BEING A RESOLUTION OF THE PLANNING COMMISSION OF THE
CITY OF CAMPBELL APPROVING A CONDITIONAL USE PERMIT
(PLN2006-78) TO ALLOW LATE NIGHT OPERATIONAL HOURS
AND OUTDOOR SEATING IN CONJUNCTION WITH A NEW
STARBUCKS COFFEE WITHIN AN APPROVED MULTI-TENANT
RETAIL BUILDING ON PROPERTY OWNED BY FORTY-TWO
ASSOCIATES LOCATED AT 330 E. HAMILTON LANE IN A C-2-S
(GENERAL COMMERCIAL) ZONING DISTRICT. APPLICATION OF
MR. STEVEN HALL, ON BEHALF OF GRYPHON ARCHITECTURE.

After notification and public hearing, as specified by law and after presentation by the
Community Development Director, proponents and opponents, the hearing was closed.
After due consideration of all evidence presented, the Planning Commission did find as
follows with respect to application PLN2006-78:
1. The proposed operational hours and late night activities in conjunction with a cafe
are consistent with the General Commercial General Plan land use designation.
2. The proposed operational hours and late night activities for a cafe will be compatible
with the C-2-S (General Commercial) zoning designation with approval of a
Conditional Use Permit and the recommended conditions of approval.
3. The project site consists of a 1,650 square foot tenant space for a cafe in an 11,600
square foot bUilding that was approved in 2004.
4. The project site is located on the south side of East Hamilton Avenue between
Central avenue and Third Street. The property is surrounded by commercial uses to
the north, an office use to the east and west and condominiums to the south.
5. The proposed project is consistent with other commercial developments and uses in
the surrounding area.
6. No exterior modifications to the building are proposed with the exception of outdoor
seating of 13 seats.
7. The Police Department has not expressed a concern with the proposed project.
8. The hours of operation shall be restricted to:
a) Outdoor activities (e.g. outdoor seating, parking lot cleaning, trash pick-up or
sweeping and deliveries) shall be limited to 6:00 a.m. to 10:00 p.m.

b) Cafe operation is permitted:
4 a. m. to 11 p.m. (Sunday through Thursday)

9. The project qualifies as a Categorically Exempt project per Section 15301, Class 1
(Existing Facilities) of the California Environmental Quality Act (CEQA).
Based upon the foregoing findings of fact, the Planning Commission further finds and
concludes that:
1. The proposed project is consistent with the General Plan.
2. The proposed use is allowed within the applicable zoning district with Conditional
Use Permit approval, and complies with all other applicable provisions of this Zoning
Code and the Municipal Code.
3. The proposed site is adequate in terms of size and shape to accommodate the
fences and walls, landscaping, parking and loading facilities, yards, and other
development features required in order to integrate the use with uses in the
surrounding area.
4. The proposed site is adequately served by streets of sufficient capacity to carry the
kind and quantity of traffic the use would be expected to generate.
5. The design, location, size, and operating characteristics of the proposed use are
compatible with the existing and future land uses on-site and in the vicinity of the
subject property.
6. The establishment, maintenance, or operation of the proposed use at the location
proposed will not be detrimental to the comfort, health, morals, peace, safety, or
general welfare of persons residing or working in the neighborhood of the proposed
use, or be detrimental or injurious to property and improvements in the
neighborhood or to the general welfare of the City.
7. The establishment a cafe with late night operational hours and outdoor seating use
will not result in an over concentration of such uses in the area.
8. The establishment of a cafe will not create a nuisance due to litter, noise, traffic,
vandalism, or other factors.
9. The establishment of a cafe will not significantly increase the demand on City
services.
10. No substantial evidence has been presented which shows that the project, as
currently presented and subject to the required conditions of approval, will have a
significant adverse impact on the environment.

11. There is a reasonable relationship and a rough proportionality between the
conditions of approval and the impacts of the project.
THEREFORE, BE IT RESOLVED that the Planning Commission approves a
Conditional Use Permit (PLN2006-78) to allow late night operational hours and outdoor
seating in conjunction with a new Starbucks Coffee within an approved multi-tenant
retail building on property owned by Forty-Two Associates located at 330 E. Hamilton
Avenue in a C-2-S (General Commercial) Zoning District.
Where approval by the Director of Community Development, City Engineer, Public
Works Director, City Attorney or Fire Department is required, that review shall be for
compliance with all applicable conditions of approval, adopted policies and guidelines,
ordinances, laws and regulations and accepted engineering practices for the item under
review. Additionally, the applicant is hereby notified that he/she is required to comply
with all applicable Codes or Ordinances of the City of Campbell and the State of
California that pertain to this development and are not herein specified.
COMMUNITY DEVELOPMENT DEPARTMENT
Planning Division
1. Aooroved Proiect: Approval is granted for a Conditional Use Permit (PLN2006-78)
to allow a cafe with late night operational hours and outdoor seating (Starbuck's)
located at 330 E. Hamilton Avenue. The project shall substantially conform to the
plans received by the Planning Division on June 16, 2006, and project description
received on May 18, 2006, except as may be modified by the conditions of approval
contained herein.
2. Conditional Use Permit Aooroval Exoiration: The Conditional Use Permit approval
shall be valid for one year from the date of final approval. Within this one-year
period the use must be established on the property and the conditions of approval
satisfied. Failure to meet this deadline will result in the Conditional Use Permit being
void.
3. Revocation of Permit: Operation of the use in violation of the Conditional Use Permit
or any standards, codes, or ordinances of the City of Campbell shall be grounds for
consideration of revocation of the Conditional Use Permit by the Planning
Commission. In the event complaints are received by the City regarding noise, the
Community Development Director may immediately modify the hours of operation
and/or limit the extended hours of operation, subject to the project being brought
back to the Planning Commission for review.

4. Business Ooerational Hours: The hours of operation shall be allowed

exterior areas of the business free from graffiti, trash, rubbish, posters and stickers
placed on the property.
6. Sionaae: No signage is approved as part of the development application approved
herein. All signage shall be installed and maintained consistent with the provision of
the Sign Ordinance, Chapter 21.30 of the Campbell Municipal Code.
7. Location of Mechanical Eauioment: No roof-mounted mechanical equipment (i.e. air
conditioning units, ventilation ducts or vents), shall be added to the existing building
without providing screening of the mechanical equipment from public view and
surrounding properties. The screening material and method shall be architecturally
compatible with the building and requires review and approval by the Community
Development Director and Building Division prior to installation of such screening.
8. Loiterina: There shall be no loitering allowed outside the business in the rear
parking lot or the side parking lot areas.
9. Outdoor Storaae: No outdoor storage is permitted on the subject property. No
equipment or materials shall be stored outside the building or within the parking lot.
10. Noise:
a. Noise Standard: Any noises, sounds and/or voices, including but not limited to
amplified sounds, loud speakers. sounds from audio sound systems, music,
and/or public address system, generated by the subject use shall not be audible
to a person of normal hearing capacity from any residential property.
b. Noise Manaaement: In the event complaints are received by the City regarding
noise, the Community Development Director may immediately modify the hours
of operation and/or limit the extended hours of operation, subject to the project
being brought back to the Planning Commission for review.

compliance with the standards in Chapter 21.28 (Parking & Loading) of the
Campbell Municipal Code.

STAFF RECOMMENDATION
That the Planning Commission take the following action:

property, subject to the attached conditions of approval.

DISCUSSION
Applicant's Proposal: The applicant is requesting approval of a Conditional Use Pennit to allow
the establishment of a Starbuck's Cafe with late night operational hours (generally early
mornings beginning at 4 a.m.) and additional outdoor seating facilities in an approved multi-
tenant retail building currently under construction on the project site.
Project Location and Background: The project site is located on the south side of East Hamilton
Avenue between Central Avenue and N. Third St. The property is surrounded by the following
uses:

A Site and Architectural Approval and Conditional Use Pennit to allow the construction of a
new single story multi-tenant commercial building was approved by the Planning Commission
in April 2004 on the project site. The proposed tenant space is situated along the Hamilton
Avenue frontage.
ANALYSIS
General Plan Designation: The General Plan land use designation for the project site is General
Commercial. The proposed cafe use is consistent with this land use designation.
Zoning Designation: The zoning designation for the project site is C-2-S (General Commercial).
The C-2-S Zoning District allows a cafe use as a permitted use and requires that late night
businesses and outdoor seating beyond 3 seats obtain a Conditional Use Permit. The applicant is
requesting approval of 13 exterior seats and late night operational hours. The proposed project
would be consistent with the Zoning Ordinance with approval of a Conditional Use Permit.
Operational Hour: The applicant is requesting approval to operate the cafe as follows:
4 a. m. to 11 p.m. (Sunday through Thursday)
4 a.m. to 12 a.m. (Friday and Saturdays)
Staff finds the operational hours are reasonable for a cafe that is situated on an arterial street and
is not in close proximity to sensitive land uses such as residences. Staff is recommending a
condition of approval that restricts outdoor activities (e.g. seating, cleaning activities and
deliveries) to 6 a.m. to 10 p.m. Outdoor seating is limited to 13 seats and the proposed tenant
space is located along the Hamilton Avenue frontage which is not in close proximity to the
residences to the rear ofthe property.
A condition of approval has been added that allows for review of the Conditional Use Permit by
the Planning Commission if verified complaints are received by the City. If staff is unable to
immediately resolve the matter with the business owner/operator, the Community Development
Director may immediately modify the hours of operation and/or limit the extended hours of
operation, subject to the project being brought back to the Planning Commission for review.

Parking: Pursuant to the Campbell Parking and Loading Ordinance, one parking space is
required for each three seats for a restaurant use. The approved building has 36 seats (23 interior
and 13 exterior) yields a parking requirement of 12 parking spaces. The current parking
configuration provides 82 parking spaces and this tenant space warrants an allocation of 11.6
spaces. Staff finds the parking adequate for the proposed use.
Landscaping: Approximately 12 percent of the project site is landscaped. A minimum of 10
percent is required by the Zoning Ordinance.
Lighting: No changes to the exterior lighting are proposed. Lower directional parking lot light
standards were originally approved with this project.
Exterior Modifications: No exterior modifications to the building or project site are proposed in
conjunction with the late night operations request with the exception of outdoor seating. Staff is
recommending that the outdoor use ofthe patio area be restricted from 6:00 a.m. to 10:00 p.m.
Police Department Review: The Campbell Police Department has reviewed the application and
has no concerns or objections to the proposed hours of operation.
Site and Architectural Review Committee: The Site and Architectural Review Committee did
not review this application, as there are no proposed changes to the exterior of the building or
site configuration.
Correspondence: An adjacent neighbor to the south of the project site objects to the operational
hours and the outdoor seating. Staff is of the opinion that the tenant space location along
Hamilton A venue with restricted hours of outdoor seating should mitigate any concerns
regarding adjacency to residential uses.

Starbucks Coffee Company at 330 East Hamilton Avenue, Campbell CA
To Whom It May Concern:
I wanted to take the opportunity to address the Planning Department with a Letter of Explanation
on behalf of my client Starbucks Coffee Company. Starbucks Coffee Company is truly excited
about this prime location at 330 East Hamilton Avenue in Campbell. This site has great visibility
and the new building being constructed will contribute positively to the vitality of Hamilton
Avenue and the surrounding community. We feel that our use will be a fine addition to this
neighborhood as well. Starbucks Coffee Company is a small coffee house that is company-
operated. We hire local residents and offer our partners (employees) great compensation and
incentives. We will schedule 4 employees per shift at our peak hours.
The existing Use Permit allows hours of operation from 7:00 am to 11 :00 pm all days of the
week. Hamilton Avenue is used by many residents in the surrounding area as a surface connector
as well as a convenient approach to the local freeway systems, and as such we would like to
propose earlier hours of operation to provide services to those early morning drivers, specifically
4:00 am all days of the week, though weekend opening times may be an hour or so later
depending on customer response. Also, weekend evenings in this community will support a later
closing time, so we are proposing a 12:00 am closing on Friday and Saturday nights. Additional
noise from these modified hours should be minimal, as the residential units on the adjacent
parcels are somewhat removed from the parking areas to be utilized by Starbucks patrons. Since
there is no cooking on site, we will have no hoods with blowers that can often create unwanted
noise for the neighborhood at early or late hours.
We feel that providing additional exterior seating in excess of that allowed by current planning
requirements (10% of interior seat count) will benefit the patrons of the center and the community
who want to take advantage of the spectacular Santa Clara County weather. The parking
assessment for the proposed exterior seating (12 regular seats and one accessible table/seat)
should not be an issue since the center was designed with loads of additional on site parking, in
excess of that required by city standards.
