THE CITY OF CAMPBELL GRANTING A SIGN PERMIT (PLN2002-

After notification and public heating, as specified by law, and after presentation by the
Community Development Director, proponents and opponents, the hearing was closed.
After due consideration of all evidence presented, the Planning Commission did find as follows
with respect to application PLN2002-23:
1. The proposed sign is architecturally compatible with the building in terms of style and
design.
2. The proposed size is proportional to the buildings and other industrial buildings in the
neighborhood.
3. The site is unusually difficult to locate in comparison to similar uses due to the location of
the meeting hall on the rear portion of a flag lot and the limited street frontage and visibility.
4. The business would not be adequately identified with only a wall sign due to the proximity of
the building to the street frontage and its limited visibility.

The installation of a changeable reader board would not create an undesirable precedent for
all commercial uses since this is a non-profit charitable organization located on property
within an industrial area. The applicant has demonstrated that the meeting hall use is largely
dependent upon this reader board to advertise their current activities and events.
6. The project is determined to be categorically exempt project under Section 15303, Class 3(e)
of the California Environmental Quality Act (CEQA), installation of small structures and
accessory structures; therefore, no environmental action is required.
Based on the foregoing findings of fact, the Planning Commission further finds and concludes
that:
1. The proposed sign, as conditioned, is consistent with the purposes of the Sig-n Ordinance by
preserving and improving the visual character of the community.

The use for which the sign is to be erected would not be adequately identified and is
unusually difficult to locate in comparison to similar uses without exceeding the standards of
the Sign Ordinance.
3. The proposed signs will not be detrimental to the public welfare or persons in the
neighborhood or the City as a whole and allows for reasonable business identification.
4. There is a reasonable relationship and a rough proportionality between the Conditions of
Approval and the impacts of the project.
NOW, THEREFORE, BE IT RESOLVED that the Planning Commission approves a Sign Permit
to allow the installation of a new off-site readerboard sign on property owned by Daniel
Falkenstein and Samuel Chin at 1350 Dell Avenue, subject to the following conditions:
Where approval by the Director of Community Development, City Engineer, Public Works
Director, City Attorney or Fire Department is required, that review shall be for compliance with
all applicable conditions of approval, adopted policies and guidelines, ordinances, laws and
regulations and accepted engineering practices for the item under review. Additionally, the
applicant is hereby notified that he/she is required to comply with all applicable Codes or
Ordinances of the City of Campbell and the State of California that pertain to this development
and are not herein specified.

Planning Division:
Approved Plans: Approval is granted for an exception to the sign regulations to allow an off-
premise freestanding sign on property located at 1350 Dell Avenue to identify the American
Legion Post at 1344 Dell Avenue. Plans submitted for building permits shall substantially
comply with the plans as submitted by the applicant, except as herein modified by the
Planning Commission. The total sign area for the sign shall not exceed 50 square feet and 9
feet in height as measured from finished grade.
2. Revised Plan: The applicant shall submitted a revised sign plan for review and approval of
the Community Development Director indicating the following changes:
a. A reduction in the sign height to 9 feet
b. Sign location to be setback 18 feet from the street property line and a minimum of 10 feet
from the north property line.
c. Sign base to include the address of the American Legion Post.

Building Division:
Permits Required: A building permit application shall be required for the proposed signs.
The building permit shall include Electrical/Plumbing/Mechanical fees when such work is
part of the permit. Prior to performing any work, the applicant shall make application to, and
receive from, the Building Division, all applicable construction permits.

STAFF REPORT - PLANNING COMMISSION MEETING OF
May 14, 2002
Hearing to consider the application of Commander Ernest Glave on behalf
of West Valley Memory Post 99 - American Legion for approval of a Sign
Exception (PLN 2002-23) to allow the installation of an off-premise
freestanding sign on property located at 1350 Dell Avenue in a C-PD
(Condominium - Planned Development) Zoning District.
STAFF RECOMMENDATION
That the Planning Commission take the following action:
Adopt a Resolution, incorporating the attached findings, approving a sign exception (PLN
2002-23) allowing an off-premise freestanding sign, subject to the attached Conditions of
Approval.
ENVIRONMENTAL DETERMINATION
Staff recommends that the Planning Commission determine that the project is categorically
exempt under Section 15303, Class 3(e) of the California Environmental Quality Act (CEQA),
installation of small structures and accessory structures; therefore, no environmental action is
required. This application was deemed complete on April 16, 2002.

DISCUSSION
Applicant's Proposal: The applicant, Mr. Ernest Glave, on behalf of American Legion Post 99, is
requesting approval of a Sign Exception (PLN 2001-23) to allow the installation of a new off-
premise freestanding sign adjacent to their driveway entrance on Dell Avenue. The American
Legion Post 99 operates a meeting hall facility on the rear portion of a flag lot adjacent to the

project site. The flag lot has 25 feet of frontage along Dell Avenue that is improved with a 20
foot wide driveway. The driveway and limited street frontage makes the placement of a visible
freestanding sign on the applicant's property difficult.
The project site is an adjacent office/industrial building developed with a two-story building that
is identified by a freestanding sign in the center of the property. The applicant is proposing the
placement of the sign near the northern boundary of this property.
Background: The existing American Legion Post is identified with a smaller monument sign that
was approved in 1991. This sign is situated in the public right-of-way and a future sidewalk area.
The applicant at this time is requesting approval to replace this sign on the parcel adjacent to the
driveway and just south of the entrance.
The project site is located on the east side of Dell Avenue just south of its intersection with
Hacienda Avenue.
ANALYSIS
Sign Proposal: The proposed freestanding sign will be installed in the lawn area just south of the
entrance to the American Legion Post along Dell Avenue. This location is not on the flag lot
parcel occupied by the American Legion, but is on the adjacent industrial site just south of their
driveway.
Design: The proposed freestanding sign measures 5 feet x 10 feet (50 square feet) with a height
of 14 feet. The double faced sign accommodates a horizontal panel identifying the "American
Legion Post 99", the American Legion emblem, and a changeable reader board. A texture coated
pole and cover is shown for the sign base.
Sign Requirements: Under Section 21.53.090(D) of the Sign Ordinance a commercial or
industrial business is permitted one wall sign and identification on an on-premises freestanding
sign. Each business is permitted one square foot of sign area for each linear foot of business
frontage, with a maximum sign area of 50 square feet and a minimum sign area of 20 square feet.
Under these provisions, the applicant would be allowed one 50 square foot wall sign and
identification on a 50 square foot freestanding sign. This signing request is before the Planning
Commission because it is not located on the premises of the American Legion and it has a
changeable reader board.
Sign Exceptions: The Planning Commission may authorize additional signs when it determines
the following:
· The use or uses for which the signs are to be erected would not be adequately
identified; or
· The site is unusually difficult to locate in comparison to similar uses without
exceeding the standards provided in the Sign Ordinance.

Staff Analysis:
Staff finds that the location of this facility on a flag lot limits its visibility and consequently an
off-premise signs is warranted. A changeable reader board is not recommended by staff because
such an approval creates an undesirable precedent. Consequently, staff is recommending the
following:
· A reduction in the sign height to 9 feet;
· A change in the reader board portion of the sign to a permanent sign panel identifying
"Banquet/Meeting Facilities;"
· The provision of a street address on the base of the sign; and
· The provision of an 18 foot setback to the curb or 10 foot setback to the street property
line to ensure pedestrian and vehicular visibility.
Site and Architectural Review Committee: The Site and Architectural Review Committee
reviewed the proposed project at its meeting of April 23, 2002 and was supportive of the
proposed signing with the replacement of the reader board portion with a permanent sign and a
reduction in the sign height per the Staff's recommendation.

Dear Ms Stephanie,
Being a non-profit organization 501 (c) 19 of past and presem members of the
U.S. Armed forces. The first thing we (Post 99) do is help Veterans and their families in
need. Post members also volunteer at the local VA Hospitals and clinics as well as the
local U.S.O'S.We also participate in patriotic events such as parades etc. Post 99 is also
involved with children and youth by Sponsoring youth activities to name a few such as I
list here.
(a) We sponsor the JRROTC programs at (4) high schools.
(b) We sponsor boys to the boys state program.
(c) We sponsor students to the American Legion high school Oratorical program
(where they can win scholarships).
(d) We sponsor youth sports such as a baseball team and will be adding soccer in the near
future.
We rent our hall and also have fund raisers to help defray the. cost of all of the
above activities.
Post 99 is also a member of the Campbell Chamber of Commerce so that we can
be more active within the Campbell community.
We are enclosing a copy of our Bylaws and a couple of American Legion
Brochures. The American Legion was Chartered by the U.S. Congress on Sept. 16, 1919.
