DISCUSSION
Applicant's Proposal: The applicant is requesting approval of a Conditional Use Permit to allow
on-sale beer and wine sales in conjunction with the Sato Japanese Cuisine located at 330 E.
Hamilton Avenue, #7. No expansion of the existing building is proposed.
Proiect Location: The project site is located on the south side of East Hamilton Avenue, between
Central Avenue and North Third Street. The property is surrounded by restaurant and
commercial uses to the north, condominiums to the south and offices to the east and west.
Background: A Site and Architectural Permit and Conditional Use Permit to allow the
construction of a new single story multi-tenant commercial building was approved by the
Planning Commission in April 2004 on the project site. The new restaurant is located in the last
tenant space at the rear of the building, adjacent to the rear parking lot. A Building Permit was
issued on November 7th for tenant improvements associated with the new restaurant use.
ANALYSIS
General Plan Designation: The General Plan land use designation for the project site is General
Commercial. The proposed beer and wine sales in conjunction with a restaurant is consistent
with this land use designation.
Zoning Designation: The zoning designation for the project site is C-2 (General Commercial).
The C-2 Zoning District allows beer and wine sales with approval of a Conditional Use Permit.
The proposed project would be consistent with the Zoning Ordinance with approval of a
Conditional Use Permit.
Parking: Pursuant to the Campbell Parking and Loading Ordinance, one parking space is
required for each three seats for a restaurant use. The applicant is requesting 60 interior seats
yielding a parking requirement of 20 parking spaces. The current parking configuration provides
82 parking spaces and this tenant space warrants an allocation of 13.9 spaces. The proposed 60-
seat restaurant creates a parking deficiency of 6 spaces.
The City of Campbell Zoning Code allows the Planning Commission to adjust the parking
requirements for a specific use when it determines that circumstances warrant an adjustment. The
subject retail building has seven tenant spaces. There are two businesses currently in operation at
this location: Starbucks and Subway Sandwiches. At this time, there are no formal applications
for the four other vacant tenant spaces.
Staff Report - Planning Commission Meeting of December 12,2006
PLN2006-174 - 330 E. Hamilton Avenue, #7
Page 3 of4
The Planning Commission may take either of the following actions:
1. Approve a parking adjustment and allow the proposed use a maximum of 60 seats.
2. Deny the parking adjustment and require the proposed restaurant to limit their seating to
42 seats.

Landscaping: Approximately 12 percent of the project site is landscaped. A minimum of 10
percent is required by the Zoning Ordinance.
Lighting: No changes to the exterior lighting are proposed. Mid-height, directional parking lot
light standards were originally approved with this project.
Exterior Modifications: The proposed restaurant use requires the installation of an emergency
exit located at the south side of the structure. This exit shall be restricted to emergency egress
only and alarmed.
Beer and Wine License: Businesses that offer on-sale beer and wine sales are required to obtain
a Conditional Use Permit. Issues for review by the Planning Commission include the
compatibility of the proposed use with the surrounding uses and properties, the potential over
concentration of similar liquor establishments, and the operational characteristics of the
requested use. The proposed on-sale beer and wine sales would be for consumption on site and
would not be available to take off site.
With the addition of recommended conditions of approval, staff finds that the proposed on-sale
beer and wine sales is incidental to the restaurant operation, is compatible with the surrounding
uses and properties within the area, and does not represent an over concentration of such
establishments.

Site and Architectural Review Committee: The Site and Architectural Review Committee did
not review this application, as there are no proposed significant architectural changes to the
exterior of the building or site configuration.
Police D~artment Review: The Campbell Police Department has reviewed the application and
has no objections to the proposed beer and wine sales, with the addition of the recommended
conditions of approval.
