We, the undersigned RUSCIANO CONSTRUCTION. INCH A CALIFORNIA CORPORATION
(hereinafter "Contractor ") and Frontier Pacific Insurance Company , a corporation organized
under the laws of the State of California , and authorized to transact business in the
State of California, as Surety, are obligated to the City of Campbell, (hereinafter "City") a municipal corporation under
the laws of the State of California, in the sum of ELEVEN THOUSAND NINE HUNDRED DOLLARS
($ 11.900.00 ) for the payment of which sum we obligate ourselves and our successors and assigns, jointly and
severally by the following provisions:
The condition of this obligation is:
Because the obligated Contractor has, on ' 19_, entered into written
Contract with the City for the Project, a copy of which contract is attached and made a part of this bond, for
construction of Project R 99-02. S 96-12. UP 96-13.2205 S. Winchester Boulevard. Permit 99-233 .
Now, therefore, if the Contractor shall faithfully perform the work in accordance with the plans, specifications
and contract documents during the original term, and any extensions of the contract which may be granted by the City,
with or without notice to the surety, and if it shall satisfy all claims and demands incurred under the contract, and shall
fully indemnify and save harmless the City from all costs and damages which it may suffer by reason of failure to do so,
and shall reimburse and repay the City all outlay and expense which the City may incur in making any default, then this
obligation shall be void; otherwise to remain in full force and effect, with surety obligated to secure the full and faithful
performance of all of Contractor's obligations under the attached contract.
If any legal action be filed upon this bond, it shall be filed within one year after final payment has been made
under the Contract excluding the warranty period, if any, provided for in the Contract, and venue shall lie in the County
of Santa Clara, State of California, and that surety, for value received stipulates and agrees that no change, extension of
time, alteration or addition to the terms of the Contract or to the work to be performed under it or the specifications
accompanying it shall in any way affect its obligation on this bond, and it does by this means waive notice of any
change, extension of time, alteration or addition to the terms of the Contract or to the work or to the specifications, and
thereby waives the provisions of Section 2819 of the Civil Code of the State of California.

"Principal") and Frontier Pacific Insurance Company , a corporation organized under the laws of the
State of California ' and authorized to transact business in the State of California, as Surety,
are obligated to the City of Campbell (hereinafter "City"), a municipal corporation under the laws of the State of California, in the
sum of ELEVEN THOUSAND NINE HUNDRED DOLLARS ($ 11.900.00) for the payment of which sum we obligate
ourselves and our successors and assigns, jointly and severally by the following provisions:
The condition of this obligation is that the Principal entered, or is about to enter, into a certain written Contract with the
City dated ' 19 '
a true and correct copy of which is presently on file in the office of the City Clerk of the City of Campbell, which said Contract is
hereby referred to and made a part hereof. The contract is entitled: R 99-02. S 96-12. UP 96-13. 2205 S. Winchester Boulevard,
Permit 99-233 .
Because Principal is required to furnish a bond in connection with the contract, providing that if Principal, or any of its
subcontractors, shall fail to pay for any materials, or other supplies, or for any work or labor on the contracted work of any kind,
or for amounts due under the unemployment insurance act with respect to any work or labor on this project, the Surety on this bond
will pay for the debt, in an amount not exceeding the sum specified in this bond, and also, in case suit is brought upon the bond, a
reasonable attorney's fee to be fixed by the court.
Now, therefore, we, RUSCIANO CONSTRUCTION. INC. ,as Principal, AND Frontier Pacific Ins. ,as
Surety, are obligated to the City of Campbell, in the sum of ELEVEN THOUSAND NINE HUNDRED DOLLARS, ($ 11.900.00)
lawful money of the United States, for the payment of which sums will and truly to be made, we the said Principal and Surety bind
ourselves, successors and assigns, jointly and severally, by these provisions.
The condition of this obligation is that if Principal, its successors or assigns, or its subcontractor, or subcontractors, shall
fail to pay for any labor, materials, or other supplies, used in the performance of the work contracted to be done, or for amounts
due under the unemployment insurance act with respect to this work or labor, then the Surety on this bond will pay for them, in an
amount not exceeding the sum specified in this bond, and in case suit is brought upon this bond will also pay a reasonable attorney's
fee, to be fixed by the court.
No prepayment or delay in payment and no changes, extensions, addition or alteration of any provision of said Contract or
in any plans and specifications referred to herein, and no forbearance on the part of the City shall operate to release the Surety from
liability on this bond, and consent to make such alterations without further notice to or consent by the Surety is hereby given, and
the Surety hereby waives the provisions of Section 2819 of the Civil Code of the State of California.

The suitability of the site was evaluated by field reconnaissance, drilling,
sampling, and laboratory testing of the surface and subsurface material. The

INTRODUCTION
Per your authorization, United Soil Engineering, Inc. (USE) conducted a geotechnical
investigation and pavement design. The purpose of this geotechnical investigation
was to determine the nature of the surface and subsurface soil conditions at the
project site through field investigations and laboratory testing. This report
presents an explanation of our investigative procedures, results of the testing
program, our conclusions, and our recommendations for earth work and
foundation design to adapt the proposed development to the existing soil
conditions.
SITE LOCATION AND DESCRIPTION
The subject site is located at 2205 South Winchester Boulevard in Campbell,
California. The subject site is bounded by South Winchester Boulevard to the east,
existing commercial/retail buildings to the south, and existing residential
developments to the west and north. At the time of our investigation the site was
a relatively flat vacant parcel of land covered with grass and weeds and a few
scattered trees. The approximate location of the proposed building footprint and
our borings is shown on Figure 2 - Site Plan.
FIELD INVESTIGATION
After considering the nature of the proposed development, and reviewing available
data on the area, a field investigation was conducted at the project site by the
project geologist under the direction of a geotechnical engineer. It included a site
reconnaissance to detect any unusual surface features, and the drilling of two
exploratory test borings to determine the subsurface soil characteristics. The
borings were drilled on January 3, 1997. The approximate location of these

borings are shown on Figure 2 - Site Plan. The borings were drilled to depths of
1 2 feet below the existing ground surface elevation (bgs). The borings were drilled
with a Minuteman using 4-inch diameter hollow stem augers.
The soils encountered were logged continuously in the field during the drilling
operations. Relatively undisturbed soil samples were obtained by hammering a
2-1/2 inch 1.0. split-tube sampler into the ground at various depths. A 75 pound
hammer with a free fall of 30 inches was used to drive the sampler 18 inches into
the ground. Blow counts were recorded on each 6-inch increment of the sampled
interval. The blows required to advance the sampler the last 12 inches of the 18
inch sampled interval were recorded on the boring logs as penetration resistance.
These values were also used to evaluate the liquefaction potential of the
subsurface soils. After the completion of the drilling operation, the exploratory
borings were backfilled from the bottom of the borehole to the surface with the
drill cuttings.
In addition, a disturbed bulk sample of the near-surface soil was collected for
laboratory analyses. The Exploratory Boring Log, a graphic representation of the
encountered soil profile which also shows the depths at which the relatively
undisturbed soil samples were obtained, may be found in the Appendix at the end
of this report.
LABORATORY INVESTIGATION
A laboratory testing program was performed to determine the physical and
engineering properties of the soils underlying the site. Moisture content and dry
density tests were performed on the relatively undisturbed soil samples in order to
determine soil consistency and the moisture variation throughout the explored soil
profile (Table I). The strength parameters of the foundation soils were determined
from one direct shear test that was performed on a selected relatively undisturbed

soil sample. A laboratory compaction test was performed on the near-surface
material per the ASTM D1557-91 test procedure. An Atterberg Limits test was
also performed on the near-surface soil to assist in the classification of these soils
and to obtain an evaluation of their expansion and shrinkage potential. One R-
Value test was performed on a near surface soil sample to determine the pavement
design recommendations. The results of the laboratory testing program are
presented in the Tables and Figures at the end of this report.
SOIL CONDITIONS
The surface consisted of approximately 2 inches of organic material. From the
surface to the depth of 9 feet the soil consisted of brown, moist, stiff, gravelly
sandy silt. From the depths of 9 feet to the end of the boring, the soil became
brown moist, very dense sandy gravel.
Groundwater was not encountered in any of the exploratory borings. It should be
noted that the groundwater level will fluctuate as a result of seasonal changes and
hydrogeological variations such as groundwater pumping and/or recharging.
GENERAL GEOLOGY
The site lies in the Santa Clara Valley, which is part of the Coast Ranges geological
province. The Santa Clara Valley occupies the structural trough formed by two
northwest trending mountain ranges; the Santa Cruz Mountains to the southwest
of the valley and the Diablo Range to the northeast. The Diablo Range is
predominantly composed of Franciscan Formation, which is uppermost Jurassic to
lower Upper Cretaceous eugosynclinal assemblage. The Santa Cruz Mountains are
predominantly composed of material formed of Cenozoic shelf and slope deposits.
A thick blanket of latest Cretaceous and Tertiary clastic sedimentary rocks and
isolated intrusions of serpentine covers large parts of the province. Folds, thrust

faults, steep revers,Q faults, ~_nd c;trikeslip faults developed as a corsequencE' of
Cenozoic deformations that occur very often within the province and some of them
are continuing today (COMG; 1 966).
The Quaternary history of the region is recorded by sedimentary marine strata
alternating with non-marine strata. The changes of the depositional environment
are related to the fluctuation of sea level corresponding to the glacial and
interglacial periods.
Late Quaternary deposits fill the center of the Santa Clara Valley and most of the
strata are of continental origin characterized as alluvial and fluvial materials. The
project site is underlain by young alluvial fan deposits (Helley and Brabb, 1971,
Rogers & Williams, 1 974).
FAULTS AND SEISMICITY
The site lies in an area of active tectonics (Figure 3). Three major faults, the San
Andreas, the Hayward, and the Calaveras, are close enough to pose a significant
potential hazard due to seismic shaking. Other faults in the general vicinity of the
subject site may also pose significant, albeit lesser, potential hazards. The San
Andreas fault is located about 7 miles southwest from the site. To the northeast,
the Hayward and Calaveras faults pass approximately 11 and 13 miles from the
site respectively. The site is not located within, or immediately adjacent to, any of
the published Special Studies Zones defined by the Alquist-Priolo Geologic Hazards
Act of 1972.
The San Andreas fault is an active fault that has produced several large
earthquakes within historic time. One has been reported to have occurred in 1838,
while the other more well known event occurred in 1906 and had a magnitude of
8.25. The Carnegie Commission report compiled by A.C. Lawson (1908) is a report
by trained observers of the damage found resulting from the earthquake. It states

that the intensity of the shaking Increased toward the center of the Santa Clara
Valley where alluvial fill is thicker towards the center of the valley. It can be said,
qualitatively, that amplification of seismic energy is greater in alluvial material than
in bedrock, but less than bay mud (Borcherdt, et aI, 1975). The latest major
earthquake in the area was the Loma Prieta earthquake of October 17, 1989, which
caused considerable damage in some areas. The earthquake had a magnitude of
7.1 on the Richter scale.
According to the Procedures of Estimating Earthquake Ground Motion by Walter
Hays, the maximum ground surface acceleration in the project site vicinity could be
.30g to .35g in an earthquake and the fundamental period of ground shaking
could be 4.5 to 5,5 seconds (Hays; 1980).
GEOLOGIC AND SEISMIC HAZARDS
The evaluation of site-specific geologic and seismic hazards is based upon
reviewed references, field investigation and laboratory test results. These hazards
include ground shaking, ground rupture, ground failure, and inundation potential.
GROUND SHAKING
This primary seismic phenomenon involves horizontal and vertical vibratory motion
of the earth surface. This area has the potential for ground shaking due to the
close proximity to the active faults of the San Andreas fault system.
GROUND RUPTURE
Rupturing of the earth's surface occurs when subsurface fault displacement
extends upward to the ground surface. The hazard of ground rupture is usually
confined to rather narrow zones along fault traces. Because the subject site is not

located over or immediately adjacent to any known active faults! the likelihood of
ground rupture at the site is low.
GROUND FAILURE
The secondary effects resulting from strong ground shaking may take forms such
as lateral spreading, ground lurching and liquefaction. All of these involve
displacement of the ground surface due to loss of strength or failure of the
underlying materials during shaking. Due to the site conditions, liquefaction is the
primary ground failure to be considered.
LIQUEFACTION
Liquefaction is the transformation of loose saturated silts and sands with less than
15% clay-sized particles from a solid state to semi-liquid state. This occurs un~er
vibratory conditions such as those induced by a seismic event. To help evaluate
liquefaction potential, samples of potentially liquefiable soil were obtained by
hammering the split tube sampler into the ground. The number of blows required
to drive the sampler the last 12 inches of the 18 inch sampled interval were
recorded on the log of test borings.
The results from our exploratory borings show that in all borings, the subsurface
soil material consisted of stiff brown gravelly sandy silt to very dense sandy gravel.
Therefore, in our opinion there is a low possibility for liquefaction to occur at the
site.

INUNDATION POTENTIAL
The subject site is located at 2205 South West Winchester Boulevard in Campbell,
California. According to the Limerinos and others, 1973 report, the site is not
located in an area that has potential for inundation as the result of a 100 year flood
(Limerinos; 1973).

CONCLUSIONS
1 . The site covered by this investigation is suitable for the proposed
buildings provided the recommendations set forth in this report are
carefully followed.
2. The native surface soil at the project site has been found to have a low
expansion potential when subjected to fluctuations in moisture.
3. On the basis of the engineering reconnaissance and exploratory
borings, it is our opinion that trenches to excavated to depths less
than 5 feet below the existing ground surface will not need shoring.
However, for trenches greater than 5 feet in depth, shoring will be
required.
4. Specific recommendations are presented in the remainder of this
report.
S. All earthwork and grading shall be observed and inspected by a
representative from United Soil Engineering, Inc., (USE). These
operations are not limited to testing and inspection during grading.

RECOMMENDATIONS
GRADING
1 . The placement of fill and control of any grading operations at the site
should be performed in accordance with the recommendations of this
report. These recommendations set forth the minimum standards to
satisfy other requirements of this report.
2. All existing surface and subsurface structures, if any, that will not be
incorporated in the final development shall be removed from the
project site prior to any grading operations. These objects should be
accurately located on the grading plans to assist the field engineer in
establishing proper control over their removal. All utility lines, if any,
must be removed prior to any grading at the site.
3. The depressions left by the removal of subsurface structures should
be cleaned of all debris, backfilled and compacted with clean, native
soil. This backfill must be engineered fill and should be conducted
under the supervision of a USE representative.
4. All organic surface material and debris, including grass and weeds
shall be stripped prior to any other grading operations, and
transported away from all areas that are to receive structures or
structural fills. Soil containing organic material may be stockpiled for
later use in landscaping areas only.
5. After removing all the subsurface structures, if any, and after stripping
the organic material from the soil, the building pad area should be
scarified by machine to a depth of 12 inches and thoroughly cleaned
of vegetation and other deleterious matter.

6. After stripping, scarifyinq and cleaning operations, native ~oil should
be re-compacted to not less than 90% relative maximum compaction
using ASTM 01557-91 procedure over the entire building pad and 10
feet beyond the perimeter of the pad.
7. All engineered fill or imported soil should be placed in uniform
horizontal lifts of not more than 6 to 8 inches in un-compacted
thickness, and compacted to not less than 90% relative maximum
compaction using ASTM 01557-91 procedure. The base rock,
however, should be compacted to not less than 95% relative
maximum compaction. This should extend at least 10 feet beyond
the building perimeter in all directions. Before compaction begins, the
fill shall be brought to a water content that will permit proper
compaction by either; 1) aerating the material if it is too wet, or 2)
spraying the material with water if it is too dry. Each lift shall be
thoroughly mixed before compaction to assure a uniform distribution
of water content.
8. When fill material includes rocks, nesting of rocks will not be allowed
and all voids must be carefully filled by proper compaction. Rocks
larger than 4 inches in diameter should not be used for the final 2 feet
of building pad. The existing asphalt concrete, if any, should not be
incorporated into the construction of the building pad.
9. United Soil Engineering, Inc., (USE), should be notified at least two
days prior to commencement of any grading operations so that our
office may coordinate the work in the field with the contractor. All
imported borrow must be approved by USE before being brought to
the site. Import soil must have a plasticity index no greater than 12
and an R-Value greater than 25.

10. All gradinq work shall be observed and approved by a
representative from USE. The geotechnical engineer shall prepare a
final report upon completion of the grading operations.
WATER WELLS
~
11. Any water wells and/or monitoring wells on the site which are to be
abandoned, shall be capped according to the requirements of the
Santa Clara County Water District. The final elevation of the top of the
well casing must be a minimum of 3 feet below the adjacent grade
prior to any grading operation.
FOUNDATION DESIGN CRITERIA
12. The proposed buildings may be supported on a continuous perimeter
foundation and isolated interior spread footings or skin friction pier
foundations. Recommendations are presented in the following
paragraphs.
1 3. When continuous perimeter and isolated interior spread footings are
used for the proposed buildings they must be founded at a minimum
depth of 30 inches below the finished floor elevation or 1 8 inches
below the rough soil pad grade. For these conditions, the
recommended allowable bearing capacity is 2,800 p.sJ. for both
continuous perimeter and isolated and interior spread footings.

14. Friction piers should be embedded at a minimum depth of 6 feet
below the lowest adjacent exterior grade. The allowable friction value
for this type of foundation is 500 p.s.f.
15. We highly recommend that a representative from our office be present
to make any field adjustments during the drilling of the piers.

16. The above bearing values are for dead plus live loads, and may be
increased by one-third for short term seismic and wind loads. The
design of the structures and the foundations shall meet local building
code requirements.
1 7. The final design of the foundations and reinforcing required shall be
determined by the project structural engineer responsible for the
foundation design. It is suggested that the foundation design be
reviewed by our office prior to construction.
RETAINING WALLS
18. Any facilities that will retain a soil mass shall be designed for a lateral
earth pressure (active) equivalent to 50 pounds equivalent fluid
pressure, plus surcharge loads. If the retaining walls are restrained
from free movement at both ends, they shall be designed for the earth
pressure resulting from 60 pounds equivalent fluid pressure, to which
shall be added surcharge loads. The project structural engineer shall
discuss the surcharge loads with our office prior to designing the
retaining wall.
19. In designing for allowable resistive lateral earth pressure (passive) of
250 pounds equivalent fluid pressure may be used with the resultant
acting at the third point. The top foot of native soil shall be neglected
for computation of passive resistance.

20, A friction coefficient of 0.3 sha.1I be used for retaining wall design.
This value may be increased by 1/3 for short term seismic loads.
21 . The above values assume a drained condition, and a moisture content
compatible with those encountered during our investigation. To
promote proper drainage, a layer of at least 1 foot gravel or drain rock
shall be placed between the facility and the retained material. Either
weep holes or perforated pipes (perforations down) shall be included
in the design to conduct excess water from behind the retaining
structure. Suitable outfall locations for drainage facilities shall be
chosen to minimize future erosion.
22. We recommend a thorough review by our office of all designs
pertaining to facilities retaining a soil mass.
CONCRETE SLAB-ON-GRADE CONSTRUCTION
23. The native soil on the site was found to have a low expansion
potential when subjected to fluctuation in moisture. Therefore, no
non-expansive fill is required beneath the concrete slab.
24. A minimum of 5 inches of Class II baserock (recycled baserock and/or
crushed asphalt concrete is not acceptable) and 2 inches of sand shall
be used between the finished grade and the concrete slab. The
baserock should be compacted to not less than 95% relative
maximum compaction according to ASTM D1 557-91.
25. Use of a vapor barrier under the concrete slab is required if a floor
covering is to be applied. If a plastic membrane is used, it shall be
placed between the baserock and the sand layers.

26. Prior to placing the vapor membrane and/or pouring concrete~ the
slab subgrade shall be moistened with water to reduce the swell
potential, if deemed necessary, by the field engineer at the time of
construction.
EXCAVATION
27. No difficulties due to soil conditions are anticipated in excavating the
on-site material. Conventional earth moving equipment will be
adequate for this project.
28. Any vertical cuts deeper than 5 feet must be properly shored. The
minimum cut slope for excavation to the desired elevation is one
horizontal to one vertical. The cut slope should be increased to 2:1 if
the excavation is conducted during the rainy season or when the soil
is highly saturated with water.
DRAINAGE
29. It is considered essential that positive drainage be provided during
construction and be maintained throughout the life of the proposed
structure.
30. The final exterior grade adjacent to the proposed building should be
such that the surface drainage will flow away from the structures.
Rain water discharge at downspouts should be directed onto
pavement sections, splash blocks, or other acceptable facilities which
will prevent water from collecting in the soil adjacent to the
foundations.
31. Utility lines that cross under or through perimeter footings should be
completely sealed to prevent moisture intrusion into the areas under

the slab and/or footings. The utility trench backfill should be of
impervious material and this material should be placed at least 4 feet
on either side of the exterior footings.
32. Consideration should be given to collection and diversion of roof
runoff and the elimination of planted areas or other surfaces which
could retain water in areas adjoining the building. In unpaved areas, it
is recommended that protective slopes be stabilized adjoining
perimeter building walls. These slopes should be extended to a
minimum of 5 feet horizontally from building walls. They must have a
minimum outfall of 5 percent.
ON-SITE UTILITY TRENCHING
33. All on-site utility trenching must be compacted to at least 90% relative
maximum compaction in accordance with ASTM D1557-91. Backfill
should be placed in 6 to 8 inch lifts and compacted. jetting of trench
backfill is not recommended. An engineer from our firm should be
notified at least 48 hours before the start of any utility trench
backfilling operations.
34. If utility trench excavation is to encounter groundwater, our office
should be notified for dewatering recommendations.

PAVEMENT DESIGN
35. Due to the uniformity of the near-surface soil at the site, one R-Value
Test was performed on a representative bulk sample. The result of
the R-Value test is enclosed in this report. The following alternate
sections are based on our laboratory resistance R-Value test of
near-surface soil samples and traffic indices (T.I.) of 4.5 for parking
areas and 5.5 for driveway. Alternate pavement section designs which
satisfy the State of California Standard Design Criteria, and above
traffic indices are presented in Table -2.

LIMITATIONS AND UNIFORMITY OF CONDITIONS
1 . The recommendations presented herein are based on the soil conditions
revealed by our test borings and evaluated for the proposed construction
planned at the present time. If any unusual soil conditions are encountered
during the construction, or if the proposed construction will differ from that
planned at the present time, United Soil Engineering, Inc. should be notified
for supplemental recommendations.
2. This report is issued with the understanding that it is the responsibility of the
owner, or his representative, to ensure that the necessary steps are taken to
see that the contractor carries out the recommendations of this report in the
field.
3. The findings of this report are valid, as of the present time. However, the
passing of time will change the conditions of the existing property due to
natural processes, works of man, from legislation or the broadening of
knowledge. Therefore, this report is subjected to review and should not be
relied upon after a period of three years.
4. The conclusions and recommendations presented in this report are
professional opinions derived from current standards of geotechnical
practice and no warranty is intended, expressed, or implied.
5. This report has been prepared solely for the purpose of geotechnical
investigation and no toxic contamination studies have been performed by
our firm.

2. Development Approval Expiration: The Site and Architectural Approval (S 96-12)

from the date of approval or the Site Approval shall be void.
3. Signage: Sign permits are required for all signs proposed. Approval of a Sign
Exception is required by the Planning Commissiori for more than one wall sign and
one free-standing sign.
4, Standard Street Improvements: Prior to issuance of any building permits for the site,
the applicant shall prepare plans, pay fees, post securities, and provide insurance as
required to obtain an encroachment permit to construct public street improvements as
required by the City Engineer. Public street improvement plans shall be prepared by
a registered Civil Engineer licensed in the State of California, and shall include the
following:
A. Removal of existing curb, gutter, two driveways, and sidewalk across the
complete property frontage.
B, Installation of new curb, gutter 10' sidewalk, driveway, street trees, tree wells and
irrigation system.
e. Relocation of water meter and sewer clean out to back of sidewalk (property
line).
D. Collection of all on-site drainage and convey underground to existing storm line
in Winchester Boulevard.

E. Prior to issuance of occupancy for the site, all public street improvements
required by the encroachment permit must be completed and accepted by
the City Engineer and the applicant must provide the one-year maintenance
security.
5. Storm Drain Area Fee: Prior to issuance of any building permits for the site, the
applicant shall pay the required storm drain area fee of $2,500.
6. Grading and Drainage Plan: Prior to issuance of any building permits for the site, the
applicant shall conduct on- and off-site hydrology studies, and provide hydraulic
calculations, as necessary, prepare grading and drainage plans, and pay fees required
to obtain necessary grading permits. Structural calculations are required for all
proposed retaining walls. Storm drainage facilities shall be designed to
accommodate the 10-year design frequency storm. All runoff shall be collected
on-site and conveyed under the sidewalk through the curb face to the gutter.
The City will provide a detail for the under sidewalk drain.
7. Landscaping: A Landscape plan shall be submitted for review by the Community
Development Director, under advisement by the City's Landscape Advisor. The plan
shall include evergreen trees, of a minimum 24" box size, to ultimately form a solid
row of greenery along the west and south property lines, from a point approximately
15' from the front property line, The landscaping shall also screen any utilities which
are visible from the public right-of-way and from adjacent properties.
8. Shared Access:
Prior to issuance of a building permit, applicant shall record a covenant running with
the land, obligating the existing and future property owner to provide reciprocal
driveway access easements to the properties immediately to the north and south.
9, Dedication: Dedicate additional right-of-way, as necessary, to create 10' of public
street right-of-way from face of curb to property line.

The construction ofa 2520 square foot commercial building on a 13,790 square foot lot. The

III. RESPONSES TO ENVIRONMENTAL CHECKLIST
The following explanations are keyed to the letter of the item contained in the Environmental
Checklist.
c. Geophysical
Exposure to fault rupture, ground shaking or liquefaction. The City of Campbell is located
within the San Francisco Bay Area, which is one of the most seismically active regions in the United
States, The San Andreas Fault and The Hayward Fault are the two major fault zones that affect the
Campbell area.
The relative seismic stability of areas in Campbell have been identified in a report prepared by the
California Division of Mines in cooperation with Santa Clara County titled, "Potential Seismic
Hazards in Santa Clara County". The Seismic Safety Element of the Campbell General Plan
identifies the relative seismic stability for the Campbell area. The project site is located in an area
designated to include low to moderate potential for liquefaction.
The state building code includes requirements for seismic safety, thus no additional mitigation
measures are necessary,
D. Water
The project will increase the amount of runoff from the site due to an increase in the impermeable
coverage by buildings and pavement, The water will be conveyed to a storm sewer system which
will return it to the water table. The City codes and standard project conditions include requirements
for drainage, thus no additional mitigation measures are necessary.
E. Transportation
The project will, of course, add traffic to the local and City streets above that of the now vacant site.
The City Traffic Engineer has determined that the location of the driveway and the amount of
additional traffic will not significantly impact City streets,
F. Noise
The applicant has stated that the proposed use is not similar to a standard auto body shop. The service
is for repair of minor automobile dents, such as those made by the opening of adjacent car doors in a
parking lot. The applicant presently visits clients at their houses in residential areas to work on their
vehicles, and has received no complaints from neighbors regarding the noise from their operation.
Future commercial uses which could be noisy are listed in the Zoning Code as requiring a Use
Pennit. Trash pickup of commercial uses occurs in the early morning, which has the potential for
some noise impact. To mitigate such impact, the Zoning Code requires builders of commercial
projects to construct a block wall along residentially-zoned boundaries.
L. Light/Glare
The building will have exterior lights, Those indicated on elevations submitted are down-lights,
which will not create glare on adjacent parcels, City Code requires that lights not create glare on
adjacent parcels, and thus no additional mitigation measures are necessary,

IV. MANDATORY FINDINGS OF SIGNIFICANCE
A. As discussed above, this project does not have the potential to significantly degrade the
quality of the environment, including effects on animals or plants, or to eliminate historic
or prehistoric sites.
B. As discussed above, both short and long-term environmental effects associated with this
project will be less than significant.
C. When impacts associated with this project are considered alone or in combination with
impacts of other projects, they are not significant.
D. The above discussions do not identify any substantial adverse impacts to people as a result
of this project.
v. DETERMINATION

the Public Works Department Conditions of Approval are summarized as follows:
1. Standard Street Improvements:
Prior to issuance of any building permits for the site, the applicant shall prepare plans,
pay fees, post securities, and provide insurance as required to obtain an encroachment
permit to construct public street improvements as required by the City Engineer. Public
street improvement plans shall be prepared by a registered Civil Engineer licensed in the
State of California, and shall include the following:

Collection of all on-site drainage and convey underground to Winchester
Boulevard. (See No.3 Grading and Drainage Plan).
Prior to issuance of occupancy for the site, all public street improvements
required by the encroachment permit must be completed and accepted by the City
Engineer and the applicant must provide the one-year maintenance security.
Storm Drain Area Fee:
Prior to issuance of any building permits for the site, the applicant shall pay the required
storm drain area fee of $2,500.

3. GradinlZ and Drainage Plan:
Prior to issuance of any building permits for the site, the applicant shall conduct on- and
off-site hydrology studies, and provide hydraulic calculations, as necessary, prepare
grading and drainage plans, and pay fees required to obtain necessary grading permits.
Structural calculations are required for all proposed retaining walls. Storm drainage
facilities shall be designed to accommodate the lO-year design frequency storm. All
runoff shall be collected on-site and conveyed under the sidewalk through the curb face
to the gutter. The City will provide a detail for the under sidewalk drain.
4. No Parking On Public Streets
Vehicles serviced or waiting to be serviced shall not be parked on public streets in front
of non-commercial property.

I have no objections to the proposed project on Winchester. However, there is a potential
concern about the storage of vehicles on nearby local streets, despite the developer's assurance
that this will not occur. My suggestion is that a condition be added as follows: "Customer
vehicles to be serviced or that have been served shall not be stored on local streets in front of
non-commercial property." It would only be enforced if we receive complaints from local
residents, but this condition would at least give us some leverage in taking corrective measures.

2. We have a concern on potential parking overflow to Winchester and the adjacent

WRITTEN STATEMENT FOR 2205 WINCHESTER BOULEVARD
The applicant, Roger Scala, proposes an operation that removes minor dents from
cars. The process by which this is accomplished does not require pounding or
painting. It is done by manipulation of the dent from within the car with special tools.
This is a very clean and specialized operation. It does not generate significant noise.
It is not like an auto repair or body shop. The market for this service has more of an
"upscale" appeal. The typical customer for this service has a late model or expensive
car. This business does not attract junk cars.
The hours for this business will be normal business hours such as an office or retail
use. We anticipate approximately four or fewer employees at any time. We anticipate
the traffic generated by this project to be less than a retail use.
This site has sat vacant for many years. The site has some older fruit trees and mostly
weeds. This is a very difficult site to develop. The site is long and narrow with the
narrow end fronting the street. The site will require a substantial amount of fill to make
it drain properly.
It would be very unlikely for a developer to improve the site the way we propose. The
return would not justify the construction and development costs. In this case, the
developer is also the user and is willing to sustain the additional burden of developing
a difficult site.
This application should be granted because this is a much needed service for the
Campbell and West Valley area. In addition, this stretch of Winchester Boulevard is in
great need of development and revitalization. This project will be the first along this
stretch of Winchester Boulevard to initiate the vision of the Campbell City Planners.
