Commissioner Vierhus reported that the applicant had met with the Site and Architectural Review Committee this morning, and the committee felt that this development would be on of the major developments in Campbell. Mr. Kee stated that he felt the concerns of the staff and the Architectural Advisor had been worked out with the latest set of plans. There was brief discussion concerning the applicant obtaining as easement on the westerly side of the property, the design of the mansard roof, and the landscaping. -9- Mr. Kee indicated that all red lines on the plans had been agreed upon by the applicant. Chairman Samuelson invited anyone in the audience to speak for or against this item. No one wishing to be heard, it was moved by Commissioner Vierhus, seconded by Commissioner Pack, and adopted unanimously that the public hearing be closed. Bascom Avenue in a C-2-S (General Com~ercia~l) Z~n.~ng That the Planning Commission adopt a resol~tibn stating that the subject property is located wholely with the C-.2-~.~on['O§:)[stri,¢t'}i Approval of plans subject to the attached STAFF DISCUSSION Part 1 - District Boundary On November 21, 1978, the City approved a parcel map which subdivided a 4.63 acre parcel into two lots: the subject lot (parcel 1) which contains 1.35 acres, and a parcel in the rear (parcel 2) which contains 3.28 acres. The Zoning Map indicates that the easterly 310 feet of the 360 foot long parcel is located in a C-2-S District, and that the westerly 50 feet and parcel 2 are located in the P-D Zoning District. Section 21.74.040 of the Zoning Code allows the Commission to adjust the district boundaries so that a parcel is located completely in only one zoning district. A copy of that section of the code is attached for the Commission's review. Part 2 - Development Plan This item has been continued several times since the meeting of January 16, 1979, in order that the applicant could submit revised plans. The original submittal (Plan 1) indicated that the applicant was proposing to construct a 16~750 square foot buildin~ on a 58,800 square foot site. The applicant was providing 91 parking spaces which resulted in a parking ratio of 1 space for every 184 square feet of gross building area. Staff recommended that these plans be revised because (1) the landscaping did not comply with the provisions of the Zoning Code, and (2) the mansard roof line was not carried all the way around the building. Plan 2 indicated that the building would be increased in size to 17,1OO square feet and the parking was reduced by 6 spaces. The new proposed parking ratio was 1 space for every 201 square feet of gross building area. The westerly half of t~'~ building was moved 5 feet away from the property line and the mansard roof line, although dissimilar in design, was carried around onto that portion of the north elevation only. The landscaping still did not meet the require- ments of the zoning ordinance. -2- Plan 3 indicated that the building had been increased in size to 18~000 square feet and the lot had been reduced in size to 58,200 square feet. The parkin§ was ~ncreased to 90 spaces which resulted in a new parking ratio of 1 space for every 200 square feet of gross building area. The landscaping was changed to comply with the zoning code. The entire north wall was shifted so that it was 6 feet away from the property line and the dissimilar mansard roof line was carried all the way around the building. The general building shape and site plan were changed. Staff had some concerns regarding driveway size and location and ingress/egress onto a future driveway easement. The staff recommended approval of these plans subject to conditions of the Staff Report. The applicant requested a continuance. Plans were again revised. Plan 4 indicated that the building size was being increased to 18,600 square feet and parking was increased by 3 spaces. The proposed parking ratio was still 1 space for every 200 square feet of gross building area. The general building shape was changed back to the design of Plan 2, the landscaping was increased, and staff's ingress/egress concerns were re- solved. Staff and the Architectural Advisor still had some concerns regarding the elevations, however approval was recommended by staff subject to conditions. The plans, however, were continued to resolve elevation changes. Plan 5, the present submittal, indicates that the buildin~ size has been increased to 19,209 square feet. The parking has been reduced by 1 space. The new proposed parking ratio is 1 space for every 209 square feet of gross building area. The building shape is now generally the same as the original submittal, Plan 1, however, the size has been increased by 2,459 square feet and the parking has been increased by 1 space. The mansard roof line is identical all the way around the building and the landscaping complies with the zoning code. Staff has indicated, in red on the plans, some changes which would reduce the building size to approximately 18,700 square feet. The resulting parking ratio would be 1 space for every 203 Square feet of gross building area. Staff is of the opinion that the 92 parking spaces proposed should meet the needs of this revised development. 21.74.040 Scale of map--Determination by commission. Where the property is indicated on the district map as acreage and not subdivided into lots or blocks or where the district boundary lines on the district map shall be determined by the scale contained on such map, and where uncertainty exists, the district boundary line shall be determined by the commission by written decision. In the event property which is shown as acreage on the district map has been or is subsequently subdivided into lots and blocks by a duly recorded subdivision map and the lot and block arrangement does not conform to that anticipated when the district boundaries were established, or property is resubdivided by a duly recorded subdivision map into dif- ferent arrangement of lots and blocks than shown on the district map, the commission, after notice to the owners of property affected thereby and hearing, may interpret the district map and make minor readjustments in the dis- trict boundaries in such a way as to carry out the intent and purposes of these regulations and conform to the street and lot layout on the ground. Such interpretations or adjustments shall be by written decision, and thereafter the copies of the district map shall be changed to conform thereto. (Prior code §9332(c)). Mr. Kee reported that the Zoning Ordinance requires that a zoning district boundary adjustment be considered by the Planning Commission at a public hearing. Acting Chairman Pack invited anyone in the audience to speak for or against this item. This motion was seconded by Commissioner Dickson and unanimously adopted. Commissioner Kasolas then reported that the applicant, Mr. Larry Angel, had requested a continuance of portion (B) of this application to the March 6, 1979, Planning Commission meeting. Building materials are indicated as slumpstone and stucco walls with metal roofing. The applicant is providing 93 parking spaces (1 handicapped, 24 compact, and 68 full size) which results in a parking ratio of one space for every 200 square feet of gross floor area. Angel and Vali Associates for approval of plans to construct a commercial building on property known as 1777 S. Bascom Avenue in a C-2-S (General Commercial) Zoning District. STAFF RECOMMENDATION 1. That the Planning Commission adopt a resolution stating that the subject property is located wholely with the C-2-S Zoning District. 2. Approval of development plans, subject to the attached conditions. STAFF DISCUSSION Part 1 - District Boundary On November 21, 1978, the City approved a parcel map which subdivided a 4.63 acre parcel into two lots: the subject lot (parcel 1) which contains 1.35 acres, and a parcel in the rear (parcel 2) which contains 3.28 acres. The Zoning Map indicates that the easterly 310 feet of the 360 foot long parcel is located in the C-2-S District, and that the westerly 50 feet and parcel 2 are located in the P-D Zoning District. Section 21.74.040 of the Zoning Code allows the Commission to adjust the district boundaries so that a parcel is located completely in only one zoning district. A copy of that section of the code is attached for the Commissions review. Part 2 - Development Plan This item was continued from the meeting of January 16, 1979, in order that the applicant could submit revised plans. The new plans indicate that the applicant is proposing to construct a 18,100 square foot building on a 58,000 square foot lot. The proposed structure will cover approximately 31% of the net lot area. Building materials are indicated as slumpstone and stucco walls with metal roofing. The applicant is providing 90 parking spaces (1 handicapped, 30 compact, and 59 full size) which results in a parking ratio of one space for every 201 square feet of gross floor area. Staff is of the opinion that the 90 spaces should be adequate for this development. The Architectural Advisor has expressed some concerns which will be discussed with the applicant at the Site and Architectural Review Committee meeting. 21.74.040 Scale of map--Determination by commission. Where the property is indicated on the district map as acreage and not subdivided into lots or blocks or where the district boundary lines on the district map shall be determined by the scale contained on such map, and where uncertainty exists, the district boundary line shall be determined by the commission by written decision. In the event property which is shown as acreage on the district map has been or is subsequently subdivided into lots and blocks by a duly recorded subdivision map and the lot and block arrangement does not conform to that anticipated when the district boundaries were established, or property is resubdivided by a duly recorded subdivision map into dif- ferent arrangement of lots and blocks than shown on the district map~ the commission, after notice to the owners of property affected thereby and hearing, may interpret the district map and make minor readjustments in the dis- trict boundaries in such a way as to carry out the intent and purposes of these regulations and conform to the street and lot layout on the ground. Continuance in order that revised site and north elevation plans may be submitted; or 2. Denial of the plans as presented. STAFF DISCUSSION The applicant is proposing to construct a 16,750 square foot commercial building which will cover approximately 29 percent of the 58,800 square foot lot. Building materials are indicated as slumpstone walls with bronze windows and doors and metal roofing. The applicant is providing 91 parking spaces which results in a parking ratio of one space for every 184 square feet of gross building area. Staff is of the opinion that this should be adequate parking for this development. The site plan indicates that approximately 10 percent of the net lot area will be landscaped planters. Additionally, the applicant is proposing approximately 1,000 square feet of ground cover (2'6" which is a part of the recommended parking stall) in the area between the wheel stops and the southerly property line. A normal requirement of the Zoning Ordinance would be 5 feet of landscaping between the property line and the beginning of the 20 foot parking stall, which in this case would result in 7-½ feet, rather than the 2-½ feet proposed. The ordinance reads as follows: 21.51.040 Commercial parking lqts--Landscaping re- quirements. Landscaping requirements of commercial parking lots shall be as follows: (1) All commercial applications for site development with paved areas along any public street frontage shall be required to provide for landscaping of such paved areas to a minimum extent of ten percent of the net site area, which shall exclude all areas of building coverage; (2) Continuous landscaped areas shall be required along the public street frontages of all paved areas, excluding driveways. Said frontage landscaping areas shall be a mini- mum of five feet in width, measured at right angles to the street; (3) Said frontage landscaping shall consist of turf, ground cover, shrubs and trees in combination to provide attractive screening of the paved areas; -2- (4) Where the frontage landscaping requirement does not provide the minimum coverage of ten percent, additional plantings in an amount which makes up the difference shall be evenly distributed throughout the paved area as attrac- tively as is possible; (5) Provision shall be made during initial installa- tion for irrigation of all planted areas; (6) All planting areas shall be protected by concrete curbs or other acceptable barriers; (7) All planting required by this section shall be continuously maintained by the owner or owners.
