STREET IMPROVEMENT AGREEMENT ~H' THIS AGREEMENT (identified as File No.~.;,Z!) made and entered into this day of ~ ' 20 0 I , by and between , hereunder referred to as "Owner," and the CITY OF CAMPBELL, a m cipal corporation of the County of Santa Clara, State of California, hereinafter referred to as "City." WHEREAS, on q- 14 ,20M the e., ~ o~ c.Qn\(J kU granted conditional approval of \mv~o~ for that certain real property described in Exhibit A attached and incorporated as though fully set forth herein, and commonly known as 3'Uo S (address) u..) \('\~~ or 5\0~ , which property is hereinafter referred to as "said real property"; WHEREAS, compliance with the terms and conditions of this Agreement are conditions to the approval of the above described Tentative Parcel Map; NOW, THEREFORE, IN CONSIDERATION OF THE ABOVE-MENTIONED APPROV AL, and satisfaction of the conditions to that approval, (1) Owner shall provide, construct and/or install at his own proper cost and expense, street improvements as described in Section 11.24.040 of the City Code within 12 months from the date first mentioned hereinabove; provided, however, that in the computation of said 12 month period, delays due to, or caused by acts of God, viz., unusually inclement weather, major strikes, and other delays beyond the control of Owner or his successors shall be excluded. (2) It is expressly understood and agreed to that if Owner shall fail to complete the work required by this Agreement within the said 12 month period, the City, after giving ten (10) days written notice thereof to Owner, or his successors, may construct and/or install said improvements and recover the full cost and expense thereof from owner, or his successors. (3) Owner, or his successors, shall cause to be prepared at his cost and expense improvement plans for the construction and/or installation of said improvements prior to such construction or installation. Said plans shall be prepared by a civil engineer registered by the State of California and submitted to the City Engineer for examination and approval. All of said improvements shall be constructed and/or installed in accordance with those plans approved by the City Engineer and shall be made under the supervision and inspection and to the satisfaction of the City Engineer. Said construction and/or installation shall be in accordance with the existing ordinances and resolutions of the City of Campbell and to all plans, specifications, standards, sizes, lines and grades approved by the City Engineer, and all State and County statutes applicable thereto. Upon completion and acceptance of the improvements by City, Owner, or his successors, shall provide reproducible as-built plans to the City Engineer. (4) The construction work of the improvements embraced by this Agreement shall be done in accordance with the specifications of the City of Campbell and West Valley Sanitation District of Santa Clara County, where indicated. (5) Prior to approval of the plans by the City Engineer pursuant to Section (3) of this Agreement, Owner, or his successors, shall pay to the City for examination of improvement plans, field inspection of construction of improvements and all necessary expenses incurred by City in connection with said improvements, a sum calculated in accordance with Resolution No. 9687 as adopted by the City Council on June 6, 2000, or as may subsequently be adopted by the City Council. (6) Owner, or his successors, shall file with City, prior to beginning construction, surety acceptable to the City in amount equal to the City Engineer's estimated cost of the street improvements to ensure full and faithful performance of the construction of all the aforementioned improvement work, excluding sanitary sewers and water distribution system. Said surety shall guarantee that Owner, and his successors, will correct any defects which may appear in said improvement work within one (1) year from the date of acceptance of the work by City and pay for any damage to other work resulting from the construction thereof, as well as pay the cost of all labor and materials involved. This surety shall remain in effect until one (1) year after date of final acceptance of said improvements by City. Said surety amount may be reduced by the City Engineer after the date of final acceptance to not less than twenty-five (25) percent of its full value. (7) Upon final release of said surety by City, the obligations of Owner, and his successors, contained in this Agreement shall be considered null and void. (8) When called upon by City to do so, Owner, or his successors, will execute a petition for the formation of any special assessment district created pursuant to any special assessment act as provided in the Streets and Highways Code of the State of California created . for the purpose of constructing and/or installing any or all of said improvements. 2 (9) Owner, or his successors, shall participate in and become a part of any special assessment district as described in paragraph (8) of this Agreement. It is expressly understood that any obligations of Owner, or his successors, contained in this Agreement that are accomplished to the satisfaction of said City Engineer by said special assessment district shall be considered null and void. (10) Owner, or his successors, shall make such deposits or file such bonds and enter into such agreement as required by West Valley Sanitation District of Santa Clara County to ensure the installation of a sanitary sewage system to serve said real property, and Owner, or his successors, shall file with City, upon execution of this Agreement, a letter from said Sanitation District stating that Owner, or his successors, have made such deposits or flIed such bonds and entered into such agreements. (11) Owner, or his successors, shall pay to Pacific Gas and Electric Company any and all fees required for installation of underground wiring circuit to all electroliers within said real property when Owner, or his successors, is notified by either the City Engineer or the Pacific Gas and Electric Company that said fees are due and payable. Owner's, and his successors', obligations under this section shall not be relieved by delay or the passage of time, but shall remain binding indefinitely and forever. (12) Owner, or his successors, shall make such deposits or file such bonds and enter into such agreement as required by San Jose Water Company when called upon to do so to ensure the installation of a water distribution system to serve said real property, including fire hydrant. Owner's, and his successors', obligations under this section shall not be relieved by delay or the passage of time, but shaIl bind Owner and successors indefmitely and forever. (13) Any easement and right of way within or without said real property necessary for the completion of the improvements shown upon aforesaid improvement plans shall be acquired by Owner, or his successors, at his own cost and expense. It is provided, however, that in the event eminent domain proceedings are required for the purpose of securing said easement and right of way, Owner, or his successors, shaIl deposit or cause to be deposited with City a sum covering the reasonable market value of the land proposed to be taken and to be included in said sum shaIl be a reasonable allowance for severance damages, if any. It is further provided that in addition thereto such sums as may be required for legal fees and costs, engineering and other incidental costs shaIl be deposited with the City. (14) Owner, or his successors, shaIl carry out any and all negotiations with all interested parties and shall perform or cause to be performed at his own cost and expense and to the satisfaction of the City Engineer any and all work required to abandon, remove, raise, lower, relocate and otherwise modify irrigation line or lines within the boundary of said real property. 3 (15) To the fullest extent permitted by law, Owner, and his successors, shall indemnify, defend and hold the City of Campbell, and its agents, employees, attorneys, officers, officials and assignees harmless from any and all claims, damages, losses and expenses, including, but not limited to, attorneys' fees, arising out of, or resulting from any negligent or intentional act or omission (including misconduct) of said Owner, or his successors, or any subcontractor, or anyone directly or indirectly employed by him, or anyone for whose acts any of them may be liable in the course of performance of the Agreement. The Owner, and his successors, shall also indemnify, defend and hold the City of Campbell, and its agents, attorneys, employees, officers, officials, and assignees harmless against and from any and all claims, demands, liabilities, losses, lawsuits, judgments, damages, costs and expenses (including, but not limited to, attorneys' fees and court costs, whether incurred at trial, appellate or administrative levels) which the City of Campbell may incur or suffer, or to which the City of Campbell may be subjected resulting from the failure of Owner, or his successors, or his agents, employees, subcontractors, or anyone performing services under him, to fulfill any of the obligations imposed under this Agreement. (16) It is acknowledged that the provisions of this Agreement constitute covenants for the improvement of the subject real property for the mutual benefit of Owner's property, commonly known as (address) ~2.fo.S lO\~-+ev~c\ and the City's property, commonly described as (street name) '~2J:o S \0 \ () c\i\.Q.s,-\-eX Bt J ~ where it adjoins Owner's property. These covenants shall be considered to affect rights in the above- described real properties, and shall be binding on the heirs, assigns, successors, and grantees of Owner to said real property. (17) Nothing contained herein shall be construed to transfer any unvested interests in real or personal property for purposes of the rule against perpetuities. (18) In the event that Owner, or his successors, should breach any of the terms, conditions, or covenants of this Agreement, the City shall be entitled to recover, in addition to any other relief available in law or equity, all costs incurred in attempting to obtain enforcement of the Agreement, or compensation for such breach. These costs shall include reasonable attorneys' fees and court costs. (19) This is the entire Agreement between the parties, and there are no representations, agreements, arrangements or understandings that are not fully expressed herein. (20) This Agreement can be executed in counterparts by the parties hereto, and as so executed shall consist of one agreement, binding on all parties. APPLICATION OF DR. KAREN LANGEMAN, ON BEHALF OF PORTE VETERINARY CLINIC. FILE NO. PLN2000-113. After notification and public hearing, as specified by law, and after presentation by the Community Development Director, proponents and opponents, the hearing was closed. After due consideration of all evidence presented, the Planning Commission did find as follows with respect to application PLN2000-113: 1. There have been no changes in the General Plan and the zoning of the property since the previous approval of the project. 2. The proposed site is adequately served by streets of sufficient capacity to carry the kind and quantity of traffic the proposed use would generate. 6. The proposed site is adequate in size and shape to accommodate the proposed project and will integrate well with the existing uses in the surrounding area. Right-of- Way for Public Street Purposes: Prior to issuance of any grading or building permits for the site, the applicant shall cause additional Right-of-Way to be granted for Public Street Purposes along the Winchester Boulevard frontage to accommodate 45 foot half street. Street Improvements: Prior to issuance of any grading or building permits for the site, the applicant shall execute a street improvement agreement and shall cause plans for public Street Improvements to be prepared by a registered civil engineer, pay fees, post security and provide insurance necessary to obtain an encroachment permit for construction of the standard public street improvements, as required by the City Engineer. The fee for a non- utility encroachment permit is $245.00. Utility Installation Plan: Prior to issuance of building permits for the site, the applicant shall submit a Utility Installation Coordination Plan and Schedule for approval by the City Engineer for installation of street improvements and/or abandonment of all utilities. Streets which have been resurfaced within the previous 5 years will require boring and jacking for all new utility installations. Applicant shall also prepare pavement restoration plans for approval by the City Engineer prior to any utility installation or abandonment. 9. Grading and Drainage Plan: Prior to issuance of any grading or building permits for the site, the applicant shall conduct hydrology studies based on a 10 year storm frequency, prepare an engineered Grading and Drainage Plan, and pay fees required to obtain necessary grading permits. The plans shall comply with the 1998 edition of the California Building Code including Chapters 10, 11, 18,33, and Appendix Chapter 33. 10. Storm Drain Area Fee: Prior to issuance of any grading or building permits for the site, the applicant shall pay the required Storm Drain Area fee which is $2,500 unless previously paid. 11. Storm Water Pollution Prevention Measures: Prior to issuance of any grading or building permits, the applicant shall comply with the National Pollution Discharge Elimination System (NPDES) permitting requirements and the California Storm Water Best Management Practices handbook prepared by the Storm Water Quality Task Force, Santa Clara Valley Water District and the City of Campbell Municipal Code regarding Storm Water Pollution Prevention. 12. After notification and public hearing, as specified by law, and after presentation by the Community Development Director, proponents and opponents, the hearing was closed. The clinic was apparently created in 1983 by remodeling an existing residential structure. A new driveway was also constructed. Storm drain area fees were paid. The frontage is fully improved with curb and gutter, sidewalk, utilities, and a street tree. These improvements are consistent along this portion of Winchester Boulevard. The existing parking lotis lower than the curb and gutter flow line. Therefore, water runoff must be pumped to the street. If the pump were to fail, the water would pond until it releases to the west across an existing developed residential lot. The lot to the north is improved with a commercial building. It is substantially higher than the subject property and drains by gravity to Winchester. The property to the south is developed as an auto sales, lease and storage facility. The lot is 2' to 3' higher than the clinic. The difference in grade is handled by a slope of about 3 horizontal to 1 vertical. There has been some movement at the toe of the slope. As a result, Frank Cauthorn, City Building Official, sent a letter to the owner directing him to retain an engineer to design a solution to the problem. Concerning public street improvements, the proposed expansion must be evaluated with respect to the Streetscape Standards adopted by resolution on August 3, 1993, and the San Tomas Area Neighborhood Plan (STANP) adopted by ordinance on December 16, 1993. These two documents are in conflict with each other with regards to the required frontage improvements. According to the Streetscape Standards, full streetscape treatment is required since the addition is more than 25 % new square footage (695SF -+- 1080SF = 64%). To accommodate the streetscape design standards, all existing improvements would have to be removed and replaced with new 10' sidewalks and two street trees in tree wells. This type of improvement across the frontage would be inconsistent with the existing improvements on Winchester. Gloria Sciara 3265 S. The existing right-of-way is 42'. However, staff is reco!llIllending an exception to the STANP be granted to require an additional 3' of dedication to provide 45' from the centerline of Winchester. This half street width would allow for future installation of a 10' sidewalk, should the streetscape standards be desired at a later date. The Public Works Department Conditions of Approval are summarized as follows: 1. Grading and Drainage Plan: Prior to issuance of any building permits for the site, the applicant shall conduct hydrology studies as necessary, prepare grading and drainage plans, and pay fees required to obtain necessary grading permits. The proposed addition and remodel is necessary for several reasons. The existing facility has many very cramped and inefficient spaces. Space is not available for updated or additional required equipment. In several instances, the existing conditions no longer comply with current state requirements for a veterinary facility. The current facility also does not comply with several of the A.D.A. and state handicap compliance requirements. The hours of operation for this facility are: Monday & Tuesday Wednesday through Friday Saturday 8 - 7 8 - 6 8 - 3 There would be one veterinarian an\i possibly up to three staff people on duty at anyone time. The proposed building expansion remodel project is on the westerly side of Winchester Boulevard between Chapman Drive and Parr Avenue. It is in the San Tomas area and subject to the San Tomas Area Neighborhood Plan. The development is also subject to the Streetscape Standards related to Winchester Boulevard. The street improvements and right-of-way dedication are consistent with the predominant improvements. Additional specific comments are listed below. 1. The area storm drain fee has been paid. 2. The property is fully improved with curb, gutter, 7' sidewalk and driveway. The improvements seem consistent with the predominant improvements in the block and Public Works would support retaining the existing improvements. However, unless the Community Development Director approves a deviation from the Streetscape Standards, the development may need to remove and replace the existing 7' sidewalk with a 10' sidewalk. Public Works would also support the retention of the existing large (8"D) tree in the sidewalk area. There does not appear to be sufficient space for an additional tree in the right-of-way. 3. It appears the on-site pavement may not slope to the private inlet. If so, the pavement should be reconstructed so the parking lot drains properly. 4. Prior to issuance of any building permits for the site, the applicant shall prepare plans, pay fees, post securities, and provide insurance as required to obtain an encroachment permit to construct the public street improvements required by the Streetscape Standards, if construction of the Streetscape Standards is to be required by Planning.
