Dear Blackhawk Parent LLC:
In response to your request for a zoning verification letter received by this department
on December 19, 2006, please be advised of the following:
The zoning and use of the above-referenced property is governed by the laws and
regulations of the City of Campbell. Our records indicate that the property is presently
owned by Equity Office Properties. This property is zoned C-2 (General Commercial)
and the current underlying General Plan land use designation is General Commercial.
Please refer to Section 21.10.050 B of the Campbell Municipal Code for a list of allowed
uses and Section 21.10.050 C for a list of uses allowed with a Conditional Use Permit in
the C-2 Zoning District. The western portion of the Pruneyard is in an "0" Overlay/
Combining Zoning District which requires a Conditional Use Permit for any building,
or use proposed per Section 21.14.030 of the Campbell Municipal Code. Condition #6(F)
of the Use Permit 94-19 states that all future development in the "0" overlay zone shall
be subject to a Special Development Permit from the City Council. The maximum
height allowed is 45 feet.

Our records indicate that the property is in compliance with the City of Campbell's
building and zoning laws, rules, and regulations. As of this date, the property and
improvements thereon are not in violation of the zoning laws, rules, and regulations.

The property is currently surrounded by the following Zoning Districts and land uses:
· North: PD (Planned Development) - Mixed Use (commercial! residential)
· South: C-2 (General Commercial) and PD (Planned Development) - commercial
and residential
· East: C-2 (General Commercial) - various retail stores
· West: Highway 17/ Los Gatos Creek
History: The retail portion of the site was approved in 1969 along with a Master Plan
for the site and was constructed over time in six phases. Construction of the office
towers began in 1971. The hotel was constructed in 1989. In 1995 a Use Permit and Site
and Architectural approval was granted to reconfigure existing retail space, construct
new retail space, improve pedestrian and vehicular circulation, parking, landscaping
and allow expansion of the hotel and sale of alcohol and outdoor seating at restaurants.
Various other approvals have been granted over the years including Tentative Parcel
Maps, Sign Permits and Use Permits.
Signs: There is a Master Sign Program for the Pruneyard which was adopted by the
Planning Commission on August 10,2004 and was then amended on October 25,2005.
A Sign Permit will be required for any signs proposed. The proposed sign(s) shall be
designed to reflect the standards of the Master Sign Program for the Pruneyard.
Parking: The Pruneyard had a Shared Parking Analysis prepared in 1995 which shows
a parking ratio of 1:311 square feet and 1,896 parking spaces.
Certificate of Occupan0': Certificates of occupancy and building permits are handled
through the Building Department. You can contact the Building Department at (408)
