicant shall comply with all
appropriate State and City requirements for the handicapped.

9. Vehicle Storage: No overnight storage of vehicles outside of the
enclosed building shall be permitted.
10. Business Operations: Business operations shall be limited to oil
changing and lubrication. No other automotive services shall be
performed. All service on vehicles is to be conducted entirely within the
building. No automotive work shall be conducted outdoors.
11. One-Hour Occupancy Separation: Provide a one-hour occupancy
separation between the drive-in (B-1) area and the office/waiting area (B-
2). UBC table 5(a). Consult the Central Fire District for designation of the

15. Removal of Existing Product Piping: Existing product piping remaining
from the old gas station tank and pump installation at this location shall

16. Records of Former Fuel Dispensing Areas: Provide records of sampling

17. Fire Extinguishers: Provide fire extinguishers for the sales area and the

19. Encroachment Permits: Applicant shall apply for an encroachment
permit, provide plans, pay fees and post surety to remove and
reconstruct driveway approaches and for any other construction within
the public right of way. Applicant is responsible for street tree
installation per the Streetscape Standards and for any necessary sidewalk

20. Grading and Drainage Plan: Applicant shall submit a grading and
drainage plan to the City Engineer for review. The plans shall show all
storm drain water collected on site and conveyed underground to the
existing inlet at the corner of Latimer and Winchester. (Public Works)
21. Storm Drain Area Fee: Applicant shall pay storm drain area fee for APN:
279-38-014 in the amount of $198.00. (Public Works)
22. Parcel Map: Applicant shall file and process a parcel map to combine
APN 279-38-014 and APN 279-38-015. (Public Works)
