The Planning Commission meeting of September 23, 2003, was called to order at 7:30 p.m., in
the Council Chambers, 70 North First Street, Campbell, California by Chair Hernandez and the
following proceedings were had, to wit:

Motion: On motion of Commissioner Francois, seconded by Commissioner Doorley,
the Planning Commission minutes of September 9, 2003, were approved as
submitted. (7-0)

Chair Hernandez read Agenda Item No. 1 into the record.
1. PLN2003-101
Nguyen, T.
Public Hearing to consider the application of Mr. Tu Tuan Nguyen, on
behalf of Mr. Duc Lam Nguyen, for a Site and Architectural Review
Permit (PLN2003-101) to allow a second story addition and remodel of an
existing single-family residence on property owned by Mr. Duc Lam
Nguyen located at 819 Kenneth Avenue in an R-l-10 (Single Family
Residential) Zoning District. Staff is recommending that this project be
deemed Categorically Exempt under CEQA. Planning Commission
decision final in 10 calendar days, unless appealed in writing to the City
Clerk. Project Planner: Tim J. Haley, Associate Planner
Mr. Tim J. Haley, Associate Planner, presented the staff report as follows:
· Advised that the applicant is seeking a Site and Architectural Review Permit to allow a
second story addition to an existing single-story residence in an R-l-10,000 Zoning District
located within the San Tomas Area Neighborhood.
· Added that this is a substantial addition and that the existing accessory structure would be
retained.
· Described the surrounding uses as single-family on three sides with duplexes located
behind the property.
· Informed that the proposal meets the requirements under the Zoning and San Tomas Area
Neighborhood Plan.
· Stated that SARC reviewed the project and proposed revised window shapes for two of the
windows.
Recommended approval.
Commissioner Roseberry asked about the large accessory structure, its use and whether
restrooms are included in that structure.
Associate Planner Tim J. Haley replied that the structure does not represent living space and
was constructed with appropriate building permits.
Commissioner Gibbons presented the Site and Architectural Review Committee report as
follows:
· SARC reviewed this project on September 9, 2003, and was supportive with two window
shape changes.
Chair Hernandez opened the Public Hearing for Agenda Item No. 1.
Ms. Meg Stein, Representative, San Tomas Neighborhood Association:
· Complimented the designer and the Commission for doing a great job.
· Advised that she had reviewed and visited both sites included on this evening's agenda.
· Stated that this residential design depicts a really great way to make an enormous house
that still fits in within the San Tomas Neighborhood.
· Added that she is pleased with how architects have been working with requirements of the
San Tomas Area Neighborhood Plan.

Chair Hernandez closed the Public Heating for Agenda Item No. 1.
Motion:
Upon motion of Commissioner Doorley, seconded by Commissioner Rocha,
the Planning Commission adopted Resolution No. 3524 approving a Site
and Architectural Review Permit (PLN2003-101) to allow a second story
addition and remodel of an existing single-family residence on property
owned by Mr. Duc Lam Nguyen located at 819 Kenneth Avenue and found
this project to be Categorically Exempt under CEQA, by the following roll
call vote:

Public Hearing to consider the application of Mr. Greg Ward, on behalf
of Max and Cynthia Aghazadeh, for a Site and Architectural Review
Permit (PLN2003-86) to allow a second story addition and remodel of
an existing single-family residence on property owned by Max and
Cynthia Aghazadeh located at 1429 Theresa Avenue in an R-l-8
(Single Family Residential) Zoning District. Staff is recommending that
this project be deemed Categorically Exempt under CEQA. Planning
Commission decision final in 10 calendar days, unless appealed in
writing to the City Clerk. Project Planner: Tim J. Haley, Associate
Planner
Mr. Tim J. Haley, Associate Planner, presented the staff report as follows:
· Advised that this project is similar to the previous one in that the applicant is also seeking a
Site and Architectural Review Permit to allow a second story addition to an existing single-
family residence.
· Described the zoning as R-l-8 as well as being located within the San Tomas Area
Neighborhood.
· Said that the additions are proposed for the first and second floor as well as a basement.
The existing garage and accessory building will be demolished.
· Advised that the project meets the R-1 and San Tomas Area Neighborhood Plan standards.
· Said that SARC reviewed the project and was supportive with minor changes.
· Recommended approval.
Commissioner Roseberry sought confirmation that the garage would be demolished.

Commissioner Roseberry expressed concern about the amount of concrete coverage and asked
who checks out such issues as hardscape coverage.
Associate Planner Tim J. Haley replied that this issue is considered as part of the Planning
Department review. There is a 50 percent limitation of hardscape coverage for front yards,
which is not exceeded here. Added that additional trees will be planted on the property as is
required under the San Tomas Area Neighborhood Plan.
Commissioner Roseberry questioned the issues of having two restrooms in the basement space
and who assures that the issues of plumbing flow will function properly.
Associate Planner Tim J. Haley replied that he suspects that the Building Department is
responsible for ensuring that a project is so design as to drain properly. Additionally, West
Valley Sanitation oversees the sewerage system for the City and is involved when new
installations are proposed.
Commissioner Gibbons pointed out that hardscape surfaces have a distinction between
concrete/asphalt versus decorative pavers. Pavers are not counted as hardscape.
Associate Planner Tim J. Haley agreed that pavers are sometimes identified as landscaping
surface.
Commissioner Gibbons presented the Site and Architectural Review Committee report as
follows:
SARC reviewed this project on September 9, 2003, and was supportive with the request
that the garage door and window detail changes be simplified and resubmitted to the
Community Development Director for approval.
Chair Hernandez opened the Public Hearing for Agenda Item No. 2.
Mr. Greg Ward, Project Designer and Applicant Representative:
· Assured the Commission that his client has agreed to the changes to the garage door and
windows and have implemented those changes in their plans.
· Said he would be happy to answer any questions from the Commission.

Motion:

REPORT OF THE COMMUNITY DEVELOPMENT DIRECTOR
The written report of Ms. Sharon Fierro, Community Development Director, was accepted as
presented with the following additions:
· Advised the Commission that she has been serving as part of a Santa Clara Valley Water
Resource Collaborative, working over the last six months to draft a Memorandum of
Consensus. A copy of the Council report was included in the Director' s Report.
· Added that the VTA Best Practices for designing transit-oriented development was adopted
by Council at its last meeting.
· Offered to make copies of the design guidelines to those Commissioners interested in
seeing it. Most indicated their interest in seeing these guidelines.
· Informed the Commission that there are three items proposed for the next Planning
Commission agenda.
· Reminded the Commission of the November 20, 2003, Commissioners Dinner to be held at
Villa Ragusa.
· Mentioned the Neighborhood Profile included in the San Jose Mercury News on the Hazel
Neighborhood.
ADJOURNMENT
The Planning Commission meeting adjourned at 7:50 p.m. to the next regular Planning
Commission meeting on October 14, 2003, in Council Chambers, City Hall, 70 North First
Street, Campbell, California, at 7:30 p.m.
