RE: Review of Pre-application P A 97-70 for a proposed outdoor patio addition to an
existing restaurant/bar
Dear Mr. Murphy:
The Community Development Department has reviewed your Pre-application (PA 97-70) for a
proposed 1,056 square foot outdoor patio in conjunction with your restaurant and bar
establishment and has determined that the proposed use will require approval of a Use Permit.
Under the C-2-S (General Commercial) zoning district in which your property is located,
outdoor business activities, including outdoor eating areas in conjunction with a restaurant,
require approval of a Use Permit. Additionally, liquor establishments require approval of a
Use Permit. Although the existing liquor establishment did not originally require approval of a
Use Permit, please note that an expansion of the liquor establishment to allow alcoholic
beverage service to the outdoor patio area will require approval of a Use Permit.
Approval of a Use Permit is granted by the Planning Commission through a public hearing
process. Please find enclosed for your reference a Use Permit application. The application fee
for the Use Permit is $1,550.
The Planning Division at this time is unable to make a recommendation of support or denial
for the proposal without additional information on your plans. The following additional
information must be included on your plans for further review:
1. An accurate site plan which depicts the configuration of the existing property, number of
existing parking spaces, number of parking spaces to be removed, setbacks of the existing
building and proposed patio enclosure from property lines, and the width of the driveway
aisles between parking spaces and the proposed patio enclosure. Please note that, given the
current parking lot configuration, a 25-foot back-up distance is required behind parking
spaces for maneuvering.
2. A seating and floor plan of the existing restaurant and proposed patio area specifying the
placement and number of seats. This information is needed to calculate the number of
parking spaces required for the restaurant/bar establishment.
3. Provision of parking for the disabled. Number of disabled parking spaces and dimensions
of disabled parking spaces should comply with the Americans with Disabilities Act.

4. A description of the use for the outdoor patio area. Is the patio area intended for additional
seating for the restaurant/bar establishment? Are there any proposals to provide shelter or
covering over the enclosed area? Is the proposed area intended to provide outside smoking
areas for customers?
Although a Planning Division determination cannot be made at this time without the above-
referenced items, the Planning Division has reviewed the elevations for the proposed patio
enclosure. The Planning Division is not supportive of the 7- foot high, solid block stucco wall
which creates a "walled-off' appearance and does not architecturally tie into the building. It is
suggested that the appearance of the wall be softened by elements which would break up the
extensive and lengthy appearance of the wall. Some options you may want to explore include
reducing the size of the enclosure, adding landscaping around the wall and/or creating
openings in the wall.
The Planning Division is also aware that there is an active Code Enforcement case regarding
the non-conforming status of the existing sign on your building. Please be aware that no
approvals or building permits will be issued for the proposed outdoor patio until the non-
conforming sign is removed from the property.
In addition to the comments from the Planning Division, the Public Works Department has
submitted preliminary conditions of approval which will be required of your property for the
proposed project. The following preliminary conditions have been proposed based upon the
expansion of the restaurant and bar establishment:
Public Works Department:
1. Public Service Easement: Prior to issuance of any building permits for the site, the
applicant shall grant a lO-foot public service easement on private property contiguous with
the public right-of-way along the westerly 60 feet of Parcel 1 of PM 336/23 on the
Sunnyside Avenue frontage. Applicant shall prepare all documents necessary for City
review, acceptance, and recording.
2. Standard Street Improvements: Prior to issuance of any building permits for the site, the
applicant shall cause plans for public improvements to be prepared by a registered civil
engineer, pay fees, post securities and provide insurance necessary to obtain an
encroachment permit for construction of the improvements, as required by the City
Engineer. The plans shall include the following:
a. Street trees, tree wells, and irrigation at 40 feet on center along the Sunnyside
Avenue frontage.
b. Street trees, tree wells, and irrigation along the Winchester Blvd. frontage to
comply with the Streetscape Standards.
c. Repair of sidewalks and driveways as determined by the City Engineer.

3. Completion of Public Street Improvements: Prior to issuance of occupancy for the site, all
public street improvements required by the encroachment permit must be completed and
accepted by the City Engineer/Council and the applicant must provide the one-year
maintenance security for 25% of the Faithful Performance Board.
4. Storm Water Management: Comply with California Storm Water Best Management
Practices Handbook, prepared by the Storm Water Quality Task Force, Santa Clara Valley
Water District.

The Planning Division has reviewed the plans for Murphy's Tavern. The original
approval for the site in 1966 was for a cocktail lounge. The approved site plan shows a
1,500 sq. ft. building with a 12 space parking area. The original conditions of a.,
