Public Hearing to consider the appeal by Mr. Robert Nicholas of the
Community Development Director's Administrative Decision approving a
second story addition to an existing residence on property owned by Eric and
Jennifer Colson located at 341 N. Harrison Avenue in an R-I-6 (Single Family
Residential) Zoning District. Staff is recommending that this project be deemed
Categorically Exempt under CEQA.
STAFF RECOMMENDATION
That the Planning Commission take the following action:
1. Remove this item from the agenda.
ENVIRONMENTAL DETERMINATION
Staff recommends that the Planning Commission find that this project is Categorically Exempt
under Section 15303, Class 3, of the California Environmental Quality Act (CEQA) pertaining to
the construction of a single-family residence in a residential zone.
Discussion
The appellant has requested that his letter of appeal be withdrawn. Staff had provided notice of
the appeal in the local newspaper and supports the removal of this matter from the agenda.

Dear Applicant:
Thank you for meeting with Jackie and myself on this date to discuss revisions to your plans to
minimize privacy concerns of your adjacent neighbor. As a result of this meeting, you have
indicated a willingness to make the following modifications:
1) Eliminate the window on the south elevation of bedroom No.3. and
2) Changing the window on the second story bathroom along the south elevation from a
2'0" x 3'0" to a 3'0" x 1 '0" (with obscure glass).
The Planning Division has reviewed your building permit submittal for the construction of a
residential addition and remodel of the residence on property located at 341 N. Harrison A venue.
The property is presently zoned R-I-6 (Single-Family Residential/6,000 square foot minimum lot
size) and was reviewed based upon the development standards of the R-I-6 zoning district and
the considerations outlined in section 21.42.040 (Site and Architectural Review) of the Campbell
Municipal Code.
Based upon this review the Community Development Director has conditionally approved your
addition, subject to the modifications described above and the revisions as outlined below:
1. Site Plan: The following revisions need to be made to the site plan:
a. Please show the distance from the centerline of the adjacent street to the property lines.
b. Please include any proposed or existing fencing. Provide the height, materials, and
location of the fencing.
c. Please illustrate the covered balcony on the site plan.
2. Elevations: The following revisions are recommended to the elevations:
a. Please indicate the height to roof peak as measured from the adjacent grade on the
elevations.

b. The front elevation depicts a covered balcony over the entrance. It is recommended that
a simpler decorative element be provided at this location that complements the building
design versus the large timber open truss design that is currently proposed.
3. Tree Protection Plan: Please provide a tree disclosure statement (enclosed) indicating that no
protected trees will be removed with the proposed construction. Protected trees include
redwood, cedar, oak or ash trees with a diameter of more than 12 inches.
