DISCUSSION
Applicant's Proposal: The applicant is requesting an extension of time (pLN2006-157) for an
approval of a Conditional Use Permit (pLN2004-188) to allow late night activities for a
restaurant in Downtown Campbell located at 266 E. Campbell Avenue.
Background: The subject property is currently developed with a single-story, multi-tenant,
commercial building constructed in approximately 1947. There are currently three tenant spaces
in the building, one occupied by the Cardiff Lounge, one leased by Slice restaurant, and one
vacant retail space.
The Planning Commission approved a Conditional Use Permit (pLN2004-188) on April 26,
2005, effective May 6, 2005, to allow late night activities for Slice restaurant in Downtown
Campbell between the hours of 11 :00 a.m. to 11 :00 p.m. Sunday to Wednesday and 11 :00 a.m. to
2:00 a.m. Thursday through Saturday.
Proiect Location: The project site is located on the south side of East Campbell Avenue, between
South First Street and South Second Street. The property is surrounded by commercial uses on
the north, east and west sides, and a parking lot to the south.
ANALYSIS
General Plan Designation: The General Plan land use designation for the project site is Central
Commercial. The proposed late night operational hours in conjunction with a restaurant is
consistent with this land use designation.
Zoning Designation: The zoning designation for the project site is C-3 (Central Business
District). The C-3 Zoning District allows late night activities occurring between 11 :00 p.m. and
6:00 a.m. with approval of a Conditional Use Permit. The proposed project would be consistent
with the Zoning Ordinance with approval of a Conditional Use Permit.
Late Night Activities: The applicant is requesting a time extension of the previously approved
Conditional Use Permit to allow late night activities for Slice restaurant in Downtown Campbell
between the hours of 11 :00 a.m. to 11 :00 p.m. Sunday to Wednesday and 11 :00 a.m. to 2:00 a.m.
Thursday through Saturday.
The applicants submitted a letter dated October 22, 2006, stating that the project would be
delayed because of unforeseen delays to construction. As a result of the delay, the applicants are
requesting an extension oftime to complete construction.
The applicants have stated that no modifications have been made to the previously approved
plans. There have been no changes in the facts or circumstances that would affect this project.
Therefore, Staff recommends that the Planning Commission approve the 60 day extension of
time to the Conditional Use Permit.
Staff Report - Planning COIrunission Meeting of November 28,2006

Given the extended period of time the applicant has had to open for business, the following
conditions have been added:
1. Tenant shall be open for business within 60 days from the date of approval of the time
extension. Failure to meet this deadline of February 9, 2007, will result in the
Conditional Use Permit being void.
2. Tenant shall submit plans for review and approval for all storefront and outdoor
improvements to the building within 60 days of approval of the time extension (by
February 9, 2007).
3. Tenant shall complete all storefront and outdoor improvements within six months of the
approval of the time extension (by June 9, 2007).
Site and Architectural Review Committee: The Site and Architectural Review Committee did
not review this application, as there are currently no proposed changes to the exterior of the
building or site configuration.

Use Permit Written Statement for SLICE
1. The requested project name is SLICE.
2. The nature of the requested use for SLICE, will be a gourmet wood oven pizzeria. The
cafe/restaurant will include gourmet thin crust pizza, light appetizers, high-end healthy
salads and desserts. In addition to food, SLICE will offer beer and wine, with the
consideration of full liquor in the future. SLICE will offer a hip and funky indoor dining
experience, in addition to pati%utdoor dining.
3. The hours of operation for SLICE will be:
o Monday to Wednesday 11 am to 11 pm
o Thursday, Friday and Saturday l1am to 3am
o The reason for the late night hours for Thursday, Friday and Saturday, is to offer
the clientele of The Cardiff Lounge, as well as additional local Campbell
neighboring pubs and bars, a place to dine for the late night hours. It is my goal
to provide this service that I feel is much needed and that has been requested
numerous times by The Cardiff Lounge clientele, in addition to other local
Campbell residents.
o I am aware that there might be some concern with the late night hours on
Thursday, Friday and Saturday, due to late possible noise, loitering, or unruly
behavior. To minimize these possible concerns, I am willing to staff at least two
door hosts/security. Be advised that I will keep these individuals onsite until the
last customer exits. In addition, there will be no music playing during the late
night hours. Finally, I'd like to state that I would be willing to operate under a
provisional CUP for the fITst 6 months of operation. At the end of the 6 month
provisional CUP, we can have an evaluation of the operation. At that time it
would be my hope that The City of Campbell will be comfortable with my
operations of SLICE. I would like to mention that I have operated The Cardiff
Lounge for 2 years come this January, and I feel that I have been a responsible
operator and business owner. My future plans are to open other businesses in
Campbell and I plan on being a business resident in Campbell for a long time.
4. The number of employees for SLICE, will be 3 per shift. Shifts will include:
o llam to 4pm
o 4pm to 9pm
o 9pm to close
5. There is a potential for light traffic generation, however I do not see it as a concern.
There is ample parking available behind the establishment and on the street.
Thank you for your consideration
