The Fence Exception provides for an eight-foot tall fence along a portion of the southern (right side) and the eastern (rear) property line, where a six-foot fence is allowed. A letter of consent was signed by the adjacent affected property owner. The Community Development Director has determined that the requested Fence Exception: 1. Will not impair vehicular or pedestrian safety; 2. Will result in a more desirable site layout; 3. Will not be detrimental to the health, safety, peace, morals, comfort or general welfare of persons residing or working in the neighborhood of the change; and 4. Will not be detrimental or injurious to property and improvements in the neighborhood or to the general welfare of the City. Therefore, your request for a Fence Exception has been approved, subject to the following conditions of approval: 1. The development of the project shall substantially conform to the plans stamped as approved by the Community Development Director on April 10, 2006. Any modifications to the approved plans shall be reviewed and approved by the Director. 2. The Community Development Director, upon recommendation from the Director of Public Works, may approved a Fence Exception to allow lesser setbacks and heights greater than six- feet for fences, walls, lattice, and screens when it is determined that: 1. The change would not impair pedestrian or vehicular safety; 2. Would result in a more desirable site layout; 3. Would not be detrimental to the health, safety, peace, morals, comfort or general welfare of persons residing or working in the neighborhood of the change; and 4. Section 21.18060 of the Campbell Municipal Code requires a letter of consent from adjacent property owners, or affected property owners directly across the public right-of-way from the front yard and street yard fences, prior to approval of a Fence Exception.
