This code section sets forth the State's policy and requirements regarding the overconcentration of residential care facilities. It defines overconcentration as "facilities which are separated by a distance of 300 feet or less, as measured from any point upon the outside walls of the structures housing such facilities." The law requires the Director of the Department of Social Services to deny an application for license if the proposed facility is 300 feet or less from another residential facility unless approval is obtained from the city or county in which the facility will be located. The law also requires the Department of Social Services to notify the local agency 45 days in advance of approving an application for license. The local agency may request denial based upon overconcentration. X We have determined that the proposed facility is more than 300 feet from any other licensed residential home as defined by the Health and Safety Code. Therefore, should the referenced applicant meet other requirements for licensure, we will approve the application. Should your agency's review determine that the propnsed facility is 300 feet or less from another residflr.tial facility, please notify us within 45 days. D We have determined that the proposed facility is 300 feet or less from an existing facility. We remind you of your option to approve an exemption from the existing requirement based upon local needs and conditions. If you do not approve this exemption within 45 days, we will deny the application without further review. Please include the above facility identifying information in any correspondence regarding this subject. Thank you for your attention to this matter. Sincerely, cc: Applicant ( c. Application of Mr. Tim Dupic, on behalf of Sarah Care of Campbell, for an Administrative Planned Development Permit to allow the establishment of an adult day care facility in an existing commercial building located at 450 Marathon Drive in the P-D (Planned Development) Zoning District. PROJECT DESCRIPTION The project consists of the establishment of an adult day care facility in an existing commercial building located at 450 Marathon Drive. The proposed modifications include interior improvements to the proposed tenant space to accommodate the new use. BACKGROUND The subject property is developed with a single-story, multi-tenant, commercial building constructed in approximately 1977. There are currently three tenant spaces within the building and the other two spaces are occupied by a medical office and a fitness center. The subject tenant space was previously occupied by a professional office. The project site is located on the east side of Marathon Drive, between Gale Drive and West Hamilton A venue, and is surrounded by commercial uses to the north, east, and west and multiple-family residential to the south. ANALYSIS General Plan: The General Plan land use designation for the project site is Residential! Commercial/Professional Office and the proposed adult day care facility is compatible with this land use designation. PLN2006-79 - 450 Nlarathon Drive Administrative Planned Development Permit Page 2 of 2 Zoning: The zoning designation for the project site is P-D (Planned Development). An Administrative Planned Development Permit is required for a change of use in an existing building within the P-D zoning district. Use: The applicant's project description (Attachment #3) indicates that the adult day care facility would provide professional health care and recreation related services for senior adults during the day. No overnight stays are proposed as part of the business. The hours of operation would be from 7:00 a.m. to 6:00 p.m. daily and there would be a maximum of six employees and 45 clients. No exterior modifications to the building or the site layout are proposed with this application. Parking: The project site is currently developed with a total of 57 parking spaces. Chapter 21.28 (Parking and Loading) of the Zoning Code requires that a multi-tenant site provide the aggregate number of parking spaces required for each separate use. The parking requirements for the proposed use, in combination with the existing adjacent uses, would require a total of 53 spaces. Therefore, the existing parking provided on site exceeds the minimum requirement by four spaces. Attachments: 1. Findings for Approval of PLN2006-79 2. Conditions of Approval for PLN2006-79 3. PLN2006-79 SITE ADDRESS: APPLICANT: DATE: 450 Marathon Drive Tim Dupic, on behalf of Sarah Care of Campbell July 12, 2006 Findings for approval of an Administrative Planned Development Permit to allow the establishment of an adult day care facility in an existing commercial building located at 450 Marathon Drive. The Community Development Director finds as follows with regard to File No. PLN2006-79: 1. The development of the proposed project will result in a use that is consistent with the General Plan land use designation of Residential/Commercial/professional Office. 2. The project will be consistent with the P-D (Planned Development) zoning district with approval of an Administrative Planned Development Permit. 3. The project site is located on the east side of Marathon Drive, between Gale Drive and West Hamilton A venue, and is surrounded by commercial uses to the north, east, and west and multiple-family residential to the south. 4. The subject property is developed with a single-story, multi-tenant, commercial building constructed in approximately 1977. There are currently three tenant spaces within the building and the other two spaces are occupied by a medical office and a fitness center. 5. The proposed operational hours are from 7:00 a.m. to 6:00 p.m. daily and there would be a maximum of six employees and 45 clients. 6. The project site is currently developed with a total of 57 parking spaces. The parking requirements for the proposed use, in combination with the existing adjacent uses, would require a total of 53 spaces. Therefore, the existing parking provided on site exceeds the minimum requirement by four spaces. 7. No exterior modifications to the building or the site layout are proposed with the project. Attachment #1 Pa&e 2 of 2 8. The project qualifies as a Categorically Exempt project per Section 15303, Class 3 (New Construction or Conversion of Small Structures) of the California Environmental Quality Act (CEQA). Based upon the foregoing findings of fact, the Community Development Director further finds and concludes that: 1. The proposed development will result in a more desirable environment and use of the land than would be possible under any other zoning classification. 2. The development will be compatible with the General Plan of the City and will aid in the harmonious development of the immediate area. 3. The development will be compatible with the Zoning Code of the City. 4. The proposed development will not be detrimental to the health, safety or welfare of the neighborhood or the City as a whole. 5. The parking will adequately meet the demands generated by the change in use, and will not be detrimental to the overall parking and circulation in the area. 6. There is a reasonable relationship and a rough proportionality between the conditions of approval and the impacts of the project. 7. There is a reasonable relationship between the use of the fees imposed upon the project and the type of development project. 8. No substantial evidence has been presented from which a reasonable argument could be made that shows that the project, as currently presented and subject to the required conditions of approval, will have a significant adverse impact on the environment.
