WHEREAS, the above-named Principal proposes to construct a
service station structure upon real property
located at 2505 Winchester Boulevard. Campbell. Californi~
on property described in deed (s) # 2265325
as said deed (s) is (are) filed
for record in the office of the Recorder, County of Santa Clara,
State of California in
WHEREAS, in order for Principal to obtain a buildina permit
to construct said structure from
said City of Campbell ' Principal is
obligated to construct and/or install or have constructed and/or
installed certain street improvements throughout the Winchester
Boulevard and Nido Drive frontage of
said site, in accordance with the standards of said City, said
street improvements including: concrete sidewalks and driveway
approaches ( 3,049 sq. ft.), asphalt street paving
(3,905 sq. ft.), concrete curb and gutter ( 354
line ft.), standard electroliers (Two ea.)~
the total cost of said street improvements having been estimated
by said City to be approximately EIGHT THOUSAND SEVEN HUNDRED
FIFTY DOLLARS ($ 8.750.00 ),
WHEREAS, the parties hereto have agreed that said improvements
shall be installed at such time as the City Council of said CITY
calls for them, provided. however. that they shall be insr~l'pn
and/or constructed in accordance with the agreement therefor
NOW, THEREFORE, if said principal shall well and truly do and
perform its obligations as set forth above, on its part to be done
and performed at the time and in the manner specified therein,
then this obligation shall be null and void: otherwise this bond
shall remain in full force and effect.

accompanying your next plan submittal.
The location of the forty-foot private street between
WinChester BOulevard and Nido Drive appears to remain unresolved
at this time. Development plans suomitted oy the Shopping center's
architect indicate an alignment eight feet (8') southerly of
the Check print submitted by your office. Accordingly. the
street improvement plans will not be ~pproved by the City
Engineer until this matter is resolved to the satisfaction of
all parties involved.

Gentlemen:
Enclosed find one copy of the preliminary check prints
previously submitted to this office with our comments regarding
the proposed Winchester Boulevard frontage improvements.
A portion of the conditions imposed by the Planning Commission
and City Council in connection with this application provides that
the developer shall "...improve private 40 foot street through
shopping center from Nido Drive to Winchester Boulevard. ". Accord-
ingly, plans must be submitted to this office for the improvement
of this private street in conjunction with the Winchester Improvements.
A minimum requirement for this private street would provide
standard radius returns on both Winchester and Nido Drive with
appropriate construction to provide channelization and access
control internally.
Mr. Francis Connelly of 2235 Grant Road, Los Altos has been
retained by Mr. Pursley, owner of the adjoining property, to design
the proposed commercial complex for the expansion of the shopping
center. It would probably be mutually beneficial for you to contact
Mr. Connelly and attempt to coordinate your proposals.

lea). TITLE. Lessee hereby agrees to pay the total cost of the above mentioned
survey and of the title insurance policy on the leasehold notwithstanding
the provisions of Article 1 hereinabove.

4(a). TAXES. Lessee agrees to pay all of the annual real property taxes,
including special assessments, levied on the leased land and improvements
during the period of this lease. Lessor agrees to arrange with the County
Assessor to have Lessee billed directly for such taxes, and, if such bills
are misdirected to Lessor, Lessor agrees to immediately tratrsmit the same
.to Lessee. If interest or penalties are imposed by reason of late payments
caused by Lessor's failure to comply with its duties regarding tax bills
hereunder, Lessor shall pay such impositions. If this lease begins or ends
'during a tax year, Lessee's tax obligation hereunder shall be prorated
accordingly.

Lessee shall erect an::l pay for all improvements, including 'but not- limited to,
any required curbs, gutters, sidewalks, street lights, street improvements,
and sewer charges, including any and all sanitary and storm sewer fees imposed
by the City of Campbell or the County of Santa Clara for connection to said
facilities, and Lessee shall also pay during the initial term of this lease
and any and all extended terms thereof, all costs and charges for the maintenance
and upkeep of the demised premises.
The Lessee shall, at all times during the time of this lease or any extensions ~
hereof, indemnify and save Lessor harmless from and against all claims, demands,/~
or causes of action made upon or instituted against Lessee as and for damages I/~
to property or injuries, including death, to persons ar~sing out of Lessee'~
use of the leased premises, provided that should Lessor be named as a party /
in any suit filed therefor, Lessee shall undertake the Lessor's defense in
such action and shall pay for any and all costs and expenses, including
attorney's fees incurred thereunder.
PURCHASE OPTION. It is expressly understood that this purchase option shall
apply only to the referenced service station site in the event that said
station site is offered for sale by the owners or a bonafide offer to (~,\.,:~_ ~

Lessee shall not construct or install any sign or improvements to obstruct
the present visibility of the now existing Campbell Plaza Theatre sign.
Lessor shall have the right to approve the architectural design. Lessor
shall not unreasonably withhold such approval. It is also understood that
Lessor's approval must be granted prior to closing of escrow.
It is expressly understood that there shall be no barricades between the
station site and the now existing Campbell Plaza Shopping Center. Lessee
shall construct on the south property line of said station site a masonry
wall as approved by Lessor. The referenced masonry wall will be 3 feet in
height and will be extended along this southern property line in an easterly

STRUCTION OF A SERVICE STATION TO BE LOCATED ON PROPERTY KNOWN AS 2505
WINCHESTER BOULEVARD.
1. Property to be fenced and landscaped as indicated and as added
in "red" on plans.
2. Landscape plan indicating location of hose bibs or sprinkJer
system and type of fencing to be submitted for approval of the
Planning Director at time of application for building permit.
3. Faithful Performance Lond in the amount of $2,000 to be posted
to insure landscaping, fencing and striping of p~rking area within
three (3) months of completion of construction, or applicant may
file written agreement to complete landscaping, fencing and
striping of parking area prior to final bui1d.ing department
clearance.
4. An enclosure consisting of a concrete floor surrounded by a SIX
foot high solid. wall or fence shall be constructed to house trash
container in an area approved by the Planning Director and Fire
Department. Plans of area indicated on approved. site plan to be
presented ~o Planning Director for approval.
The applicant is notified as part of this application that he is required
to meet the following conditions in accordance with Ordinances of the City
of Campbell.
5. All parking and driveway areas to be developed in compliance with
Section 9319 of the Campbell Municipal Code.
6. Underground utilities to be provided as required by Section 9110.6
of the Campbell Municipal Code.
7. Plans submitted to the building department for plan check shall
indicate clearly the location of all connections for underground
utilities, including water, sewer, electric, telephone and tele-
vision cables, etc.
8. Sign application to be submitted in accordance with provisions
of the sign ordinance for all signs. No sign to be installed
until application is approved and permit issued by the building
department. Plans for signs submitted are not a part of this
approval.

Boulevard frontage and to improve private 40 foot street through
shopping center from Nido Drive to Winchester Boulevard.

10. Applicant to pay storm drainage fee in the amount of $690.00.

to make left turns into service station site and shall use fourty
(40) foot street to the north for access to service station.
