BEING A RESOLUTION ACCEPTING STREET
IMPROVEMENTS AT 2006 WINCHESTER
BOULEVARD
WHEREAS, the City Council has been advised by the City
Engineer that all street improvements at 2006 Winchester
Boulevard have been completed in accordance with that agree-
ment entered into December 15, 1980; and
WHEREAS, the City Engineer recommends acceptance of the
street improvements;
NOW, THEREFORE, BE IT RESOLVED by the City Council of the
City of Campbell that the street improvements at 2006 Winchester
Boulevard are hereby accepted, and that the City Engineer is
hereby ordered to record a ~~tice of Completion of said street
improvements.

SUBJECT: CONSTRUCTION WORK AT CAMPBELL AND WINCHESTER
Dear Mr. Jung:
Please be aware that one of the contractors working on site at
Campbell and Winchester damaged our traffic controller box. This
box must be repaired and repainted before we can accept the im-
provements and release your bond. Please contact Mr. Manley in
this office regarding the necessary repairs.
In addition, the sidewalk around the PG&E box at Campbell Avenue
must be completed and the tree planting deficiency must be cor-
rected before we can release your bond.

Please be aware that certain offsite improvement work must be
completed before utility service connections may be made at
subject property.
This work includes the removal of two driveway approaches on
Winchester Boulevard and one and one-half driveway approaches
on Campbell Avenue and their replacement with sidewalk. The
work also includes the relocation, in accordance with your
approved plans, of the utility pole at the corner.
An Excavation Permit from the City is required before commencing
work. There will be fees and bonds required on the permit.

sidewalk now or at a later date when the City is ready to do such
work. If we do it now, does that mean that the City will relocate
the curved sidewalk at the City's expense at a later date so that my
client will not have to pay for the same work twice?

THIS AGREEMENT (identified as NO. SC-76) made and entered into this

ROSITA W. L. JUNG, husband and wife as joint tenants, hereinafter referred
to as "OWNERS", and the City of Campbell, a Municipal Corporation of the
County of Santa Clara, State of California, hereinafter referred to as
"Ci ty. "
WIT N E SSE T H:
WHEREAS, OWners applied to City for Approval to construct a commercial
building upon that certain real property devised in Grant Deed recorded
April 30, 1979 and recorded in Book E454 of Official Records of page 213,
County Recorder of Santa Clara County, California, and
WHEREAS~ the Planning Commission of City of Campbell granted its
approval on February 5, 1980 subject to certain Conditions as contained
in S-79-44, and
WHEREAS among the said Conditions there was the following:
Public Works Department:
"0." Provide evidence of access easements allowing vehicu-
1ar movement between Campbell Avenue and Sanford Avenue," and
WHEREAS after discussion of this Condition with Title of Title
Insurance and Trust, "OWNERS" have been advised, that they cannot establish
easements over their lands, but can and may reserve such easements for
access purposes in the event of sale by them of the said Real Property.
NOW THEREFORE, It Is Mutually Agreed by the Parties hereto that said
Condition "0" hereinabove set forth shall be considered as Complied with
by "OWNER", upon their promise and agreement to reserve such access ease-
ments as hereinabove required in any deed conveying the real property to
which the Condition applies to third parties and the undersigned "OWNERS"
for and in consideration of the granting of their said application, do by
this Instrument hereby agree to make such reservation of access easements
in the event of sale, transfer and conveyance of their said 1
rea property
by deed or such after Appropriate Instrument as may be required.
It is further agreed that this Instrument shall be binding upon the
OWNERSII, hei rs, successors, and assi gns.
IN WITNESS WHEREOF, said City has caused its Name to be affixed by
the Mayor and City Clerk upon Resolution of the City Council authorizing
the same, and said OWNERS have signed this Instrument on the day, year,
and places hereinafter written.

Dear Mr. Bonacina:
This letter is to confirm our conversation of October 16, 1980, and
to clarify those conditions stipulated in the agreement between the
City of Campbell and the Jungs.
This agreement (identified as No. SC-76) covers all City-required
improvements within the curb return area on their proposed development
located at the southeast corner of Campbell Avenue and Winchester
Boulevard. You will note that surface improvements (curb, gutter~
sidewalk~ paving) and relocation of the existing catch basins are spec-
ified as items of responsibility of the owner. The owner is thus pre-
cluded from any obligation to participate financially in underground
construction~ including, but not limited to, signal relocation and
relocating the existing Pacific Telephone vault.
It should be noted that in addition to the deferred improvements
covered in the subject agreement, the owner will be responsible for
relocating the existing joint pole to a point approximately five feet
east of the future fifty-foot curb return. This pole relocation along
with any curb~ gutter~ sidewalk and driveway work required by the
owner's plans (that is removal of old driveways that do not conform to
the proposed driveway locations and construction of new driveways as
proposed) must be done concurrently with the development.

WHEREAS, Jim Jung and Rosita W. L. Jung have submitted

A G R E E MEN T
THIS AGREEMENT (identified as No. SC-76), made and entered into this 20th
day of ~1av ' 19 80 , by and between JIM JUNG and ROSITA W. L.
JUNG, husband and wife as joint tenants, hereinafter referred to as "Owners," and
the CITY OF CAMP8ELL, a municipal corporation of the County of Santa Clara, State
of California, hereinafter referred to as "City."
WITNESSED:
WHEREAS, Owners applied to City for approval in order to construct a com-
mercial building upon that certain real property described in Grant Deed recorded
April 30, 1979, and filed in Book E454 of Official Records at page 213 in the office
of the County Recorder, County of Santa Clara, State of California, which property
is hereinafter referred to as "said real property";
WHEREAS, at its regular meeting held February 5, 1980, the Planning Commission
of City did consider said application and grant its approval thereon subject to cer-
tain conditions thereof as contained in S 79-44;
NOW, THEREFORE, IT IS MUTUALLY AGREED TO by and between the parties hereto as
follows:
(1) Owners shall complete at their own proper cost and expense upon WINCHESTER
BOULEVARD and CAMPBELL AVENUE throughout the frontage of said real property publ ic
street improvements consisting of the following:
1. Remove
A. 650 square feet of sidewalk
8. 88 1 inear feet of curb and gutter
C. One catch basin ~
2. Install
A. 519 square feet of sidewalk
B. 79 linear feet of curb and gutter
C. One catch basin
D. Three I i near feet of 12" RCP ,

(2) Owners shall provide and construct and/or install all of said publ ic
street improvements when Owners are so notified to do so by said City Engineer of
City.
(3) All of said improvements shall be constructed and/or installed within twelve
(12) months from the date that Owners are notified by said City Engineer to do so;
provided, however, that in the computation of said twelve-month period, delays due to
or caused by acts of God, viz., unusually inclement weather, major strikes, and other
delays beyond the control of Owners shall be excluded.
It is expressly understood and agreed to that if Owners shall fail to
complete the work required by this Agreement within the said period of twelve
(12) months, the City, after giving ten (10) days written notice thereof to Owners,
may construct and/or install said improvements and recover the full cost and ex-
pense thereof from Owners.
(4) Owners shall prepare or cause to be prepared at their cost and expense
improvement plans for the construction and/or installation of said public street
improvements, which plans shall be prepared by a civil engineer licensed by the
State of California, which plans shall be submitted to City Engineer of City for
his examination and approval and which plans shall be submitted to City Engineer
when Owners are so notified to do so by City Engineer.
Upon completion and acceptance of the improvements by City, Owners shall
provide reproducible as-built plans to said City Engineer.
(5) The construction work of the improvements embraced by this Agreement shall
be done in accordance with the Standard Specifications of the Department of Publ ic
Works, Department of Transportation, State of California, dated January, 1975, and
in accordance with the Specifications of the City of Campbell and Sanitation District
No.4 of Santa Clara County, where indicated.
Wherever the word "State" or words "Department of Transportation" are
mentioned in the State Specifications, it shall be considered as referring to the
City of Campbell. Also, wherever the "Directorll or "Director of Public Works" is
mentioned, it shall be considered as referring to the City Engineer.
In case of conflict between the State Specifications and the Specifications
of the City of Campbell and Sanitation District No.4 of Santa Clara County, the
Specifications of the City of Campbell and Sanitation District No.4 of Santa Clara
County shall take precedence over and be used in 1 ieu of such conflicting portions.
(6) Owners shall deposit with City, when called upon to do so, for office
examination of improvement plans, field inspection of construction of improvements
and all necessary expenses incurred by City in connection with said improvements, an
amount equal to 3-1/2% of the estimated cost of said improvements.
(7) Owners shall file with City, when called upon to do so, a surety acceptable
to the City in an amount equal to the estimated cost of said improvements to insure
full and faithful performance of the construction of all the aforementioned improve-
ment work, excluding sanitary sewers and water distribution system. Said surety
shall guarantee that Owners shall correct any defect which may appear in said work
within one (1) year from the date of acceptance of the work by City and pay for
any damage to other work resulting from the construction thereof, as well as paying
the cost of all labor and materials involved. This surety shall remain in full
force and effect until one (1) year after date of final acceptance of said improve-
ments. Said bond amount may be reduced by the City Engineer after the date of final ~
acceptance to not less than twenty-five (25) percent of its full value.
(8) Upon final release of said surety by City, the obligations of Owners con-
tained in this Agreement shall be considered null and void.
(9) Owners sha 11 carry out any and all negot i at ions wi th all interested
parties and shall perform or cause to be performed at their own cost and expense
and to the satisfaction of the City Engineer any and all work required to abandon,
remove, raise, lower, relocate and otherwise modify irrigation line or lines within
the boundary of said real property.
(10) Owners shall indemnify and save harmless the City of Campbell, the City
Council and the City Engineer, and any and all other officers or employees of
City from any suits, claims or actions brought by any person for or on account of
any injuries or damages to persons or property sustained or arising in the con-
struction of the on-site work due to any acts, omissions or negligence of Owners,
their officers, agents, employees or contractors.
(11) This instrument is and shall be considered to be an instrument affecting
the right, title, interest in or possession of the real property hereinabove
described, and shall bind the successors in interest of Owners.
IN WITNESS WHEREOF, said City has caused its name to be affixed by its Mayor
and City Clerk, who are duly authorized by resolution of the City Council, and
said Owners have caused their names to be affixed the day and year first above
written.
