BEING A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF CAMPBELL, COUNTY OF SANTA CLARA, STATE
OF CALIFORNIA, ACCEPTING THE AGREEMENT OF
WILLIAM F. BYRNES, DEVOTA L. BYRNES, WILLIAM
ERRICO AND LORETTA A. ERRICO FOR DEVELOPMENT
OF REAL PROPERTY LOCATED AT THE SOUTHWEST
CORNER OF BEDAL LANE AND WINCHESTER BOULEVARD
AND AUTHORIZING EXECUTION OF AGREEMENT.
WHEREAS, William F. Byrnes, et al have submitted an
Agreement to this City Council for the development of their
real property located at the southwest corner of Bedal Lane
and Winchester Boulevard in accordance with prescribed
condi tions i and,
NOW, THEREFORE, BE IT AND IT IS HEREBY RESOLVED by this City
Council that said Agreement is hereby accepted and that the Mayor
be and he is hereby authorized and directed to execute said
Agreement on behalf of the City of Campbell.

You are requested to have the original and one other copy of this
Agre_ent executed by all the parties concerned in the presence
of a Notary Public and returned to this office.
You will note that the AlJreement prOVides that. you are required
to construct all of the public street. improvements upon Winchesi:er
Boulevard and also upon Badal Lane.
The Ag'reement also provides that in and for the valuable considera-
tion of the sum of Eiqhteen Thousand Dollars, or as may be adjus'ted
in accordance with the proposal (bid) of lowest responsible con-
traetor, the City of Campbell shall provide and construct and/or
install the street improvements upon wtncheater Boulevard only in
accordance with the plans and specifications which the City shall
prepare in aecordance with your proposed development plans.
Ess.ntially, the Eighteen Thousand Dollar- is to defray the costs
of all labor, materials, equipment and incidentals which are appli-
cable to your development only. The plana and specifications which
the City shall prepare will not include the furnishing and instal-
lation and/or construction of water mains, services or appurtenances,
nor the undergrounding of utilities such as television cables,
telephone services, electrical utilities, except for street lighting
and traffic signals, nor gas mains or services, nor sanitary sewer-
age systems or services. It will be necessary for you to contract
with each of the applicable utility companies to provide you with
