Campbell Avenue in a C-1 (Neighborhood Commercial) Zoning District. PROJECT DESCRIFrlON The project consists of the continued use of an existing telecommunications facility consisting of one ground mounted monopole/lightpole and associated ground-mounted equipment located at 1630 W. Campbell Avenue. The existing facility was approved by a Conditional Use Permit (UP96-17) on January 14, 1997 for a period of five years and expired on January 14, 2002. Since the approval in 1997, the City has adopted a Wireless Telecommunications Facilities Ordinance to address development standards and the processing of telecommunications facilities. Under the Wireless Telecommunications Facilities Ordinance, at the time an application is submitted to allow an existing facility to remain, the Community Development Director shall determine if the facility can be reviewed as a stealth facility and approved administratively as a Site and Architectural Review Permit. The Community Development Director has found that the existing facility is a stealth facility as defined in the Wireless Telecommunications Ordinance. DISCUSSION The facility consists of one 43-foot, 2-inch tall ground mounted monopole/lightpole with a light fixture mounted 18 feet, 8 inches above grade. Three flush mounted panel antennas are attached to the top of the pole. The associated ground mounted equipment cabinets are located within an existing trash enclosure across the driveway from the monopole and are not visible to the public. The facility is unmanned and operates 24 hours a day, seven days a week. The facility is serviced approximately once every 4-6 weeks or in the event of an emergency, such as a power outage. The continued operation of the existing facility will not have an effect on parking and no additional parking is required. The maximum height allowed in the C-1 Zoning District is 35 feet. The applicant has submitted supplemental documentation to demonstrate how the lowering of the monopole from 43 feet, 2 inches to 35 feet would result in a compromised coverage area. The antennas need to maintain their existing height to continue to provide reliable, seamless coverage in the area due to physical obstacles that would impair the signal if the antennas were lowered. The proposed project as conditioned will aid in the harmonious development of the immediate area. ° The establishment, maintenance or operation of the use, as conditioned, will not be detrimental to the health, safety, peace, morals, comfort, or general welfare of persons residing or working in the neighborhood of such proposed use, or be detrimental or injurious to property and improvements in the neighborhood or to the general welfare of the City. ° The site is of adequate shape and size to accommodate the stealthing required in order to integrate the telecommunications facility with uses in the surrounding area. The lead department with which the applicant will work is identified on each condition where necessary. Length of Permit Term: This Site and Architectural Review Permit shall expire five years after permit approval, on April 21, 2008. If the use is to continue, the applicant shall apply for a new permit for an additional five-year period. If technological improvements or developments occur which allow the use of materially smaller or less visually obtrusive equipment at this time, the service provider will be required to replace or upgrade the approved facility upon application for a new Site and Architectural Review Permit application to minimize adverse effects related to land use compatibility, visual resources, public safety or other environmental factors. Maintenance of Finish: It is an ongoing obligation of Sprint PCS, assignees and successors in interest to maintain the exterior finish of the monopole, antennas and equipment enclosure in good order. Faded, peeling or damaged paint shall be repainted as soon as practical. 4. Maintenance of Landscaping: It is an ongoing obligation of Sprint PCS, assignees and successors in interest to maintain the landscaping required as part of this permit. Cessation of Operations: The service provider shall provide written notification to the Director upon cessation of operations on the site exceeding a 90-day period. New Permit Required: If a consecutive period of 180 days has lapsed since cessation of operations, a new Site and Architectural Review Permit shall be required prior to use or reuse of the site. Utilities: All new on-site utilities shall be installed underground per Section 20.36.150 of the Campbell Municipal Code for any new or remodeled buildings or additions. Applicant shall comply with all plan submittals, permitting, and fee requirements of the serving utility companies. Cables: All external cables or equipment shall be obscured from public view by enclosing them in architecturally designed cabinets/enclosures painted to match the structure. Compatibility With City Emergency Services: The facility shall not be operated, nor caused to transmit on or adjacent to any radio frequencies licensed to the City for emergency telecommunication services such that the City's emergency telecommunications system experiences interference. Lighting: The use of lighting shall not be allowed on telecommunication facilities unless required as a public safety measure. Where lighting is used, it shall be shielded to prevent glare on adjacent uses. No Advertising: No advertising signage or identifying logos shall be displayed on wireless telecommunications facilities, except for small identification plates used for emergency notification or hazardous or toxic materials warning. Noise. The telecommunication facility, including power source, ventilation and cooling facility, shall not generate noise discernible beyond the property lines. Back-Up Generators: Back-up generators shall comply with the noise standard referenced above and shall only be operated during power outages or for testing and maintenance between the hours of 8:00 a.m. and 5:00 p.m., Monday through Friday. Heat Generation: The wireless telecommunication facility, including power source and cooling facility, shall not be operated so as to cause the generation of heat that adversely affects any building occupant. Odors: The testing of back-up generators shall not produce odors that adversely affect the public. Maintenance Hours: Normal maintenance activities shall only occur between the hours of 7:00 a.m. to 5:00 p.m. Monday through Saturday, excluding emergency repairs. Safety: ao Public Access Restricted: Antennas are to be sited in such a way and barriers and signage provided to prevent a person from passing within the safety limits established by the FCC-adopted standards for controlled access. bo Warning Signs: Signage shall be maintained at the facility identifying all wireless telecommunication facility equipment and safety precautions for people nearing the equipment as may be required by any applicable FCC- adopted standards, including the RF radiation hazard warning symbol identified in ANSI C95.2-1982, to notify persons that the facility could cause exposure to RF emissions. Co Emissions Conditions: It is a continuing condition of this authorization that the facilities be operated in such a manner so as not to contribute to ambient RF/EMF emissions in excess of then current FCC adopted RF/EMF emission standards; violation of this condition shall be grounds for revocation. do Periodic Safety Monitoring: The wireless telecommunications service provider shall submit to the Community Development Director 10 days after installation of the facilities, and every two years thereafter, a certification attested to by a licensed engineer expert in the field of EMR/RF emissions, that the facilities are and have been operated within the then current applicable FCC standards for RF/EMF emissions. The report shall be written in plain English. e° Emergency Contact: The service provider shall provide signage as required, including phone numbers of the utility provider, for use in case of an emergency. Campbell Ave. Dear Mr. Burke: Thank you for your submittal of a Conditional Use Permit application for the continued use of an existing Sprint cellular facility located at 1630 W. Campbell Avenue. Pursuant to the Campbell Telecommunications Ordinance, upon application to allow an existing facility to remain, the Director shall determine if the design or changes in design, location, or configuration allow review as a stealth facility. If so, the application may be approved administratively as a Site and Architectural Review Permit and must comply with all provisions of the Telecommunications Ordinance. The Director has determined that the existing facility is a stealth facility and can be approved administratively as a Site and Architectural Review Permit. However, the existing monopole exceeds the maximum height limit of 35 feet allowed in the C-1-S Zoning District. The Telecommunications Ordinance requires that all monopoles not exceed the maximum height limit allowed for buildings in the zoning district in which it is located. Applications for monopoles that exceed the maximum height limit must submit a supplementary report and supporting technical documentation as to why the height requirement cannot be met. This documentation will be required to approve this application. Additionally, the existing monopole's paint is in poor condition and is peeling. The monopole will need to be re-painted the same color as was previously used, prior to the Site and Architectural Review Permit being approved. Your application has been deemed incomplete. Campbell Ave, Campbell, California Kirkwood Shopping Center Sprint Site FS04xc156 - Kirkwood Sprint Spectrum LP, doing business as Sprint PCS has been authorized by the Federal Communications Commission under file number 00005-CW-L-95 to construct, operate and maintain a wireless communications network in the greater San Francisco Bay Area. Operating between the 1850-1945 Mhz bandwidth. Sprint PCS is currently expanding its footprint to enhance both existing facilities and provide additional coverage in the Campbell/San Jose area. Continual increase in Sprint's customer subscriber base of individuals, local businesses, commuters, public and quasi-public agencies, and other users has led to the need for coverage, and the immediate need to relocate an existing site. Sprint PCS currently operates a cell site at 1630 West Campbell Avenue, Campbell California in the Kirkwood Shopping Center which provides coverage in downtown Campbell and the surround business and residential districts on Prospect, Hamilton and Quito Roads. The site has been located in this shopping center since 1997 and recent changes in the city ordinance regarding wireless communications facilities have prompted resubmission of this use permit. The current site's permit expired in January of 2002. The site is located in the rear of the 3.4-acre parcel number 403-02-053 located off of Whitwood Lane. The current design is a 43' monopole/lightpole, with a light standard located at the 18' level on the pole. The existing antennas are flush mounted 4' panel antennas that have been designed to blend in with the pole. The equipment is located adjacent to a trash enclosure, 100' from the pole, and is enclosed behind an 6' high CMU wall. The equipment consists of 5 each radio and utility interconnect cabinets, with expansion space for up to a total of seven in an approximate 300 square foot, irregular shaped compound. The equipment cannot be seen from outside the wall and the adjacent commercial building is approximately 20' high. The current uses in the area are a mixture general commercial, retail and office space In keeping with the desire to utilize existing infrastructure and vertical elements whenever possible, Sprint PCS constructed this site with the design of a lightpole to blend in as much as possible with the surrounding uses on the property. The current uses on the property are consistent and compatible with the ongoing operation of the Sprint PCS cell site. The site is located at the rear of the existing buildings, and does not create a visual impact from the front of the parcel. No modifications to the existing permit have been made that create an increased visual impact on the parcel or site, and the site remains in compliance with the original approval. The facility is unmanned and operates 24 hours per day, seven days a week. The cabinets are environmentally controlled, and do not require any other services other than power and telephone connections. Access to the facility will be through the parking lot off of Whitwood Avenue and will be serviced once approximately every 4-6 weeks, or in the event of an emergency such as a power outage. No additional parking area will be required, or taken out of service from the existing parking requirement. This telecommunications site require no city services, create only a negligible amount of noise from cooling fans, give off no fumes or odors, are secured behind a CMU wall to prevent unauthorized access and alarmed to Sprint PCS's central switch office. This site is designed to provide seamless coverage in the greater Campbell / San Jose area. It allows for smooth handoffs and transition of calls from one cell to another, and allows cell sites that are currently at capacity to operate more efficiently in the processing of voice and data transference. The loss of the site would create a hole in the network that would reduce coverage reliability, increase dropped calls and diminished call capacity. This would have an impact on both private and public sectors, as both rely on the Sprint PCS network. Given the heavy call volume from similar type downtown and commercial areas, this site remains critical to a maintaining the already established 5-year old wireless network. - Sprint Sprint PCS' JUSTIFICATION FOR MAINTAINING CURRENT HEIGHT Sprint PCS currently operates a wireless telecommunications facility at 1630 West Campbell Avenue. The pole is a 43' high combination antenna light pole located to the rear of the parcel. The current height limitation in this zoning district is 35', or 8' below what currently exists. This antenna needs to maintain the current height in order to continue to provide reliable, seamless coverage in the area mainly due to physical obstacles that would impair the signal if the antennas were lowered. The main concern is reflection of the signal off the roof of the adjacent buildings. When antennas are either at building height, the signal is unable to adequately be dispersed across the rooftop, and thus suffers signal degradation. In effect, the rooftop absorbs signal strength and weakens the transmission. As a result, the signal travels less, and creates holes in the network designed to be covered by this site. When the antennas are adequately above the rooftop by a factor of 5', it allows for no reflection, strong signal impulses, and thus an enhanced coverage capacity. The enclosed map will show that when modeled at 35', the system shows a number of weakened areas (highlighted in blue) where calls are either dropped, or unable to be carded in vehicles or buildings. While the color variation may seem minor, the fact is that any black or red coverage noted the dropping of a call, from which the signal is unable to recover. As a result, the signal fails, and the network is compromised. The second enclosed map showing the existing height provided the required coverage to carry and handoff calls to and from this cell site, and thus provide the seamless and reliable network. The site currently operates in this environment very well, and does not suffer the signal degradation a lowered height would cause.
