BEING A RESOLUTION AUTHORIZING EXECUTION OF RELEASE
OF AGREEMENT WITH WILHELM MEYER, MAGDELENA MEYER,
REINHARD MEIR, AND MARLEN MEIR FOR THE INSTALLATION
OF STREET IMPROVEMENTS AT 3375-85 SOUTH WINCHESTER
BOULEVARD
WHEREAS, a certain agreement recorded in Book G039 of Santa Clara
County Official Records at page 210 was entered into by and between
Wilhelm Meyer, et aI, referred to therein as OWNER, and the City of
Campbell, a municipal corporation, referred to therein as CITY,
relative to construction of certain street improvements across lands
described therein; and
WHEREAS, the owners, their successors or assigns have fulfilled all
the terms and provisions as contained in said agreement;
NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of
Campbell does hereby release the owners as above set forth, their
heirs, successors, or assigns from all obligations contained in said
agreement, and terminates said agreement.

8. STREET IMPROVEMENT AGREEMENT--3375 SOUTH WINCHESTER BOULEVARD--MR. WiLHELM MEYER
RECOMMENDATION: That the Council adopt a resolution authorizing a revised
agreement for street improvements.
DISCUSSION: As a condition of U.P. 79-25, an application for an auto service
center on the northwest corner of Winchester Boulevard and West Parr Avenue,
the appl icants were requi red to enter into an agreement for street improvements
construction. A copy of that agreement, approved by the Council on April 13,
1981, is attached.
Mr. Meyer has now requested that the payment schedule to the City for the street
work be extended for one additional year by deferring .the principal portions of
the payback schedule for that period. The interest payments of ten percent per
annum would be kept current in accordance with the existing schedule.
Mr. Meyer cites temporary financial hardship as the reason for the requested
payback extension, and indicates that he would be present at the Council
meeting of April 20 to answer any questions in this regard. Mr. Meyer agrees
that he will be willing to maintain a surety bond, in effect for the life of
the revised agreement, to insure compliance.

MAGDALENA MEYER, REINHARD MEIER, AND MARLEN MEIER, hereinafter re-
ferred to as "Owner," and the Ci ty of Campbell, a muncipal corporation
of the State of California, hereinafter referred to as "City";
WITNESSETH:
WHEREAS, Owner has heretofore entered into an agreement dated
Ma;-ch 13,1981, with the City fOl' the construction of street improve-
ments on the frontages of that certain parcel of land described as
Parcell, on that certain parcel map filed in Book 464 of Maps, at
pages 38 and 39, on June 11, 1980, in the office of the County Re-
corder, County of Santa Clara, State of Cal ifornia; and
WHEREAS, Owner desires to amend that agreement to provide for a
one - yea rex ten s ion 0 f the s c h e d u 1 e 0 f pay me n t for the rei m bur s e me n t
to City of the monies expended for said street improvements in ac-
cordance with the terms of said agreement;
rww, THEREFORE, IT IS HEREBY t.1UTUALLY AGREED by and bet\oJeen the
parties hereto as fol lows, to-wit:
1. Owner agrees to pay to City the sum of FOUR THOUSAND
FIVE HUNDRED DOLLARS ($4,500.00) at the time of
execution of this agreement.
2. Owner agrees to pay to City the sume of NINETEEN
THOUSAND FIVE HUNDRED DOLLARS ($19,500.00) on or
before April 1, 1983; EIGHTEEN THOUSAND DOLLARS
($18,000.00) on or before April 1,1984; and
SIXTEEN THOUSAND FIVE HUNDRED DOLLARS ($16,500.00)
on or before Apri 1 1, 1985.
3. Owner agrees to maintain a faithful performance bond
in the amount of FORTY FIVE THOUSAND DOLLARS ($45,000.00)
in full force and effect unti 1 Apri 1 1, 1985, to insure
comp1 iance with the t~rms of this Agreement.

Subject: Curb grades for the northwest corner of
Winchester Boulevard and West Parr Avenue.
Gentlemen:
Please use the following information to establish subject grades:
1. Elevation reference TC253.28 at the BCR on the southside of
West Parr at Winchester.
2. The curb grades on the northside of West Parr should essentially
match the existing curb grades on West Parr.
3. The top of curb elevation at the return on the west side of
Winchester north of West Parr should be set at 251.86.
4. The slope of the curb on Winchester should go down at 1.08%
to the north.
5. The existing drainage inlet should be relocated to the Winchester
side of the curb return if grades will allow.
6. The storm drain in West Parr should be extended to the westerly
property line and plugged. The 18" RCP should slope to the west
at 0.42%.
Drywell should be installed at the end of the pipe.

and approval of plans to construct an auto service center on property
known as 3375 & 3385 S. Winchester Boulevard in an Interim (Commercial)
Zoning District, as per application filed in the Office of the Planning
Department on September 6, 1979, and after presentation by the Planning
Director, proponents, and opponents, the hearing was closed (UP 79-25).
After due consideration of all evidence presented, the Commission
did find as follows:
That the establishment, maintenance, and operation of the
proposed use will not be detrimental to the health, safety,
peace, morals, comfort, or general welfare of persons residing
or working in the neighborhood of such use, or be detrimental
or injurious to the property and improvements in the neigh-
borhood or the general welfare of the City.
Based on the above findings, the Planning Commission does hereby grant
the requested use permit, subject to the following conditions:
1. Revised elevations to be approved by the Planning Director
upon recommendations of the Architectural Advisor.
2. Property to be fenced and landscaped as indicated and/or
added in red on plans.
3. Landscaping plan indicating type and size of plant
material, and location of hose bibs or sprinkler system
to be submitted for approval of the Planning Director and the Site
and Architectural Review Committee prior to application for building permit.
4. Fencing plan indicating location and design details of
fencing to be submitted for approval of Planning Director
prior to application for building permit.
5. Landscaping and fencing shall be maintained in accordance with
the approved plan.
6. Applicant to either (1) post a faithful performance bond in
the amount of $3,000 to insure landscaping, fencing, and
striping of parking areas within three months of completion
of construction, or (2) file written agreement to complete
landscaping, fencing and striping of parking areas prior to
final Building Department clearance.
7. All mechanical equipment located on roofs to be screened as
approved by the Planning Director.
8. Building occupancy will not be allowed until public improve-
ments are installed.

The applicant is notified as part of this application that he/she is
required to meet the following conditions in accordance with Ordinances
of the City of Campbell and Laws of the State of California.
A. All parking and driveway areas to be developed in compliance with
Section 21.50 of the Campbell Municipal Code. All parking spaces
to be provided with appropriate concrete curbs or bumper guards.
B. Underground utilities to be provided as required by Section
20.16.070 of the Campbell Municipal Code.
C. Plans submitted to the Building Department for plan check shall
indicate clearly the location of all connection for underground
utilities including water, sewer, electric, telephone and tele-
vision cables, etc.
D. Sign application to be submitted in accordance with provisions
of the sign ordinance for all signs. No sign to be installed
until application is approved and permit issued by the Building
Department. (Section 21.68.070 of the Campbell Municipal Code.)
E. Ordinance No. 782 of the Campbell Municipal Code stipulates that
any contract for the collection and disposal of refuse, garbage,
wet garbage and rubbish produced within the limits of the City
of Campbell shall be made with Green Valley Disposal Company.
This requirement applies to all single-family dwellings, multiple
apartment units, to all commercial, business, industrial, manu-
facturing, and construction establishments.
F. Trash container(s) of a size and quantity necessary to serve the
development shall be located in area(s) approved by the Fire
Department. Unless otherwise noted, enclosure(s) shall consist
of a concrete floor surrounded by a solid wall or fence and have
self-closing doors of a size specified by the Fire Department.
All enclosures to be constructed at grade level.
G. Applicant shall comply with all appropriate State and City require-
ments for the handicapped.
