Central Avenue - Guiseppe's Dear Ms. Bem: The Planning Division has reviewed the your application for a Conditional Use Permit to allow live entertainment and late night hours in conjunction with the restaurant at 33 S. Central Avenue. In effect, your request is to operate a nightclub in addition to the restaurant that includes the sale of liquor without food services, dancing and live entertainment. The granting of a Conditional Use Permit for this kind of change of use would require approval by the Planning Commission and would be decided upon at a public hearing. The subsequent Live Entertainment Permit application that is processed by the Police Department would be considered by the City Council after the Planning Commission's consideration of the Conditional Use Permit. Your application was routed for review by staff. Based upon this review, staff has concluded that approval of a Conditional Use Permit will not be recommended to the Planning Commission due to a conflict with the goals and objectives of the Downtown Development Plan and the Redevelopment Agency's Five Year Implementation Plan. A goal of this plan is to maintain a balance of retail and restaurant uses in the downtown area. The conversion of the restaurant into a nightclub for after hours use increases the concentration of live entertainment permits within the downtown. The addition of an entertainment use after 10:00 p.m. is not viewed as ancillary to the existing restaurant use and consequently is not supported as a desirable balance of uses in the downtown area. The Central Business District allows limited live entertainment in conjunction with a standard restaurant as a permitted use without a Conditional use permit. A copy of this zoning District is enclosed for your information. If you wish to withdraw your application at this time, we will recommend that your application fee be refunded. If you wish to still pursue your request with a negative staff recommendation you may do so. Based upon review of the submitted application, the application has been deemed incomplete. Central Ave. Project Application: PLN-2003-00116 RECOMMENDATION: Note: No building code issue has been reviewed at Development Review Committee; it will be reviewed in the Building Permit process. Please be aware that building codes are changing constantly; plans submitted for building permit shall comply with the code in effect at that time. Submit permit application together with required documents to the Building Inspection Division to obtain a building permit. No construction can be commenced without an appropriate building permit. It is recommended that this item be forwarded to the Planning Commission for review, with the following conditions. TO THE SATISFACTION OF THE BUILDING DIVISION MANAGER/BUILDING OFFICIAL: PERMITS REQUIRED: A building permit application shall be required for all interior modifications to the space. Plans submitted with this application reflect significant changes to the space from previous restaurant use. The building permit shall include Electrical/Plumbing/Mechanical fees when such work is part of the permit. CONSTRUCTION PLANS: The conditions of Approval shall be stated in full on the cover sheet of construction plans submitted for building permit. SIZE OF PLANS: The minimum size of construction plans submitted for building permits shall be 24 in. × 36 in. PLAN PREPARATION: This project requires plans prepared under the direction and oversight of a California licensed Engineer or Architect. Plans submitted for building permits shall be "wet stamped" and signed by the qualifying professional person. SITE PLAN: Application for building permit shall include a competent site plan that identifies property and proposed structures with dimensions and elevations as appropriate. Site plan shall also include site drainage details. Site address and parcel numbers shall also be clearly called out. Site parking and path of travel to public sidewalks shall be detailed. o TITLE 24 ENERGY COMPLIANCE: Califomia Title 24 Energy Standards Compliance forms shall be blue-lined on the construction plans. Compliance with the Standards shall be demonstrated for conditioning of the building envelope and lighting of the building. Section 1701, the architect or engineer of record shall prepare an inspection program that shall be submitted to the Building Official for approval prior to issuance of the building permits, in accordance with U.B.C Section 106.3.5. Please obtain City of Campbell, Special Inspection forms from the Building Inspection Division Counter. The City of Campbell, standard Santa Clara Valley Non-point Source Pollution Control Program specification sheet shall be part of plan submittal. The specification sheet (size 24" X 36") is available at the Building Division service counter. TITLE 24 ACCESSIBILITY - COMMERCIAL: On site general path of travel shall comply with the latest California Title 24 Accessibility Standards. Work shall include but not be limited to accessibility to building entrances from parking facilities and sidewalks. 10. P.G.& E.: Applicant is advised to contact Pacific Gas and Electric Company as early as possible in the approval process. Service installations, changes and/or relocations may require substantial scheduling time and can cause significant delays in the approval process. We would like to be able to use our restaurant until 12:00 a.m. on weekdays and 1:30 a.m. on weekends to serve liquor and appetizers and provide entertainment With the economy downturn, we need to use other avenues to make our restaurant successful. We have been established for eleven years now and have become pat of the City of Campbell. We have obeyed all City ordinances and would appreciate your consideration for the Use Permit. There will be four to six employees on the night shift. We have approximately 61 spaces in our immediate parking lot and feel that would be plenty for our patrons.
