This memo provides some ideas concerning driveway locations.
. The City of San Jose's Standard Detail R-7 (see attached) shows a minimum 4' separation (non-
sloped top of curb) between commercial driveways. The City of San Jose analyzes each driveway on
a case-by-case basis and does not have predetermined standards for driveway locations.
. The City of Santa Clara has more detailed standards (See attached Drawings R-52, R-53, and P-54)
for driveway locations relative to the location of hydrants, utility poles, street lights, and signal
poles. The City of Santa Clara recommends that driveways are not to be located within the curb
return.
. The City of Santa Clara also uses a sight distance triangle for evaluating whether an object such as a
tree would result in sight distance problems (see attached Drawing T-808A). The triangle concept
assumes the driveway motorist's eye is located 20' from the face of curb and uses the stopping sight
distance for the adjacent street motorist to allow the motorist on the street enough time to stop should
a vehicle dart from the driveway. Objects should not be located within the triangle of safety.
. For additional material, the Institute of Transportation Engineers (lIE) publication entitled
Transportation and Land Development (pp. 138-151) addresses comer clearance. Minimum comer
clearance is affected by factors such as adjacent street roadway type, control type at comer, traffic
volume including intersection, driveway turning movements, roadway speeds, and stopping sight
distance for adjacent street traffic.

PRELIMINARY APPLICATION COMMENTS:
We understand that the existing gas station pump islands, canopy, fuel tanks, and building footprint will
remain the same. The building will be remodeled and new landscape will be added at the northeast and
northwest comers of the property. Driveway locations will not change. Based on the information
submitted and our site review:
1. The existing curbs, gutter, sidewalks, and driveways are cracked and damaged and will have to
be removed and replaced as determined by the City Engineer.
2. Street trees, tree wells, and irrigation will have to be installed to comply with the City's street
tree requirements (approximately 40' on center) along the Rincon Avenue frontage. Streetscape
Standards apply for the property's Winchester frontage but the two wide driveways preclude
implementation of the standards. Perhaps trees and shrubs could be constructed on-site with
curb protected planter areas.
3. The on-site drainage system may have to be modified due to new/modified planters suggested
by the Planning Division. A drainage plan may not be necessary as determined by the City
Engineer.
4. Pay storm drain area fee ($2,500 per acre).
5. Water meters and sewer service cleanouts will have to be relocated to back of sidewalk.
6. All existing and new utilities services must be placed underground.
7. Upon resubmittal, the Site Plan must accurately depict all the information listed on the check
list.

PROJECT DESCRIPTION: Pre-application for a proposal to modify an existing 1,050 square foot service
station building at a gas station for expansion of retail sales and use as a convenience market in conjunction
with the gasoline sales. The building is located at 2140 S. Winchester Blvd. (Rotten Robbie's -- southeast
comer of Winchester Blvd. and Rincon Avenue). Rotten Robbies is proposing to eliminate the service bay
doors and replace them with storefront windows for the convenience market and also to add some
landscaping along the northwest and northeast portions of the property.
A Conditional Use Permit application will be required for this project to expand retail sales for use as a
convenience market, proposed beer and wine sales and late night operating hours.
