STREET IMPROVEMENT AGREElVIENT
THIS AGREEMENT (identified as File No. PLN 2000-44/PLN 2000-73) made and
entered into this e"'* day of ~6()e..;r- , 20 0 I , by and
between JAMES EDWARD AND RUNORE SMITH 1999 REVOCABLE TRUST, hereunder
referred to as "Owner," and the CITY OF CAMPBELL, a municipal corporation of the
County of Santa Clara, State of California, hereinafter referred to as "City."
WHEREAS, on June 13, 2000, the Planning Commission Per Resolution No. 3283
granted conditional approval of PLN 2000-44/PLN 2000-73 for that certain real property
described in Exhibit A attached and incorporated as though fully set forth herein, and
commonly known as 3245 S. Winchester Boulevard, which property is hereinafter referred to
as "said real property";
WHEREAS, compliance with the terms and conditions of this Agreement are conditions
to the approval of the above described Modification to a Conditional Use Permit;
NOW, THEFEFORP, IN CONSIDER-A.TION OF THE
APPROV AL, and satisfaction of the conditions to that approval,

(1) Owner shall provide, construct and/or install at his own proper cost and
expense, street improvements as described in Section 11.24.040 of the City Code within 12
months from the date first mentioned hereinabove; provided, however, that in the computation
of said 12 month period, delays due to, or caused by acts of God, viz., unusually inclement
weather, major strikes, and other delays beyond the control of Owner or his successors shall
be excluded.
(2) It is expressly understood and agreed to that if Owner shall fail to complete the
work required by this Agreement within the said 12 month period, the City, after giving ten
(10) days written notice thereof to Owner, or his successors, may construct and/or install said
improvements and recover the full cost and expense thereof from owner, or his successors.
(3) Owner, or his successors, shall cause to be prepared at his cost and expense
improvement plans for the construction and/or installation of said improvements prior to such
construction or installation. Said plans shall be prepared by a civil engineer registered by the
State of California and submitted to the City Engineer for examination and approval.
All of said improvements shall be constructed and/or installed in accordance with those
plans approved by the City Engineer and shall be made under the supervision and inspection
and to the satisfaction of the City Engineer. Said construction and/or installation shall be in
accordance with the existing ordinances and resolutions of the City of Campbell and to all
plans, specifications, standards, sizes, lines and grades approved by the City Engineer, and all
State and County statutes applicable thereto. Upon completion and acceptance of the
improvements by City, Owner, or his successors, shall provide reproducible as-built plans to
the City Engineer.
(4) The construction work of the improvements embraced by this Agreement shall
be done in accordance with the specifications of-the City of Campbell and West Valley
Sanitation District of Santa Clara County, where indicated.
(5) Prior to approval of the plans by the City Engineer pursuant to Section (3) of
this Agreement, Owner, or his successors, shall pay to the City for examination of
improvement plans, field inspection of construction of improvements and all necessary
expenses incurred by City in connection with said improvements, a sum calculated in
accordance with Resolution No. 9691 as adopted by the City Council on June 6, 2000, or as
may subsequently be adopted by the City Council.
(6) Owner, or his successors, shall file with City, prior to beginning construction,
surety acceptable to the City in amount equal to the City Engineer's estimated cost of the street
improvements to ensure full and faithful performance of the construction of all the
aforementioned improvement work, excluding sanitary sewers and water distribution system.
Said surety shall guarantee that Owner, and his successors, will correct any defects which may
appear in said improvement work within one (1) year from the date of acceptance of the work
by City and pay for any damage to other work resulting from the construction thereof, as well
as pay the cost of all labor and materials involved. This surety shall remain in effect until one
(1) year after date of final acceptance of said improvements by City. Said surety amount may
be reduced by the City Engineer after the date of final acceptance to not less than twenty-five
(25) percent of its full value.
(7) Upon final release of said surety by City, the obligations of Owner, and his
successors, contained in this Agreement shall be considered null and void.
(8) When called upon by City to do so, Owner, or his successors, will execute a
petition for the formation of any special assessment district created pursuant to any special
assessment act as provided in the Streets and Highways Code of the State of California created
for the purpose of constructing and/or installing any or all of said improvements.

(9) Owner, or his successors, shall participate in and become a part of any special
assessment district as described in paragraph (8) of this Agreement.
It is expressly understood that any obligations of Owner, or his successors, contained in
this Agreement that are accomplished to the satisfaction of said City Engineer by said special
assessment district shall be considered null and void.
(10) Owner, or his successors, shall make such deposits or file such bonds and enter
into such agreement as required by West Valley Sanitation District of Santa Clara County to
ensure the installation of a sanitary sewage system to serve said real property, and Owner, or
his successors, shall file with City, upon execution of this Agreement, a letter from said
Sanitation District stating that Owner, or his successors, have made such deposits or filed such
bonds and entered into such agreements.
(11) Owner, or his successors, shall pay to' Pacific Gas and Electric Company any
and all fees required for installation of underground wiring circuit to all electroliers within said
real property when Owner, or his successors, is notified by either the City Engineer or the
Pacific Gas and Electric Company that said fees are due and payable.
Owner's, and his successors', obligations under this section shall not be relieved by
delay or the passage of time, but shall remain binding indefinitely and forever.
(12) Owner, or his successors, shall make such deposits or file such bonds and enter
into such agreement as required by San J ose Water Company when called upon to do so to
ensure the installation of a water distribution system to serve said real property, including fire
hydrant. Owner's, and his successors', obligations under this section shall not be relieved by
delay or the passage of time, but shall bind Owner and successors indefinitely and forever.
(13) Any easement and right of way within or without said real property necessary
for the completion of the improvements shown upon aforesaid improvement plans shall be
acquired byOwner, or his successors, at his own cost and expense. It is provided, however,
that in the event eminent domain proceedings are required for the purpose of securing said
easement and right of way, Owner, or his successors, shall deposit or cause to be deposited
with City a sum covering the reasonable market value of the land proposed to be taken and to
be included in said sum shall be a reasonable allowance for severance damages, if any. It is
further provided that in addition thereto such sums as may be required for legal fees and costs,
engineering and other incidental costs shall be deposited with the City.
(14) Owner, or his successors, shall carry out any and all negOtlatIOns with all
interested parties and shall perform or cause to be performed at his own cost and expense and
to the satisfaction of the City Engineer any and all work required to abandon, remove, raise,
lower, relocate and otherwise modify irrigation line or lines within the boundary of said real
property.

(15) To the fullest extent permitted by law, Owner, and his successors, shall
indemnify, defend and hold the City of Campbell, and its agents, employees, attorneys,
officers, officials and assignees harmless from any and all claims, damages, losses and
expenses, including, but not limited to, attorneys' fees, arising out of, or resulting from any
negligent or intentional act or omission (including misconduct) of said Owner, or his
successors, or any subcontractor, or anyone directly or indirectly employed by him, or anyone
for whose acts any of them may be liable in the course of performance of the Agreement.
The Owner, and his successors, shall also indemnify, defend and hold the City of
Campbell, and its agents, attorneys, employees, officers, officials, and assignees harmless
against and from any and all claims, demands, liabilities, losses, lawsuits, judgments,
damages, costs and expenses (including, but not limited to, attorneys' fees and coun costS,
whether incurred at trial, appellate or administrative levels) which the City of Campbell may
incur or suffer, or to which the City of Campbell may be subjected resulting from the failure of
Owner, or his successors, or his agents, employees; subcontractors, or anyone performing
services under him, to fulfill any of the obligations imposed under this Agreement.
(16) It is acknowledged that the provisions of this Agreement constitute covenants for
the improvement of the subject real property for the mutual benefit of Owner's property,
commonly known as 3245 S. Winchester Boulevard, and the City's property, commonly
described as Winchester Boulevard where it adjoins Owner's property. These covenants shall
be considered to affect rights in the above-described real properties, and shall be binding on
the heirs, assigns, successors, and grantees of Owner to said real property.
(17) Nothing contained herein shall be construed to transfer any unvested interests in
real or personal property for purposes of the rule against perpetuities.
(18) In the event that Owner, or his successors, should breach any of the terms,
conditions, or covenants of this Agreement, the City shall be entitled to recover, in addition to
any other relief available in law or equity, all costs incurred in attempting to obtain
enforcement of the Agreement, or compensation for such breach. These '';Osts shall include
reasonable attorneys' fees and court costs.
(19) This is the entire Agreement between the parties, and there are no
representations, agreements, arrangements or understandings that are not fully expressed
herein.
(20) This Agreement can be executed in counterparts by the parties hereto, and as so
executed shall consist of one agreement, binding on all parties.
(21) Owner shall provide and construct public street improvements per preliminary
plans titled "Street Improvement Plans for 3245 S. Winchester Boulevard, Encroachment
Permit ENC 2000-00180," which are subject to approval by the City Engineer, prepared by
Allied Engineering Company, 3170 Williams Road, San Jose, CA 95117.

one-to-four family residential structure, in which the Insured Owner resides or intends to reside, For the purpose of this
Indorsement the term "residential structure" is defined as the principal dwelling structure located on said land together

3, Notice of Claim To Be Given BV Insured Claimant,
An insured shall notify the Company promptly in writing (i) in case of
any litigation as set forth in 4(a) below, (ii) in case knowledge shall
come to an insured hereunder of any claim of title or interest which is
adverse to the title to the estate or interest or the lien of the insured
mortgage, as insured, and which might cause loss or damage for which
the Company may be liable by virtue of this policy, or (iii) if title to the
estate or interest or the lien of the insured mortgage, as insured, is
rejected as unmarketable, If prompt notiee shall not be given to the
Company, then as to that insured allliability,of the Company shall
terminate with regard to the matter or matters for which prompt notice
is required; provided, however, that failure to notify the Company shall
in no case prejudice the rights of any insured under this policy unless
the Company shall be prejudiced by the failure and then only to the
extent of the prejudice,
4, Defense and Prosecution of Actions; Duty of Insured
Claimant to Cooperate,
(a) Upon written request by an insured and subject to the
options contained in Section 6 of these COFlditions and Stipulations,
the Company, at its own cost and without unreasonable delay, shall
provide for the defense of such insured in litigation in which any third
party asserts a claim adverse to the title or interest as insured, but
only as to tOOse stated causes of action alleging a defect, lien or
encumbrance or other matter insured against by this policy, The
Company shall have the right to select counsel of its choice (subject to
the right of such insured to object for reasonable cause) to represent
the insured as to those stated causes of action and shall not be liable

After notification and public hearing, as specified by law, and after presentation by the
Community Development Director, proponents and opponents, the hearing was closed,
After due consideration of all evidence presented, the Planning Commission did find as follows
with respect to application PLN2000-44 & PLN2000-73:
I. The proposed building design and site layout are consistent with the commercial land use
of the General Plan and the (C-2-S) General Commercial designation for the site. The
proposed use achieves the following objectives:
A. Provides an attractive architectural elevation of the building towards the street frontage.
B. Accommodates driveways and parking circulation to serves the proposed use consistent
with the parking standards of the City.
C. Creates an architecturally pleasing project reflective of the other approved commercial
buildings along this portion of Winchester Blvd.
2. The proposed circulation accommodates the parking and access needs of the proposed use.
3. The proposed project design addresses the site planning issues ofthe building placement
near the street frontage and provides a buffer to the residential use to the rear.
4. The project site plan indicates that 16 percent of the project will be landscaped,
5. The project will not create a nuisance due to noise, litter, vandalism, traffic or other factors.
6. The project will not significantly disturb the peace and enjoyment of the nearby residential
neighborhood.

Based on the foregoing findings of fact, the Planning Commission further finds and concludes
that:
1. The proposed project will aid in the enhancement and the harmonious development of the
immediate area. The establishment, maintenance, or operation of the uses will be
detrimental to the public health, safety, peace, morals, comfort or general welfare of
persons residing or working in the neighborhood of such proposed use,
2. The proposed site layout provides a desirable site layout for a commercial use along this
portion of Winchester Blvd.
3. The project is adequately served by streets of sufficient capacity to carry the kind and
quantity of traffic such uses would generate.
The applicant is hereby notified, as part of this application, that he/she is required to meet the
following conditions in accordance with the ordinance of the City of Campbell and the State of
California. The lead department with which the applicant will work is identified on each
condition where necessary, Additionally, the applicant is hereby notified that he/she is required
to comply with all applicable Codes or Ordinances of the City of Campbell and the State of

1. Project Approval - Approval is granted for a Modification to a previous use permit (PLN
2000-44) allowing development of a retail use on property located at 3245 S. Winchester
Blvd. consisting of the following:
. A 2200 square feet retail building and related parking and landscape areas. Project
approval shall substantially comply with project plans prepared by Bruce Johnson,
Architect, dated 5/15/00 and 3/6/00, except as modified by the Conditions of Approval

2. Detailed Building Elevations
A. Revised Elevation - The applicant shall continue to work with staff on resolving the
exterior treatment providing further detail of architectural details enhancements such as
trim an/or cornice details. Details to be approved by the Community Development
Director upon recommendation of the Architectural Advisor,
B. Materials and Colors: The applicant shall work with staff upon the recommendation of
the Architectural Advisor to select specific building colors and materials for the new
buildings, The conceptual palette is considered acceptable, The colors shall be referred
to the Community Development Director for review and approval prior to issuance of

4. Parking and Driveways - All parking and driveway areas shall be developed in compliance
with the approved plans and Chapter 21.50 (Parking and Loading) of the Campbell
Municipal Code, subject to review by the Community Development Director.
5. On-site Lighting: The applicant shall submit plans and illustrated brochures indicating the
location and design of architectural features such as light fixtures and parking lot lighting
for approval by the Community Development Director, All lighting shall be shield away
from adjacent residential uses and a lighting plan shall be approved prior to the issuance of
any building permits. Lighting shall be directed to prevent glare on adjacent properties or
on the public right-of-way,
6. Landscape PlanlBuffer Wall Plan: The applicant shall submit four (4) sets of the
landscape/irrigation and buffer wall plan indicating the decorative screen wall design
between the parking area and the adjacent residential use to the west to the Community
Development Director for review and approval prior to the issuance of building permits.
Final plan landscape and irrigation plan to be prepared consistent with the WELSstandards
and the Tree Preservation Ordinance, The plan shall include the following:
A. Installation of a 6 to 8 foot screen wall along the westerly property line,
B. Provision of irrigation and planting details for all planting areas.
C. Introduce minimum 24-inch box trees and 5-gallon shrubs as a part of the landscaping
concept and provide a row of redwood trees for screening along the easterly property
line at a minimum of 12 feet on center,

7. Signage Program - No signage is approved as part of the development applications
approved herein. The applicant shall submit a sign program indicating all signs for the site.
No sign shall be installed until such application is approved and a permit issued by the
Community Development Director as specified in Chapter 21.53. of the Zoning Ordinance
(Sign Ordinance),
8. Construction Mitigation Measures: The applicant shall implement measures as specified in
the Initial Study including the following:
A. Construction activities will be limited to daytime hours of 8:00 am to 5:00 p.m.
weekdays and 9:00 a.m, to 4:00 p,m, Saturdays, Construction is prohibited on Sundays
and Holidays unless an exception is granted by the Building Official.

conversion of the existing residence and a commercial addition on the reference property.

The conversion of a residential use to a commercial use raises a number of issues that have
not been addressed in your submittal.
The proposed addition provides a positive element to the proposed conversion, This
addition provides a commercial appearance to the project and provides a building form
closer to the street.
Concerned that are raised regarding the latest proposal are as follows:
I, Large vehicle access, Your previous application at this site for a cleaning supply
business proposed an open parking area along the street frontage to accommodate the larger
vehicles you anticipated with your supply business. An easily accessible driveway has not
been provided with this site plan. If a similar use is proposed, it would be desirable to
accommodate the loading and unloading needs of the proposed commercial use.
2. The commercial appearance of the structure should be carried to all four elevations of
the structure.
3. The arched disabled access area appears awkward,
4, The storefront system at the building is not reflected on the site plan.
5. The previous conversions of residential structures into commercial operations have
required significant modifications to the buildings to address functional as well as the

property line to buffer the adjacent residential use.
Generally, the conversion of a residential building into retail use presents a number of
design problems, The City in reviewing such request wishes to maintain the high quality of
commercial buildings on its image streets. The visibility of the building entrance, the
storefront appeal of the building, and the loading and unloading needs are all essential
components of a commercial building's design that need to be accommodated, The current
proposal provides a more positive design solution than merely converting the existing
residence,

Utilities: All new on-site Utilities shall be installed underground per Section 20.36,150 of
the Campbell Municipal Code for any new or remodeled buildings or additions. Applicant
shall comply with all plan submittals, permitting, and fee requirements of the serving

Received a call from Rich Smith in response to my letter inviting him in. . . since his
application has now been approved by the Planning Commission. He inquired about not
having to construct a 10 foot sidewalk and leaving the existing sidewalk in place. He
said he doesn't think it's necessary to come in again since they went through the process
12 years ago when they built the adjacent building to the south, He said his architect,
Johnson, is very familiar with the process and Allied is very familiar with the surveying.
HE said he's not planning to come in and will leave it up to his architect.

BEING A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF
CAMPBELL GRANTING A SITE AND ARCHITECTURAL APPROV AL TO
ALLOW A NEW 3,330 SQUARE FOOT COMMERCIAL BUILDING ON
PROPERTY LOCATED AT 3245 S. WINCHESTER BOULEVARD IN A C-2-S
(GENERAL COMMERCIAL) ZONING DISTRICT, APPLICATION OF MR. JAMES
SMITH, FILE NO, S 99-04.
After notification and public hearing, as specified by law, and after presentation by the Community
Development Director, proponents and opponents, the hearing was closed.
After due consideration of all evidence presented, the Planning Commission did find as follows with
respect to application S 99-04:
1. An initial study was prepared for this project, which concludes there are no significant
environmental i.mpacts, and a Negative Declaration has been prepared for this project.
2. The proposed building design and site layout are consistent with the commercial land use of the
General Plan and the (C-2-S) General Commercial designation for the site, The proposed
achieve the following objectives:
a) Provides an attractive architectural elevation of the building towards the street frontage
b) Accommodates driveways and parking circulation to serves the proposed use consistent with
the parking standards of the City.
c)Creates an architecturally pleasing project reflective of the other approved commercial
buildings along this portion of Winchester Blvd.
3, The proposed circulation accommodates the parking and access needs of the applicant.
4. The proposed project design addresses the site planning issues of the building placement at the
rear of the property buffering the residential use to the rear and integrates the use with the
surrounding neighborhood and uses.
5. The project site plan indicates that 23 percent of the project will be landscaped.
6. The project will not create a nuisance due to noise, litter, vandalism, traffic or other factors.
7. The project will not significantly disturb the peace and enjoyment of nearby residential
neighborhood.
Based upon the foregoing findings of fact, the Planning Commission further finds and concludes that:
1. The proposed project will aid in the enhancement and the harmonious development of the
immediate area. The establishment, maintenance, or operation of the uses will be detrimental to
the public health, safety, peace, morals, comfort or general welfare of persons residing or
working in the neighborhood of such proposed use,

I. Project Approval - Approval is granted for a Site and Architectural Review Permit (S 98-07)

2. Detailed Building Elevations
A. Revised Elevation - The applicant shall continue to work with staff on resolving the
exterior treatment providing further detail of architectural details enhancements, Details
shall include elimination of the covered arcade, expansion of the canvas awnings, provision
of split face block or stucco finish on the north and west elevation and refinement of the
window sizes, Details to be approved by the Community Development Director upon
recommendation of the Architectural Advisor,
B, Materials and Colors: The applicant shall work with staff upon the recommendation of the
Architectural Advisor to select specific building colors and materials for the new buildings.
The conceptual palette is considered acceptable. The colors shall be referred to the
Community Development Director for review and approval prior to issuance of building
permits,
3, Architectural Details- The applicant shall submit plans and illustrated brochures indicating the
location and design of architectural features such as light fixtures and parking lot lighting for
approval by the Community Development Director.
4, Parking and Driveways - All parking and driveway areas shall be developed in compliance with
the approved plans and Chapter 21.50 (Parking and Loading) of the Campbell Municipal Code,
subject to review by the Community Development Director,

5. On-site Lighting: Details of project lighting shall be approved by the Planning Department prior
to the issuance of building permits, Lighting shall be directed to prevent glare on adjacent
properties or on the public right-of-way,
6. Landscape/Screen Wall Plan: The applicant shall submit four (4) sets of the landscape/irrigation
and screen wall plan indicating the decorative screen wall design between the parking area and
the street frontage to the Community Development Director for review and approval prior to the
issuance of building permits. Final plan to be prepared consistent with the WELS standards and
the Tree Preservation Ordinance. The plan shall include the following:
A) Installation of a 3 to 3.5 foot screen wall to soften the appearance of the parking area,
B) Provision of irrigation and planting details for all planting areas,
C) Introduce a minimum 24-inch box trees and 5 gallon shrubs as a part of the landscaping
concept.
7. Signage Program - No signage is approved as part of the development applications approved
herein, The applicant shall submit a sign program indicating all signs for the site, No sign shall
be installed until such application is approved and a permit issued by the Community
Development Director as specified in Chapter 21.53, of the Zoning Ordinance (Sign
Ordinance),
8. Construction Mitigation Measures: The applicant shall implement measures as specified in the
Initial Study including the following:
1. Construction activities will be limited to daytime hours of 8:00 am to 5:00 p,m. weekdays
and 9:00 a.m, to 4:00 p,m. Saturdays. Construction is prohibited on Sundays and Holidays
unless an exception is granted by the Building Official.
2. No pile driving is allowed for construction of the project.
3. All internal combustion engines for construction equipment used on the site will be properly
muffled and maintained.
4. All stationary noise generating construction equipment, such as air compressors and
portable power generator, will be located as far as practical from the existing residences and
businesses.
5. All active construction areas shall be watered at least twice daily,
6. Cover all trucks hauling soil and other loose materials stationed or prior to leaving the site,
7, Pave, apply water, or apply non-toxic soil stabilizers on all unpaved surfaces, and staging
areas at the construction site,
8. Sweep daily all paved access roads, parking areas, staging areas, and adjacent public streets
as directed by the City Engineer.
9, Enclose, cover, water or apply soil binders to exposed stockpiles,
10. Install sandbags or other erosion control measures to prevent runoff to all roadways,
waterways or pubic walkways accessed by the public,

9. Archaeological Monitoring Program: Provide an archaeological monitoring program prepared
by a qualified archaeologist to monitor all subsurface excavation and construction for review
and approval by the Community Development Director prior to the issuance of building
permits.

10. Preliminary Title Report: Prior to issuance of any grading, drainage or building permits for the
site, the applicant shall provide a current Preliminary Title Report,
11. Right-of-Way for Public Street Purposes: Prior to issuance of any grading or building permits
for the site, the applicant shall grant additional Right-of-Way (3 feet) for Public Street Purposes
along the Winc~ester Boulevard frontage to accommodate 45 feet from the existing center line,
The applicant shall cause all documents to be prepared as necessary to submit to the City for
review and record the dedication.
12. Street Improvements: Prior to issuance of any grading or building permits for the site, the
applicant shall execute a street improvement agreement and shall cause plans for public Street
Improvements to be prepared by a registered civil engineer, pay fees, post security and provide
insurance necessary to obtain an encroachment permit for construction of the public
improvements, as required by the City Engineer. The plans shall include the following:
. Removal of existing curb, gutter, sidewalk and two driveway approaches.
. Construction of new curb, gutter, lO-foot sidewalk, one ADA compliant driveway approach,
street trees, tree wells and irrigation system at 40 feet on center.
13, Water Meter(s) and Sewer Cleanout(s): Existing and proposed Water Meter(s) and Sewer
Cleanout(s) shall be installed on private property behind the public right-of-way line,

self-closing doors of a size specified by the Fire Department. All enclosures to be constructed
at grade level and have a level area adjacent to the trash enclosure area to service these
containers and to be architecturally compatible with the building walls.
22. Mechanical Equipment - All roof-mounted and ground level mechanical equipment on new or
remodeled structures on site, which are visible from the public right of way, shall be screened
with similar building materials subject to the approval of the Community Development
Director.
23, Disabled Accessibilitv - All new and remodeled buildings shall provide disabled access in
accordance with the Uniform Building Code (UBC), and the Uniform Federal Accessibility
Standards (UFAS) and the Federal Americans with Disabilities Act (ADA),

FIRE DEPARTMENT REQUIREMENTS
24. Developmental Review: Review of this proposal is limited to site access and water supply as they
pertain to fire department operations and shall not be construed as a substitute for formal plan
review to determine compliance with adopted model codes or building standards. Prior to
performing any work, the applicant shall apply to the Building Department for appropriate
construction permits,
25. Required Fire Flow: Required fire flow for this project is 2,500 GPM at 20 psi residual pressure,
The required fire flow is available from area water mains and fire hydrant(s)which are spaced at
the required spacing.
26. Automatic Fire Sprinkler System Required: Buildings requiring a fire flow in excess of 2,000
GPM, or in excess of two stories in height or, 35 Feet in height shall be equipped throughout with
an approved fire sprinkler system, The fire sprinkler system shall be hydraulically designed per
National Fire Protection Association(NFPA) Standard # 13, 1994 edition,
27. Fire Department Key Box Required: Provide an approved fire department key box and appropriate
building keys, Installations shall conform with Fire Department Standard Detail and Specification

BUILDING DIVISION REQUIREMENTS
28. Building Submittal: All building permit submittals shall require that the conditions of approval
shall be printed on the first page of all sets of plans.
29. Permits Required: A building permit application shall be required for the proposed structure, The
building permit shall include Electrical/PlumbinglMechanical fees when such work is part of the
permit.
30. Construction Plans: The Conditions of Approval shall be stated in full on the cover sheet of
construction plans submitted for building permits.
31. Size of Plans: The maximum size of construction plans submitted for bulding permits shall be 24"
x 36", The minimum size is 18" x 24",
32. Soils Report: Two copies of a current soils report, prepared to the satisfaction of the Building
Official, containing foundation and retaining wall design recommendations shall be submitted with
the building permit application, A licensed civil engineer specializing in soils mechanics shall
prepare this report,
33. Foundation Inspections: A pad certificate prepared by a licensed civil engineer or land surveyor
shall be submitted to the project building inspector upon foundation inspection. This certificate
shall certify compliance with the recommendations as specified in the soils report and the building
pad elevation and on-site retaining wall locations and elevations are prepared according to

Review of this Developmental proposal is limited to acceptability of site access
and water supply as they pertain to fire department operations, and shall not be
construed as a substitute for formal plan review to determine compliance with
adopted model codes, Prior to performing any work the applicant shall apply to

Required Fire Flow: Required fire flow for this project is 1,750 GPM at 20 psi
residual pressure, The required fire flow is available from area water mains and
fire hydrant(s) which are spaced at the required spacing.

After notification and public hearing, as specified by law, and after presentation by the
Community Development Director, proponents and opponents, the hearing was closed.
After due consideration of all evidence presented, the Planning Commission did find as follows

1. Approved Proiect: Approval is granted for a Modification allowing an expansion of a
veterinary hospital facility on property located at 3265 S. Winchester Boulevard. Project

dated 1/8/97 except as modified herein in the C~nditions of Approval.,
2. Approved Use: The approved use of the property is for veterinary care services for small
animals. The use and building shall comply at all times with Section 21.22.040 (Q) of the
C-2-S zoning ordinance as specified below:
A. A maximum of 3-5 animals may be kept overnight on the premises for treatment
purposes only.
B. The entire clinic shall be maintained within the enclosed building.
C. The building shall be soundproofed. Sound levels shall not exceed 65 decibels audible
to the exterior of the building. Air conditioning shall be provided to prevent the
necessity of opening windows and doors for ventilation purposes.
D. The facility shall not be closer than 50 feet from the nearest residential property.
E. The facility shall be maintained free of objectionable odors and be operated In
compliance with health standards for such clinics.
F. Hours of operation are approved by the Planning Commission and specified below.
Emergency calls after hours shall not be prohibited.
G. The facility shall comply with all statet county, and city ordinances which pertain the
use or zone where the facility is located.

Modification (M 97-01) for this project is valid for a period of eighteen months from the
Planning Commission approval and will expire on September 24, 1999. All conditions of
approval specified herein must be completed within eighteen months from the date of
approval or the approval shall be void.
6. Landscaping: Applicant shall submit four (4) sets of a revised landscaping plan which
includes one (1) 48" box tree within the front on-site landscape bed. Planting details and
the irrigation system shall be submitted to the Community Development Department for
review and approval prior to the issuance of b':lilding permits. Landscape plans shall be
prepared in conformance with the City's Water Efficient Landscape Guidelines (WELS).
7. Signage: Signage is not approved as part of this application. Any exterior building
signage shall require a sign permit and approval as required by Chapter 21.53 (Signs) of the
Campbell Municipal Code.
8. Grading and Draina~e Plan: Prior to issuance of any building permits for the site, the
applicant shall conduct hydrology studies as necessary, prepare grading and drainage plans,
and pay fees required to obtain necessary grading permits.
The plans shall provide for on-site retention of runoff from a 100 year storm frequency
minimum, or positive surface runoff to Winchester Boulevard, or other drainage concept
subject to review by the Building Official and City Engineer. Plans must comply with the
1994 Edition of the UBC.
9. Standard Street Improvements: Prior to issuance of any building permits for the site, the
applicant shall prepare plans, pay fees, post securities, and provide insurance as required to
obtain an encroachment permit to construct improvements in the public right-of-way,
Plans shall be prepared by a registered Civil Engineer licensed in the State of California,
and shall include improvements such as under sidewalk drains and other improvements to
be constructed in the public right-of-\yay as shown on the approved grading and drainage
plans.
10. Completion of Public Street Improvements: Prior to issuance of occupancy for the site, all
improvements within the public right-of-way as required by the encroachment permit must
be completed and accepted by the City Engineer and the applicant must provide the one-
year maintenance security.

It. Dedication to City: Prior to issuance of any building permits for the site, the applicant shall
dedicate an additional 3' of property frontage to provide 45' of public right-of-way from
