I understand your concern regarding adjustments to your system for a problem for which you question your responsibility. The fact is that the problem exists regardless of who is at fault, Aside fran being an eyesore and nuisance to our project, it is definitely a liability problem for all concerned. Having 6"+ of water is definitely an attraction for children to play in and with the rapid algae growth the chances of a child slipping and falling is a liability that any of the concerned parties would not want to deal with. Please rerrember, regardless of the location or how it got there, it is ~ water that is on our property. At this tine, I am working with Dave Valkenaar (City of Camp:,ell) on what solution the city wants to use to rectify the problem. We have discussed a tine line of 90 days to have the rerredy in place. I feel this is too long a tine period and would like sarething resolved by mid-october. At this point in tine, I am requesting that you lower the level of your pond to stop the on-site flooding of our office project. It appears that percolated water may move laterally to the low lying parking area from our pond by infiltrating into the City drain system. We expect, with you, that the situation should be corrected since our water should not be wasted in this way. You advise that the City of Campbell is working to find a solution and expects to implement one within ninety days. You request that we lower the level of the pond for up to ninety days so that the parking area will dry out. You also ask that we cooperate with the City and with you in the permanent solution. We are pleased to assist you in this way. The purpose of this letter is to make clear the conditions we will be acting under. Our intention will be to accommodate you by lowering the water in our pond to a level which will permit the parking area to drain but we cannot guarantee and will not be held to have represented that such a level will at all times be maintained. January 22, 1985 The applicant is notified as part of this application that he/she is required to meet the following conditions in accordance with the Ordinances of the City of Campbell and the Laws of the State of California. 1. Revised elevations and/or site plan to be submitted to the Planning Department and approved by the Site and Architectural Review Committee and/or the Planning Commission prior to application for a building permit, addressing revised parking layout, roof design, provision of emergency exits, and better definition of building entrances. 2. No sign to be installed until application is approved and permit issued by Planning and Building Departments (Section 21.68.030 of the Campbell Municipal Code). 14. Ordinance No. 782 of the Campbell Municipal Code stipulates that any contract for the collection and disposal of refuse, garbage, wet garbage and rubbish produced within the limits of the City of Campbell shall be made with Green Valley Disposal Company. This requirement applies to all single-family dwellings, multiple apartment units, to all commercial, business, industrial, manufacturing, and construction establishments. 15. Trash container{s) of a size and quantity necessary to serve the development shall be located in area(s) approved by the Fire Department. Unless otherwise noted, enclosure(s) shall consist of a concrete floor surrounded by a solid wall or fence and have self-closing doors of a size specified by the Fire Department. All enclosures to be constructed at grade level and have a level area adjacent to the trash enclosure area to service these containers. 16. Applicant shall comply with all appropriate State and City requirements for the handicapped. 17. Noise levels for the interior of residential units shall comply with minimum State (Title 25) and local standards as indicated in the Noise Element of the Campbell General Plan. 18. The applicant is hereby notified that the property is to be maintained free of any combustible trash, debris and weeds, until the time that actual construction commences.
