RESOLUTION NO. 6687
BEING A RESOLUTION ACCEPTING IMPROVEMENTS AT
2605 SOUTH WINCHESTER BOULEVARD
WHEREAS, the City Council has been advised by the City
Engineer that all improvements at 2605 South Winchester
Boulevard have been completed in accordance with that
agreement entered into February 9, 1983, concerning
said development; and
WHEREAS, the City Engineer recommends acceptance of the
improvements.
NOW, THEREFORE, BE IT RESOLVED by the City Council that the
improvements at 2605 South Winchester Boulevard be, and the
same are hereby, accepted, and that the City Engineer is
hereby ordered to record a Notice of Completion of said im-
provements.

AN AGR~EMENT BETWEEN THE CITY OF CAMPBELL
AND WDT, A CALIFORNIA LIMITED PARTNERSHIP
'WHEREAS, there has been submitted to the City Council by WDT,
a Cal ifornia limited partnership, an agreement (identified as
Rin. 196) for the development of their real property known as 2605
S. Winchester Boulevard, in accordance with prescribed conditions;
NOW, THEREFORE, BE IT RESOLVED by the City Council that the
Mayor be, and he 'is hereby, authorized to execute the said agree-
ment on behalf of said City.

A G R E E MEN T
THIS AGREEMENT (identified as No. Rin 196), made and entered
into this 1. day of /~t;I"'~~l..J/ , 19 &:~ ,by and
between WDT, a California limited pirtnership, hereinafter referred
to as "Owners,11 and the CITY OF CAMPBELL, a municipal corporation of
the County of Santa Clara, State of California, hereinafter referred
to as "City.11
WHEREAS, City granted conditional approval of Owners' applica-
tion to construct a research and development building upon that
certain real property known as 2605 S. Winchester Boulevard;
S. Reconstruct existing median islands on Winchester
Boulevard as directed by City Engineer to provide
protected left-turn ingress to proposed development.
As defined on
sketch attached
hereto and made
part hereof
T. Construct raised traffic island on Winchester Boule-
vard at the junction of San Tomas Expressway northbound
off-ramp and Winchester Boulevard, as directed by City
Eng i neer.
WHEREAS, City has initiated proceedings to accompl ish similar
construction in Winchester Boulevard in Project 83-7 that is adjacent
to the work required in Conditions Sand T above;
NOW, THEREFORE, IT IS MUTUALLY AGREED to by and between the
parties hereto as follows:
(1) City shall include the work contemplated in Conditions
Sand T above in its Project 83-7;
(2) Owners shall advance to City the cost to accomplish the
work required by Conditions Sand T above when City has
accepted a bid to perform the work in Project 83-7;
(3) Owners agree to post surety guaranteeing the payment of
said cost in the estimated amount of $22,000.00 (TWENTY-
TWO THOUSAND DOLLARS).

(4) It is understood and agreed to by the parties that the
actual amount to be advanced to City cannot be deter-
mined until bids for Project 83-7 have been received.
Owners agree to advance more, and City agrees to accept
less, than the estimated amount above, depending on the
bid received. Bids shall be solicited on a price per unit basis;
therefore, the obligation of Owners shall be quantity of unit
multiplied by price per unit.
IN WITNESS WHEREOF, the City has caused its name to be affixed
by its Mayor and City Clerk, who are duly authorized by resolution
of the City Council, and said Owners have caused their names to be
affixed the day and year first above written.

This shall confirm our discussion this morning regarding the improve-
ments to be made on Winchester Boulevard. Inasmuch as the work to be
done is quite close to improvements the City has planned next spring,
it is agreeable to all that significant savings can be realized by
having the work performed concurrently. Therefore, when the City plans
are completed in January-February 1983, and competitive bids are sub-
sequently solicited, we shall pay our fair share predicated upon
quantity units.
In the interim, if there is anything that we can do to assist you in
your efforts, please let us know.

BEING AN ORDINANCE OF THE CITY COUNCIL OF THE
CITY OF CAMPBELL ADOPTING PLANS, ELEVATIONS
AND DEVELOPMENT SCHEDULE FOR THE PLANNED
DEVELOPMENT ZONE ESTABLISHED BY ORDINANCE
OF THE CITY OF CAMPBELL (APPLICATION OF
MR RICHARD DEWEY, PD 82-04).
The City Council of the City of Campbell does ordain as follows:
SECTION ONE: That the Zoning Map of the City of Campbell is hereby
changed and amended by adopting the attached Exhibit A entitled Plans
and Elevations, Exhibit B entitled Development Schedule, Exhibit C
entitled Map of Said Property, and Exhibit D entitled Conditions of
Approval, as per the application of Mr. Richard Dewey for approval of
plans, elevations, and development schedule to allow construction of
a 24,075 sq. ft. research and development building on property known as
2605 S. Winchester Blvd. in a Planned Development Zoning District.
Copies of said Exhibits are on file in the Office of the Planning
Department.
The app1icdnt is notified that he shall comply with all applicable
Codes or Ordinances of the City of Campbell which pertain to this
development and are not herein specified.
SECTION TWO: This Ordinance shall be come effective thirty (30)
days following its passage and adoption and shall be published once
within fifteen (15) days upon passage and adoption in the Campbell
Press, a newspaper of general circulation in the City of Campbell,
County of Santa Clara.

A. Property to be fenced and landscaped as indicated and/or added
in red on plans. Landscaping and fencing shall be maintained
in accordance with the approved plans.
B. Landscaping plan indicating type and size of plant material, and
location of irrigation system to be submitted for approval of
the Site and Architectural Review Committee and/or Planning
Commission prior to application for a building permit.
C. Fencing plan indicating location and design details of fencing
to be submitted for approval of the Planning Director prior to
application for building permit.
D. Applicant to either (1) post a faithful performance bond in the
amount of $5,000 to insure landscaping, fencing, and striping
of parking areas within three months of completion of construction;
or (2) file written agreement to complete landscaping, fencing, and
striping of parking areas prior to application for a building permit.
E. All mechanical equipment located on roofs and all utility meters
to be screened as approved by the Planning Director.
F. Building occupancy will not'lbe allowed until ~ub1ic improvements

The applicant is notified as part of this application that he is
required to meet the following conditions in accordance with
Ordinances of the City of Campbell and Laws of the State of
California.
G. All parking and driveway areas to be developed in compliance with
Section 21.50 of the Campbell Municipal Code. All parking spaces
to be provided with appropriate concrete curbs or bumper guards.
H. Underground utilities to be provided as required by Section 21.16.070

I. Plans submitted to the Building Department for plan check shall indicate
clearly the location of all connections for underground utilities in-
cluding water, sewer, electric, telephone and television cables, etc.
J. Sign application to be submitted in accordance with provisions of the
sign ordinance for all signs. No sign to be installed until application
is approved and permit issued by the Building Department. (Section

K. Ordinance No. 782 of the Campbell Municipal Code stipulates that any
contract for the collection and disposal of refuse, garbage, wet gar-
bage and rubbish produced within the limits of the City of Campbell
shall be made with Green Valley Disposal Company. This requirement
applies to all single-family dwellings, multiple apartment units, to
all commercial, business, industrial, manufacturing, and construction
establishments. .

L. Trash container(s) of a size and ljuantity necessary to serve the
development shall be located in area(s) approved by the Fire
Department. Unless otherwise noted, enclosure(s) shall consist
of a concrete f1 oor surrounded by a sOli d wal, or fence and
have self-closing doors of a size specified by the Fire Department.
All enclosur'es to be constructed at grade level.
M. Applicant shall comply with all apropriate State and City requirements

PLANNING DEPARTMENT
V. Applicant to submit a letter, satisfactory to the City Attorney:
1. Building use shall comply with the parking standards of the
Campbell Municipal Code and a use floor plan shall be approved
by the Planning Department.
a) The initial office ratio shall be calculated at one
parking space for every 200 square feet of gross floor
area.
b) Initial storage uses shall be calculated at one parking
space for every 500 square feet of gross floor area.

2. Stating that there will be no outside storage or underground
storage of any kind.
3. Restricting noise levels as measured at the north property line
to those which are acceptable to residential land uses. The
standard would be that which is labeled as "Clearly Acceptable
Exterior Levels" for residential land use as stated in the Noise
Element of the General Plan.
W. Approval of a separate use permit shall be required prior to issuance
of any permit from the Fire Department to allow storage of hazardous
or flammable materials.
X. Normal hours of business operation shall be 7:00 a.m. to 10:00 p.m.
Monday through Friday and 8:00 a.m. to 5:00 p.m. Saturday and Sunday.
Y. Normal hours for deliveries shall be 7:00 a.m. to 6:00 p.m.
Z. Applicant agrees to install 8'0" masonry wall along northerly property
line as soon as feasible in the construction process.
AA. Allowable uses are limited to the following:
1. Administrative, executive, and financial offices.
2. Administrative offices for high technology.
3. Electrical and electronic parts and assemblage of the same.
4. Electrical and electronic parts and warehousing of the same.
5. Electrical and electronic parts, products, production and
appliances and sale of same.
6. Office equipment and supply manufacture and sale.
7. Optical goods manufacture and sale.
8. Pharmaceutical manufacture and sale.
9. Professional, research and engineering offices.
10. Publishing, printing, engraving and lithographing.
11. Warehousing, distributing and sales office.
12. Other uses similar to the above which are compatible with the
eM zone shall be permitted, subject to approval of a use permit.

STANDARD FIRE HAZARD ABATEMENT COMMENT; The applicant is hereby notified
that the property is to ~e maintained free of any combustible trash, debris and
weeds, until the time that actual construction commences. All existing structures
shall be kept secure by having windows boarded up and doors sealed shut, or be
