WHEREAS, the parties hereto have agreed that said improvements shall be installed at such time as the City Council of said CITY calls for them~rovided that thet shall be installed in accordance W1t the agreement t erefor. NOW, THEREFORll, if said principal shall well and truly do and perform its obligations as set forth above, on its part to be done and performed at the time and in the manner specified therein, then this obligation shall be null and void; otherwise this bond shall remain in full force and effect. 1 of 2 SUBJECT TO THE FOLLOWING CONDITIONS: 1. The electroliers are to be served underground from the nearest available power source. The plans also provide that the two existing power poles on Winchester Boulevard are to be relocated to the back of curb of the improvements. Undoubtedly the developers of this pro- perty will apply for service in the near future and since they will be required to provide underground utilities we want you to be aware of what the public improvements consist of. Beauchamp for variance from requirements 6f Section 9311.60 to allow construction of a coin-operated car wash with 2 gas pumps on property located at 2955 Winchest~r Bculevard. (See Map #6 and applicant's statement attached to UP 68-2) Variances requested are as follows: 1. Variance from Section 9311.60 (10) (c) requiring all washing facilities to be under a permane~t roof and enclosed on two sides, to allow an outside washing stall on the south property line adjacent to Bedal Lane. 2. Variance from Section 9311.60 (10) (d) regulating location of vacuuming facilities as follows: Variance from 15 feet to 0 feet on southerly property line abutting Bedal Lane; from 30 feet to o feet on westerly property line where lot abuts a residential zone and variance from 45 foot setback for vacuuming facilities in front yard on Winchester Bou~evard. 3. Variance from Section 9311.60 (10) (f) to allow car wash operation to be located 64 feet instead of 100 feet from resi- dentially zoned and developed property to the west, and 60 feet instead of 100 feet from residentially zoned property to the south. The property is more than adequate to allow the developer to construct an operation of this type in compliance with the ordinance requirements. The City Engineer has commented that the stacking area for fuel pumps is inadequate and could create a traffic hazard. The applicant states that the operation would not be financially sound without the number of washing stalls proposed ill the plan, and that he could not logically meet the requirements of the ordinance without reducing the number of stalls. Section 9329 of the Campbell Municipal Code reads as follows: SECTION 9329 AUTHORITY OF COMMISSION TO GRANT VARIANCES Where pra~tical difficulties, unnecessary hardships and results inconsistent with the general purposes of this ordinance may result from the strict applicQtion of certain provisions thereof, variance may be granted as provided in this section. This section may not be applied to allow a use that is not in conformity with the uses specified by this ordinance for the district in which the land is located. If approved, Staff recommends the following conditions: 1. Applicant to comply with all conditions of Use Permit 1968-2. 2.
