BEING A RESOLUTION OF THE PLANNING COMMISSION OF THE
CITY OF CAMPBELL GRANTING A SIGN EXCEPTION (PLN2002-
152) TO AIJ.OW THE INSTAIJ.ATION OF A WAIJ. SIGN ON THE
SIDE OF THE BUILDING FACING McBAIN AVENUE AND A LOGO
PANEL ON THE FRONT OF THE BUII.DING FACING S. BASCOM
AVENUE ON PROPERTY OWNED BY STEVEN AND GINGER
COHEN LOCATED AT 1870 S. BASCOM AVENUE IN A C-2-S
(GENERAL COMMERCIAL) ZONING DISTRICT. APPLICATION OF
MR. JEFFREY E. JENSEN ON BEHALF OF POOL, PATIO AND
THINGS. FII.F. NO. PLN2002-152.
After notification and public hearing, as specified by law, and after presentation by the
Community Development Director, proponents and opponents, the hearing was closed.
After due consideration of all evidence presented, the Planning Commission did find as follows
with respect to application PLN2002-152:
1. The proposed signs are architecturally compatible with the building in terms of color, style
and design and would be constructed of high quality durable materials.
Due to the single tenant nature of the building, and the rather long building frontage along
South Bascom Avenue and narrow frontage on McBain Avenue, the use for which the signs
are to be erected would not be adequately identified without the larger wall sign and second
logo sign.
Although the letters on the wall sign could be spaced closer together in order to conform to
the maximum allowable size of 34 square feet, the greater spacing would maximize the effect
of the halo illumination, providing for a more attractive sign without allowing larger letters
or more text.
The two signs proposed on the front of the building facing South Bascom Avenue total 69.9
square feet, however, the logo sign does not contain any text and is a decorative addition to
the building that breaks up the blank wall of the elevator tower.
5. The project qualifies as Categorically Exempt under Section 15311, Class 11 of the California
Environmental Quality Act (CEQA) pertaining to accessory structures.
Based on the foregoing findings of fact, the Planning Commission further finds and concludes
that:
1. The proposed sign is consistent with the purposes of the Sign Ordinance by preserving and
improving the visual character of the community.
2. The use for which the sign is to be erected would not be adequately identified in comparison
to similar uses without exceeding the standards of the Sign Ordinance.

3. The proposed sign would not be detrimental to the public welfare or persons in the
neighborhood or the City as a whole and allows for reasonable business identification.
4. The proposed signs will promote the economic viability of the City by providing adequate
identification and visibility of the new business, and will also best serve the public welfare
and be in keeping with the principles and purposes of the City's Sign Ordinance.

No substantial evidence has been presented from which a reasonable argument could be
made that shows that the project, as currently presented and subject to the required
Conditions of Approval, will have a significant adverse impact on the environment.
6. There is a reasonable relationship and a rough proportionality between the Conditions of
Approval and the impacts of the project.
NOW, THEREFORE, BE IT RESOLVED that the Planning Commission grants a Sign
Exception (PLN2002-152) to allow the installation of a wall sign on the side of the building
facing McBain Avenue and a logo panel on the front of the building facing S. Bascom Avenue
on property owned by Steven and Ginger Cohen located at 1870 S. Bascoln Avenue, subject to
the following conditions:
Where approval by the Director of Community Development, City Engineer, Public Works
Director, City Attorney or Fire Department is required, that review shall be for compliance with
all applicable conditions of approval, adopted policies and guidelines, ordinances, laws and
regulations and accepted engineering practices for the item under review. Additionally, the
applicant is hereby notified that he/she is required to comply with all applicable Codes or
Ordinances of the City of Campbell and the State of California that pertain to this development
and are not herein specified.

allowed on the second floor level windows. Temporary signs that meet the criteria under the
City's Sign Ordinance can be placed on first story windows.

stacking of merchandise against display windows are to be prohibited. Appropriate attractive
displays of available retail merchandise are permitted.

Permits Required: A building permit application shall be required for the proposed signs.
The building permit shall include Electrical/Plumbing/Mechanical fees when such work is
part of the permit. Prior to performing any work, the applicant shall make application to, and

Hearing to consider the application of Mr. Jeffrey E. Jensen, on behalf of
Pool Patio and Things, for a Sign Exception (PLN 2002-152) to allow the

on property owned by Steven and Ginger Cohen located at 1870 S. Bascom
Avenue in a C-2 (General Commercial) Zoning District.
STAFF RECOMMENDATION
That the Planning Commission take the following action:
Adopt a Resolution, incorporating the attached findings, approving a Sign Exception to allow
the installation of a wall sign on the side of the building facing McBain Avenue and a logo panel
on the front of the building facing South Bascom Avenue, subject to the attached Conditions of
Approval and find that this project is categorically exempt under Class 11 of the California
Environmental Quality Act pertaining to accessory structures.

DISCUSSION
Applicant's Proposal: The applicant, Mr. Jeffrey E. Jensen, on behalf of Pool Patio and Things, is
requesting a Sign Exception to allow the installation of a wall sign on the side of the building
facing McBain Avenue and a logo panel on the front of the building facing South Bascom
Avenue. The proposed wall sign exceeds the maximum size (34 square feet) that is allowed on
the building under the Sign Ordinance based on the amount of building frontage and the logo
sign would be a second wall sign that is not allowed under the Sign Ordinance, unless approved
by a Sign Exception.

Background: The subject building is currently under construction and was approved by the
Planning Commission in March 2002. No signs were approved at the time of Site and
Architectural Review Permit approval. A Sign Permit was issued by staff on January 3, 2002 for
a 38.3 square-foot wall sign mounted on the front of the building wall facing South Bascom
Avenue since it conformed to the requirements of the Sign Ordinance. This wall sign is identical
to the one proposed for the McBain Avenue building wall.
The project site is located on the northeast comer of South Bascom Avenue and McBain Avenue.
ANALYSIS
Sign Proposal: The proposed wall sign would be mounted on the side of the building facing
McBain Avenue over the two-story retail windows. The sign would consist of individually
mounted bronze channel letters that read "Pool Patio & Things" that are halo illuminated with
white neon. The letters measure 20" high for the capitals and 18.5" high for the non-capitals. The
sign is 23 feet wide. The proposed sign is 38.3 square feet as measured as a box around the letters
(20" by 23'). Although the letters could be spaced closer together in order to conform to the
maximum allowable size of 34 square feet, the applicant is requesting approval of the Sign
Exception in order to maximize the effect of the halo illumination by spacing the letters further
apart.
The proposed logo panel would be mounted on the front of the building facing South Bascom
Avenue on the elevator tower. The sign would consist of a raised 8" bronze background panel
that holds the electrical components and provides a flat surface for the neon halo lighting
depicting a sun, pole, and umbrella that forms the store's logo. It is an established trademark used
by the company for several years. The applicant is requesting approval of this sign because it
would be a colorful decorative addition to the building.
Sign Requirements: The Sign Ordinance stipulates that each business is permitted one wall sign
and businesses which are located adjacent to two streets (on a comer) are permitted one
additional wall sign, to face the second adjacent street if the business is not identified on a
freestanding sign. Wall signs for commercial uses are limited in size to no greater than one
square foot of sign area for each linear foot of business frontage. The maximum size of the wall
sign for Pool Patio and Things building side facing McBain Avenue is 34 square feet since the
building frontage measures 34 linear feet. The proposed wall sign exceeds the maximum
permitted size by 4.3 square feet. The proposed logo panel is an additional sign that exceeds the
one permitted under the Sign Ordinance.
Sign Exceptions: Section 21.53.030 "Administrative Procedures" of the Sign Ordinance
stipulates that the Planning Commission may authorize larger signs or more signs when it
determines the that one or more of the following apply:
a. The use or uses for which the signs are to be erected would not be adequately identified;
or
b. The site is unusually difficult to locate in comparison to similar uses without exceeding
the standards provided in this chapter; or
c. The use is of such size and is so located in reference to surrounding uses and/or the traffic
circulation system that a larger, higher or temporary off-site directional sign, or longer

time period would best serve the public welfare and would be in keeping with the
principles and purposes of this Chapter.
Staff Analysis: The proposed signs are architecturally compatible with the building in terms of
color, style and design and would be constructed of high quality durable materials. The building
has a large amount of frontage (112'-6") on South Bascom Avenue and a smaller amount (34')
on McBain Avenue. While a 50 square foot wall sign would be permitted on the South Bascom
Avenue wall, only a 34 square foot sign would be permitted on the McBain Avenue wall.
Staff finds that due to the single tenant nature of the building, and the rather long building
frontage along South Bascom Avenue and narrow frontage on McBain Avenue, the use for which
the signs are to be erected would not be adequately identified without the larger wall sign and
second logo sign. Staff believes that only the first finding required for permitting larger or more
signs applies and not the second, in that the site is not unusually difficult to locate in comparison
to similar uses.
Although the letters on the wall sign could be spaced closer together in order to conform to the
maximum allowable size of 34 square feet, the greater spacing would maximize the effect of the
halo illumination, providing for a more attractive sign without allowing larger letters or more
text. Although the wall sign on the front of the building facing South Bascom Avenue could be a
maximum size of 50 square feet, the applicant has kept its size at 38.3 square feet in order to be
identical to the wall sign proposed for the side of the building facing McBain Avenue.
The two signs proposed on the front of the building facing South Bascom Avenue total 69.9
square feet, however, the logo sign does not contain any text and is a decorative addition to the
building that breaks up the blank wall of the elevator tower. Staff is supportive of this decorative
logo panel because it is decorative and does not include text. It also helps to provide visual
interest to the elevator tower.
Site and Architectural Review Committee: The Site and Architectural Review Committee
reviewed the proposed application at its meeting of January 14, 2003. The Committee was
supportive of the proposed sign exception as presented and had no recommended modifications.

Dear Darcy:
We would like to present a sign program for our above-mentioned customer, please see
enclosed drawing #02-2166 dated 10/4/02. We propose two (2) sets of 181/2'' pan channel
letters to read: "POOL PATIO & THINGS" on the West and South elevations and a
38" (w) x 10'-0" (h) Iago panel on the "elevator tower" on the West elevation.
One issue with the set of"halo" illuminated letters on the McBain Avenue elevation is that
only 34 sq. feet of signage is allowed based on frontage of 34 feet and we are proposing 38
sq. feet of signage as calculated by City of Campbell Planning Dept. the reason that our sign
is 4 sq. feet over its allotment is that the wider spacing layout better utilizes the "halo"
illumination effect. This effect can be seen at the Pottery Barn.
The Iago is an established trademark used by the company for several years and will be
recognized by generations of loyal "Pool Patio & Things" customers, zt consists of a raised 8"
background panel that holds the electrical components and provides a fiat surface for the
neon "halo" lighting within the sun, the umbrella and the pole.
We feel that this design will be a colorful addition to a beautiful new building and will serve
the customers needs while complementing the community.

Staff Recommendation: Staff recommends approval of the Sign Exception due to finding that the
use for which the signs are to be erected would not be adequately identified without the larger
wall sign on the side of the building facing McBain Avenue and a logo panel on the front of the
building that is a second sign on the front building wall.

Approval of One (1) Wall Sign Facing South Bascom Avenue

Dear Mr. Jensen:
The Campbell Planning Division has reviewed your application for sign permits for one (1) wall
sign on the front of the building facing South Bascom Avenue, one (1) wall sign on the side of
the building facing McBain Avenue, and one (1) logo panel attached to the front of the building
facing South Bascom Avenue on property owned by Steven and Ginger Cohen located at 1870 S.
Bascom Avenue in a C-2 (General Commercial) Zoning District.
This sign permit for the one wall sign on the front of the building facing South Bascom Avenue
has been approved because it measures 38.3 square feet, which 'is below the maximum wall sign
size of 50 square feet for that building wall. The sign consists of individually mounted bronze
pan channel letters that read "Po. ol Patio & Things." The white neon halo illuminated letters
measure 20" high for the capitals and 18.5" high for the non-capitals. The sign is 23 feet wide.
The proposed halo illuminated bronze pan channel letters measure 38.3 square feet as measured
as a box around the letters (20" by 23'). The approval is subject to the following Conditions of
Approval:
1. The applicant shall obtain any necessary building permits from the Building Division prior to
sign installation.
2. This sign permit shall expire six months from the date of approval unless the signs have been
erected.
3. The sign shall conform with the enclosed approved plans in terms of colors, size, and
proportions.

As discussed previously, the one (1) wall sign proposed for to be located on the side of the
building facing McBain Avenue and the and one (1) logo panel proposed to be attached to the
front of the Pool Patio and Things require approval of a Sign Exception by the Planning
Commission because the proposed wall sign facing McBain Avenue exceeds the maximum size
(34 square feet) that is allowed under the Sign Ordinance for this particular building frontage and
the logo sign would be a second wall sign that is not allowed under the Sign Ordinance. The Sign
Exception a~plication is schedule for review by the Site and Architectural Review Committee on
January 14u' and the Planning Commission on January 28th. You will be receiving more
