In the auditor's annual review of the Finance Department records, a
comment was made that there might be a problem with procedures re-
garding street improvement project receivables, inasmuch as certain
arrounts were determined to be uncollectible and subsequently written
off.
The apparent basis for this comment was an invoice prepared by the
Finance Department and sent to the owner of a parcel of property that
was involved in the widening of Winchester Boulevard that took place
several years ago. This invoice was prepared due to an internal mis-
understanding within the City staff. There was no effective agreement
enforceable at the time of the project that would have required the
property owner to honor the invoice. A previous agreement executed by
this owner many years ago, involving a promissory note, had turned out
to be uncollectible.
This outstanding uncollectible has been written off by the City Finance
Department and sufficient funds were available in the project to cover
the cost of the improvements. A misunderstanding regarding the reasons
for the write-off was the impetus behind the auditor's comments.
Internal procedures have been initiated that will prevent the genera-
tion of invoices without appropriate agreements guaranteeing payment.

The "f'1anagement Letter" fran the City Auditors for the audit of the 1983-84
Fiscal Year Budget was recently received. Included in their report were
CCX'1Til2nts regarding "Street Project Fund Receivable Contracts". Their canrents
\vere the following:
In reviewing street project receivables, we noted that certain amounts
\vcre determined to be uncollectable and thus written off due to a lack of
execution by the citizen. Without an executed agreement, the City could
not enforce the terms of L,e agreement.
hIe recOltT:"end that the City Cled:' s Office maintain a log of all unsigned
docwncnts issued by thel'l1 to the Public ~'brks Department. The City Clerk's
Office could then follrnv up on a periodic basis to insure that the street
\'.'Ork is not perfonred without an executed agreement on file.
This carment would appear to reveal a problem with follow through in insuring
the execution of agreements for certain street improvements. v~ile I suspect
the specific instfu~ces referred to by the audit firm are a small minority of
the number of agreeoents processed by the department, we must assure that we
have a procedure which will verify the execution of such agreements prior to
the undertaking of work. In adcIition, the Finance Departrrent needs to be
notified \vben such agree~nts are executed in order to record such receivables
in the City's financial records.
The City Council Finance Committee recently reviewed the entire ~1anagement
Letter. I notified them that I would be requesting of you a report on this
~tter with recommendations concerning how such oversights could be avoided 1n
the future. I would appreciate your review of this matter and a report on
your conclusions, including recommendations for modified procedures by July 1,
1985.

1. The proposcJ 51 high fence surrounding the property
to be reduced to a height of 3~ feet or moved to a
point 15 feet within the property line.
2. Landscape plan indicating type of plant material,
location of hose bibs or sprinkler system and type
of fencing to be submitted for approval of the
Planning Director at time of application for building
permit.
3. Faithful Performance Bond in the amount of $2,000 to
be posted to insure landscaping, fencing and striping
of parking area within three (3) months of completion
of const.ruction, or applicant may file written agree-
ment to complete landscaping, fencing and striping
of parking area prior to final building department
clearance.
4. Use of the structure shall be continued as a residence
in conjunction with the day nursery care.
S. The number of children shall be limited to a maximum
of 24.
The applicant is notified as part of this application that
he is required to meet the following conditions in accordance
with Ordinances of the City of Campbell.
A. Applicant to comply with all conditions of Use Permit
1969-2.
B. Sign application to be submitted in accordance with
provisions of the sign ordinance for all signs. No
sign to be installed until application is approved and
permit issued by the building department.
The applicant is notified that he shall comply with all
applicable Codes or Ordinances of the City of Campbell
which pertain to this development and are not herein speci-
fied.
Motion seconded by CommissionerLyons and unanimously
adopted.
Mr. Murphy, applicant, stated that condition No. 5 limits
the number of children to 24. He advised Mr. Sheehy, with
the State of California, had recommended a total of 28
children at present and when the property is utilized to
the full extent that 60 children be allowed. He stated
that at the time the use permit was granted the number of
children was brought up and that 60 was approved at that
time.
Mr. Kee stated that at the time of use permit the number
of children was not specified and the basis for limitation

on the arch~ ~..;ctural approval is the sb.,_~ as recommended
and approved on previous applications. Two approvals
in the last few months limited the number of children
to 24 and they were similar to this application in the
lot area and circumstances.

Commissioner Scott stated the number of children allowed
shall be as determined by the State of California.
Commissioner Lyons was of the opinion the City should
not be more stringent than the State.
Commissioner Scott moved that condition No. 5 of "S" 69-31
be amended to state that the number of children shall be
as determined by the State of California for similar and
like properties, seconded by Commissioner Lyons and unani-
mously adopted. .
