This letter is written to describe the need for and the design of
the drainage system for the Van Cleef property located at 2931 S.
Winchester Blvd., Campbell, CA.
1. A storm drainage design based on a 10-year storm frequency
was required as Condition of Approval No. 10 of Planning
commission Resolution No. 3011. Detailed Hydraulic
Calculations have been submitted in accordance with
Condition Nos. 11 and 12 of said Resolution No. 3011 by the
undersigned, a Registered civil Engineer.
2. Since there is no storm drain in the street within a
reasonable distance of the site, the city has allowed
drainage through the face of curb. It is to be noted that
the adjacent two properties to the North also drain through
the face of curb.
3. The design of the system requires the use of a pump station
since the invert of the pipe at the pump station is 1.88
feet below the elevation of the gutter grade in the street.
4. If Area Drain No.1, located in the rear (W. side) of the
building becomes plugged, the storm water will pond up and
run into the Santa Clara Valley Water District percolation
pond to the rear of the property without causing any damage,
as the floor elevation is 0.15 feet higher than the pavement
along the Westerly edge.

5. If Area Drain No. 2 located in front of the building (E.
side) becomes plugged, or if the pump malfunctions, the
storm water will pond up and flow over the sidewalk to the
gutter without causing any damage as the floor elevation is
0.45 feet higher than the back of sidewalk at the curb drain
location.
6. The pump company will determine the proper size of pump to
provide the design flow of 9.64 cubic feet per second when
lifting the water 2.1 feet; and will also provide the
complete pumping station design as required to operate the
pump.

maintenance responsibilities of keeping the Area Drains and
storm Drainage lines clean and free of obstructions; and,
also of maintaining the pumping facilities.

District's Construction Unit, c/o Mr. Dean Arroyo, (408) 265-2607, extension 2801, at least 2 normal working days before
starting any work under this permit. Failure to notify is cause for revocation of oermit and removal of work. Exercise of this
permit shall indicate acceptance of and agreement to comply with all provisions included herein. This permit is subject to
the General Provisions listed on the reverse side hereof or as expressly modified in the additional Special Provisions listed
below. Violation of any provision shall be cause for immediate revocation of permit.
SPECIAL PROVISIONS
1. All backfill within District right of way shall be compacted to at least 90 percent relative compaction in accordance with
California Test Method 216 or 231 or ASTM Test Designations 01556,01557, or 02922 except as mpdified herein.
'2. The District's inspector must verify removal of all drainage facilities directed towards the percolation pond and the demolition
of the pool.

BEING A RESOLUTION OF THE PLANNING
COMMISSION OF THE CITY OF CAMPBELL,
APPROVING A CONDITIONAL USE PERMIT TO
ALLOW RETAIL AUTOMOTIVE SALES ON
PROPERTY LOCATED AT 2931 S. WINCHESTER
BOULEV ARD IN A C-2-S (GENERAL COMMERCIAL)
ZONING DISTRICT. APPLICA nON OF WAYNE
RENSHAW, DAVID TAKAMOTO ASSOCIATES.
FILE NO. UP 95-19.
After notification and Public Hearing as specified by law to approve a
Conditional Use Permit, and after presentation by the Community
Development Director, proponents and opponents, the hearing was closed.
After due co~ideration of all evidence presented, the Planning COmmission
did find as follows with respect to File No. UP 95-19:
1. The proposal is consistent with the General Plan and Zoning
designations which indicate a commercial land use for this property.
2. The pt.oposed site improvements of 10% on site landscaping and
streetscape improvements adequately address the aesthetic concerns
related to the project/site with the recommended conditions of approval.
3. Adequate on site parking has been provided for the proposed retail
automotive sales and retail/commercial use.
4. The proposed use is compatible with the surrounding adjacent land uses.
Based upon the foregoing findings of fact, the Planning Commission further
finds and concludes that:
1. The proposed project is consistent with the policies of the General Plan
and zoning, and;
2. The proposed project will aid in the harmonious development of the
immediate area.
3. The establishment, maintenance or operation of the use applied for will
not be detrimental to the health, safety, peace, morals, comfort, or
general welfare of persons residing or working in the neighborhood of
such proposed use, or be detrimental or injurious to property and
improvements in the neighborhood or to the general welfare of the City.

4. The proposed residential use is compatible with uses in the area.
The applicant is hereby notified, as part of this application, that he/she is
required to meet the following conditions in accordance with the Ordinances
of the City of Campbell and the State of California. Additionally, the
applicant is hereby notified that he/she is required to comply with all
applic;able Codes or Ordinances of the City of Campbell and the State of
California that pertain to this development and are not herein specified.
1. Approved Project: Approval is granted for a Use Permit allowing for
retail automotive sales on property located at 2931 Winchester
Boulevard. Project approval shall substantially comply with project
plans prepared by Wayne Renshaw dated October 23, 1995, except as
modified herein in the Conditions of Approval.
2. Street Improvements: Remove and replace broken curb and gutter as
determined by the City Engineer. Also remove and replace cracked
sidewalk squares and remove sidewalk squares for irrigation and tree
planting.
3. Related Street Improvements: Install 2" asphalt concrete overlay to seal
utility trench excavation. See "Utility Coordination Construction in
Public Right of Way."
4. Street Liiht Poli~: Install one street light in accordance with City of
Campbell Street Lighting Policy for arterial streets.
5. Streetscape Improvements: Install street trees, hardscape, and irrigation
improvements in the public right-of-way in accordance with the City 01
Campbell's Streetscape Standards.
6. Landscaping Plans: Applicant shall submit four (4) sets of landscape
plans indicating type and size of plant materials, irrigation system and
planting details to be submitted to the Planning department and
approved by the Community Development Director prior to issuance
of building permits. Landscape plans shall reflect staff
recommendations incorporating the fol~owing:
A. Addition of Evergreen Pear trees on the south property line
reflecting the arrangement on the north property line.

B. Addition of two 24" box sized trees, each to be placed within the
landscaping areas on the street frontage.
7 Screening of Utility Facilities: Screen all above ground utility equipment
within the public right-of-way, on private property or roof mounted to
the satisfaction of the Community Development Director.
8. Street Improvement Plans: Provide Street Improvement Plans for
review and approval by the City engineer for all improvements and
landscaping within the public right-of-way.
9. Grading and Drainage: Provide a preliminary grading and drainage plan
for review. A ~omplete grading and drainage plan may be required for
approval upon review of the preliminary plan.
10. Storm Drain Desi~: Design of improvement plans for storm water
conveyance fac!.lities shall be based on a 10 year storm frequency.
11. Hydrology and Hydraulic Calculations: Provide hydrology and hydraulic
calculations based upon a 10 year storm frequency.
12. Registered Civil Engineer/Land Surveyor: Cause plans, specifications,
calculations, reports and designs for street improvements, grading and
drainage improvements and Record Map to be prepared and sealed by a
Civil engineer, Land Surveyor or Architect, as applicable, lic~nsed in the
State of California and submitted to the City Engineer for approval.
13. Standard Specifications and Details: Comply with the City of Campbell
Standard Specifications and Details for Public Works Construction.
14. Street and Sidewalks: Comply with Title 11 of the Campbell Municipal
Code concerning Streets and Sidewalks.
15. Disability Standards: Comply with the Americans' with Disability Act
and the California Disability Access Regulations, whichever applies.
16. Under~ound Utilities: Install electrical, telephone, and .cable television
facilities underground, in accordance' with the provisions of Chapter
20.36.150 of the Campbell Municipal Code and as required by the City
Engineer, prior to occupancy.

17. Utility Construction Coordination in Public Right-of-Way: Submit a
Utility Coordination Plan and Schedule for approval by the City
Engineer, for installation of electrical, gas, telephone, cable television,
sewer, water and storm drain improvements to minimize damage to
City streets, sidewalks, and related facilities. Relocate existing water
meter to behind back of sidewalk.
18. Sanitary Sewer Service: Provide a sanitary sewerage system to serve all
lots in conformance with the requirements of the West Valley
Sanitation District.
19. Water Service: Provide a water service in conformance with the
requirements of the San Jose Water Company.
20. Other Utility Services: Install electrical and gas service in conformance
with the requirements of Pacific Gas and Electric Company. Ins t a II
telephone facilities in conformance with the requirements of Pacific
Bell. Install cable television facilities in conformance with the
requirements of TCI Cable.
Flood Control: Comply with the Santa Clara Valley Water District's
requirements. The grading and drainage plans shall be submitted to
the Santa Clara Valley Water District for review and approval.
Storm Drain Area Fee: Pay the then current storm drainage area fee
prior to issuance of Building Permit. Current amount is $2,500.00 per
acre.
Securi ty: Provide guarantees to design and construct all public
improvements by cash, bonds, letters of credit, or other legal
instruments acceptable to the City Attorney, prior to issuance of a
building permit.
24. Encroachment Permit: Obtain an Encroachment Permit, pay fees and
deposits, provide bonds and insurance certificates for all construction
within the public right-of-way. Encroachment Permit includes the one
year post-construction, maintenance pe~od requirements;

Dust Control: Implement the requirements of the Bay Area Air Quality
Control Management District including the following mitigation
measures:
A. Water all exposed or disturbed soil surfaces to control dust, as
necessary, but not less than twice daily;
B. Water areas of digging and grading operations;
C Suspend grading or other dust producing activities during periods
of high wind;
D Water or cover stock piles of soil debris, sand and other dust
producing materials;
E. Sweep construction area and surrounding streets daily.
F. Cover trucks with tarp during hauling.
26. Completion Prior to Occupancy: Complete construction of all required
off-site and on-site improvements prior to occupancy of any structure.

27. Building Occupan~: Obtain any necessary building permits to change
with Occupancy to B-2 to B-1 through the City of Campbell's Building
Department. Also include ventilation and occupancy separations for
such use.
28. Vehicle Storage: The storage of all vehicles for the use of sales or
display shall be contained within the building or on the back portion of
the property. , '
29. Use: The use shall be restricted to the resale and refinancing of
automobiles. There shall be no maintenance or restoration of vehicles
on the property. The-additional use for the property which may be
added at a later time shall be restricted to those uses permitted within
the C-2 zoning district.
30. Hours of Operation: Hours of operation shall be limited 6 a.m. To 11
p.m. in accordance with other uses permitted in the C-2 zoning district.

After notification and Public Hearing as specified by law to approve a
Conditional Use Permit, and after presentation by the Community
Development Director, proponents and opponents, the hearing was closed.
After due consideration of all evidence presented, the Planning Commission
did find as follows with respect to File No. UP 95-19:
1. The proposal is consistent with the General Plan and Zoning
designations which indicate a commercial land use for this property.
2. The proposed site improvements of 10% on site landscaping and
streetscape improvements adequately address the aesthetic concerns
related to the project/site with the recommended conditions of approval.
3. Adequate on site parking has been provided for the proposed retail
automotive sales and retail/commercial use.
4. The proposed use is compatible with the surrounding adjacent land uses.
Based upon the foregoing findings of fact, the Planning Commission further
finds and concludes that:
1. The proposed project is consistent with the policies of the General Plan
and zoning, and;
2. The proposed project will aid in the harmonious development of the
immediate area.
3. The establishment, maintenance or operation of the use applied for will
not be detrimental to the health, safety, peace, morals, comfort, or
general welfare of persons residing or working in the neighborhood of
such proposed use, or be detrimental or injurious to property and
improvements in the neighborhood or to the general welfare of the City.

DISCUSSION: The property is within the San Tomas Neighborhood. Winchester Boulevard
is designated as a major arterial. The street is improved for more than 50% of the lined footage
on the west side from Bedal Lane to Sunnyoaks Avenue. Therefore, the street improvements
in front of the subject property should match the predominant which they do, except they are
incomplete and damaged. The existing right-of-way also matches the predominant right-of-way.
Street trees are needed, however, and the sidewalk/curb and gutter are damaged in some areas.
A street light is needed per the City's Street Lighting Policy.
Winchester Boulevard is also designated for a certain streetscape treatment in accordance with
the adopted Streetscape Standards. The attached recommendations, however, are from the
STANP.
The Conditions of Approval are attached.
