Dear Applicant:
Thank you for your submittal of a Fence Exception application for a fence located at the
above referenced location. The Fence Exception provides for a six-foot, two-inch tall
wood fence on a one-foot, four-inch tall concrete block wall for a total height of seven-
feet, six-inches, where a six-foot fence is allowed. The fence is located along a portion of
the street side yard (northern) property line where a five-foot setback is required. A
letter of consent was signed by the adjacent affected property owners at 201 N. San
Tomas Aquino Road and 176 Calado Avenue and received by the Planning Division on
August 21, 2006.
The Community Development Director has determined that the requested Fence
Exception:
1. Will not impair vehicular or pedestrian safety;
2. Will result in a more desirable site layout;
3. Will not be detrimental to the health, safety, peace, morals, comfort or general
welfare of persons residing or working in the neighborhood of the change; and

4. Will not be detrimental or injurious to property and improvements in the
neighborhood or to the general welfare of the City.
Therefore, your request for a Fence Exception has been approved, subject to the
following conditions of approval:
1. The development of the project shall substantially conform to the plans stamped
as approved on August 31, 2006. Any modifications to the approved plans shall
be reviewed and approved by the Director.
2. The applicant shall obtain a Building Permit from the Campbell Building
Division for fencing over six-feet high.

To Whom It May Concern:
The purpose of this letter is to respond to our city violation letter dated
August 10,2006 from the Code Enforcement Officer. We are submitting a
Fence Exception Application with required documents in order to obtain a
Fence Exception Permit as recommended by Mr. Prosser.
The sidewalk is lower than the house. In order to build an aesthetically
pleasing fence, we built the fence to match the sidewalk setback and height
to match the neighbor's fence. Our existing fence is clean with no
obstructions that could impair the safety or comfort of any pedestrians or
vehicles.
We have improved our landscaping by building this fence as it has virtually
alleviated the Villarita Drive litter problem. Passersby utilized our
overgrown shrubs to discard fast food wrappers and additional trash. We
have trimmed the shrubs and keep this area clean daily which results in
enhancing the neighborhood safety and city appearance.
We sincerely apologize for building our fence without a permit. We were
not aware of the city regulation regarding the setback and height of our fence
until we received the violation letter citing "CMC Section 21.18.060(2) (Q
Fences, Walls, Lattice, and Screens.
