DISCUSSION: If the Community Development Department determines that Streetscape
Standards shall be implemented, then Conditions 1, 2, 3 and 4 apply. If Streetscape Standards
are not implemented, only Condition No.4 applies.
PUBLIC WORKS DEPARTMENT CONDITIONS OF APPROVAL ARE AS FOLLOWS:
1. Grant of Public Right-of-Way: Prior to issuance of any building permits for the site,
the applicant shall grant additional right-of-way, as needed, along the Winchester
Boulevard frontage to accommodate a 10 foot parkway distance from the curb to the
property line. Applicant shall prepare all documents necessary to record dedication and
submit to the City for review, acceptance, and recording.
2. Standard Street Improvements: Prior to issuance of any building permits for the site,
the applicant shall cause plans for public improvements to be prepared by a registered
civil engineer, pay fees, post securities and provide insurance necessary to obtain an
encroachment permit for construction of the improvements, as required by the City
Engineer. The plans shall include the following:
. Street trees and irrigation system in accordance with Streetscape Standards on
Winchester Boulevard.
3. Title Report: Provide a current Preliminary Title Report.
4. Grading and Drainage: Prior to issuance of any building permits, the applicant shall
refurbish, remodel, and reconstruct the on-site drainage system, as necessary, to
demonstrate that it is functioning normally in accordance with the standards of the City
as determined by the City Engineer.

The property is subject to the requirements of the San Tomas Area Neighborhood Plan.
Winchester Boulevard is classified as a minor arterial and Sunnyoaks Avenue is classified as a
minor collector. Winchester Boulevard, is an Image Street and subject to the Streetscape
Standards and the San Tomas Area Neighborhood Plan. A 10' commercial sidewalk with tree
we~ls is required by Streetscape Standards, while a 12' parkway is required pursuant to the
ST ANP. For the Veterinary Hospital at 3265 Winchester Boulevard we requested additional . . k...t

Description of Current Situation:
The Shell Service Station on the Comer of Winchester Boulevard and Sunny Oaks Avenue in
the city of Campbell, California has been notified of norHX>mpliance wth City cocIes,
Specifically, the cocIes relate to a Hava Java Coffee Cart on the site as well as Cargo Storage
Container.
At the City Planner's request, we met wth a City Planner and the City Attorney, The cocIes were
described to us. Further, we YoOrked on possible solutions to the problem. The followng scope
of YoOrk and justification are the direct result of the that meeting,
Scope of Work:
Carao Storaae Container
In order to comply wth the City's limit of one year for storage containers, the current
container wll be modified to become a more permanent structure on the lot. Further, it
wll be made to match the aesthetic integrity of the permanent building. This wll entail
the addition of a facia around the top of the container to be consistent wth the facia of
the existing service station building. The entire container will be painted to match the
existing building. (See color elevations.)
NOTE: The storage container is made of a -ribbed wall siding" which matches very
closely with the effect of the ribbed wall siding of the permanent building.
In order to further enhance the aesthetics of the location and the area around the storage
container, one planter wll be added. The planter wll run the entire length of the storage
container, (See color elevations)
Hava Java Coffee Cart:
The Hava Java Coffee Cart wll be moved into line wth the storage container. The
coffee cart is an "as is" item from the manufacturer. There are currently no plans to
change the color scheme of by Hava JaVa, Inc. (See color elevations)
In order to further enhance the aesthetics of the location and the area around coffee cart
and the front of the storage container, one planter wll be added. The planter wll run the
entire width of the storage container, thus camouflaging the coffee cart from a direct
view from the street. The planter will also act as a safety banier for the coffee cart and
its employee by separating it from the 'air and water tower used by customers, (See
color elevations)
Justification:
We believe the YoOrk detailed above represents a significant effort to comply with the cocIes of
the City of Campbell. Further, the comer of Winchester Boulevard and Sunny Oaks will become
more aesthetically appealing to the citizens of Campbell and its visitors.
The storage container has been on the site for over 12 years wthout any notice, adverse affects
or problems mentioned by the City. The creation of a more permanent building, repositioning of
the coffee cart, and the addition of planters wll insure the maintenance of this relationship in the
future.
We believe the citizens of Campbell are benefited by such a project. The community is
beautified, as well as additional services being continued. (The cargo container is used solely for
storage of the merchandise for sales in the main building.) The Hava Java cart has been well
received by the community and wll continue to be in the future. Moving it the side of the lot wll
improve traffic flow and aesthetics.
NOTE: As for a possible connict with City codes regarding the sales of merchandise at a service
station; Hava Java is preparing to request the City Council to change the ordinance as business
styles and community demands have changed since its inception
