Dear Dan,
As per our telephone conversation today, I am writing you to
formally request your assistance with the water level problem
at the above referenced location.
I understand your concern regarding adjustments to your system
for a problem for which you question your responsibility. The
fact is that the problem exists regardless of who is at fault,
Aside fran being an eyesore and nuisance to our project, it is
definitely a liability problem for all concerned. Having 6"+ of
water is definitely an attraction for children to play in and
with the rapid algae growth the chances of a child slipping and
falling is a liability that any of the concerned parties would
not want to deal with. Please rerrember, regardless of the location
or how it got there, it is ~ water that is on our property.
At this tine, I am working with Dave Valkenaar (City of Camp:,ell)
on what solution the city wants to use to rectify the problem.
We have discussed a tine line of 90 days to have the rerredy in
place. I feel this is too long a tine period and would like
sarething resolved by mid-october.
At this point in tine, I am requesting that you lower the level
of your pond to stop the on-site flooding of our office project.
I am also requesting that you review any of the rerredies that the
City of Campbell is going to present and would appreciate your
assistance in helping this firm and the City to a tinely solution.

Dear Mr. Bommarito:
Water is standing in the newly constructed parking area at your
Campbell property on Bedal Avenue adjoining the District's percolation
pond. It appears that percolated water may move laterally to the
low lying parking area from our pond by infiltrating into the City
drain system. We expect, with you, that the situation should be
corrected since our water should not be wasted in this way.
You advise that the City of Campbell is working to find a solution
and expects to implement one within ninety days. You request that
we lower the level of the pond for up to ninety days so that the
parking area will dry out. You also ask that we cooperate with the
City and with you in the permanent solution. We are pleased to assist
you in this way. The purpose of this letter is to make clear the
conditions we will be acting under.
Our intention will be to accommodate you by lowering the water in
our pond to a level which will permit the parking area to drain but
we cannot guarantee and will not be held to have represented that
such a level will at all times be maintained. Further, we
specifically deny that any ground of legal liability to you or to
anyone is upon the District by reason of the presence of water as
noted.

CONDITIONS OF APPROVAL: S 84-27

The applicant is notified as part of this application that he/she is
required to meet the following conditions in accordance with the
Ordinances of the City of Campbell and the Laws of the State of
California.
1. Revised elevations and/or site plan to be submitted to the Planning
Department and approved by the Site and Architectural Review Committee
and/or the Planning Commission prior to application for a building
permit, addressing revised parking layout, roof design, provision of
emergency exits, and better definition of building entrances.
2. Property to be fenced and landscaped as indicated and/or added in
red on the plans. Landscaping and fencing shall be maintained in
accordance with the approved plans.
3. Landscaping plan indicating type and size of plant material, and
location of irrigation system to be submitted to the Planning
Department and approved by the Site and Architectural Review Committee
and/or Planning Commission prior to issuance of a building permit.
4. Fencing plan indicating location and design details of fencing to be
submitted to the Planning Department and approved by the Planning
Director prior to issuance of a building permit.
5. Applicant to either (1) post a faithful performance bond in the
amount of $7,000.00 to insure landscaping, fencing, and striping of
parking areas within 3 months of completion of constructioni or (2)
file written agreement to complete landscaping, fencing, and striping
of parking areas. Bond or agreement to be filed with the Planning
Department prior to application for a building permit.
6. Applicant to submit a plan to the Planning Department, prior to
installation of PG&E utility (transformer) boxes, indicating the
location of the boxes and screening (if boxes are above ground) for
approval of the Planning Director.
7. Applicant to submit a letter to the Planning Department,
satisfactory to the City Attorney, prior to application for building
permit, limiting the use of the property as follows: 13,500 sq. ft. of
office use.
8. All mechanical equipment on roofs and all utility meters to be
screened as approved by the Planning Director.
9. Building occupancy will not be allowed until public improvements are
installed.
10. All parking and driveway areas to be developed in compliance with
Chapter 21.50 of the Campbell Municipal Code. All parking spaces to be
provided with appropriate concrete curbs or bumper guards.

11. underground utilities to be provided as required by section
20.16.070 of the Campbell Municipal Code.
12. Plans submitted to the Building Department for plan check shall
indicate clearly the location of all connections for underground
utilities including water, sewer, electric, telephone and television
cables, etc.
13. Sign application to be submitted in accordance with prov1s1ons of
the Sign Ordinance for all signs. No sign to be installed until
application is approved and permit issued by Planning and Building
Departments (Section 21.68.030 of the Campbell Municipal Code).
14. Ordinance No. 782 of the Campbell Municipal Code stipulates that
any contract for the collection and disposal of refuse, garbage, wet
garbage and rubbish produced within the limits of the City of Campbell
shall be made with Green Valley Disposal Company. This requirement
applies to all single-family dwellings, multiple apartment units, to
all commercial, business, industrial, manufacturing, and construction
establishments.
15. Trash container{s) of a size and quantity necessary to serve the
development shall be located in area(s) approved by the Fire
Department. Unless otherwise noted, enclosure(s) shall consist of a
concrete floor surrounded by a solid wall or fence and have
self-closing doors of a size specified by the Fire Department. All
enclosures to be constructed at grade level and have a level area
adjacent to the trash enclosure area to service these containers.
16. Applicant shall comply with all appropriate State and City
requirements for the handicapped.
17. Noise levels for the interior of residential units shall comply
with minimum State (Title 25) and local standards as indicated in the
Noise Element of the Campbell General Plan.
18. The applicant is hereby notified that the property is to be
maintained free of any combustible trash, debris and weeds, until the
time that actual construction commences. All existing structures shall
be secured by having windows boarded up and doors sealed shut, or be
demolished or removed from the property. Sect. 11.201 & 11.414, 1979

BEING A RESOLUTION AUTHORIZING EXECUTION OF RELEASE
OF AGREEMENT WITH RALPH AND AVRILLA BEAUCHAMP FOR
THE INSTALLATION OF STREET IMPROVEMENTS AT
2955 SOUTH WINCHESTER BOULEVARD
WHEREAS a certain agreement dated october 13, 1969 and subsequently
recorded in Book 8713 of Santa Clara County Official Records at page 22
et. seq. was entered into by and between Ralph and Avrilla Beauchamp
referred to therein as OWNER and the City of Campbell, a municipal
corporation referred to therein as CITY relative to construction of
certain street improvements across lands described therein; and
WHEREAS the owners, their successors or assigns have fulfilled all the
terms and provisions as contained is said Agreement;
NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of
Campbell does hereby release the owners as above set forth, their heirs,
successors, or assigns from all obligations contained in said Agreement,
and terminates said Agreement.

Dear Mr. Evarkiou:
The proposed development, located at the northewest corner of Winchester
and Bedal Lane, was ,previously developed as a combination car wash and
gas station. Conditions of approval at that time were the installation
of street improvements, payment of the standard fees, and dedication of
additional land for the widenlng of Winchester Boulevard. These condi-
tions were reduced to writing tn an agreement executed by the owners sf
that time ,fta 1 ph and Avr 11 1 a Beauchamp. and recorded tn Book 8713 of
Santa Clara County Official Records at pages 22~26.
All the conditions of approval imposed at the time have been satisfied
and the agreement that was recorded can be considered void throu9h per-
formance of the terms. We have no further claims to make under that
agreement.

We have reviewed the site plan for a proposed office center for Pinn Brothers
Construction Company, File 584-27, sent to us on January 14.
The site is in the San Tomas Aquino Creek watershed and would not be subject
to flooding from a District facility in the event of a one percent flood.
A pond for the Page Percolation System is adjacent to the northwesterly
corner of the site as marked on enclosed Sheet 1 of plan.

(Details of any grading adjacent to our right of way line should include
cross-sectional views, show the location of the existing masonry wall, and
be sent for our review.
In accordance with District Ordinance 75-6, the Owner should show any existing
well(s) on the plans. The well(s) should be properly registered with the
District and either maintained or abandoned in accordance with District
standards. Improperly constructed or abandoned wells can be a hazard and
Illdj be d source of groundwater contaminatlon. We request that wells be
sealed in accordance with District standards unless they are to be used for
the proposed development. In this case, they should only be used after proper
testing and inspection. Please call Mr. Nicholas Lyn at 265-2600, Extension 382,
for information regarding permits and the registering of or abandonment of
any wells. We request written confirmation from the developer or his engineer
