Rice: Thank you for your request wherein you describe your organizations desire to buy and occupy an existing office building on the referenced property. Based upon the description of your proposed use, your activities appear to be similar to the use of the building as a counseling office versus that of a traditional church. Due to the size of your organization (16-20 members) and the primary activities such as counseling and office uses, the Community Development Department considers your proposed use to be a professional office. The referenced property is located in a P-O(Professional Office) zoning district. This zoning district list professional offices as a permitted use subject to approval of a site and architectural application. A site and architectural application was previously approved for the construction of this office building on this property. The establishment of a church use on this property is not listed as a permitted use nor a use allowed, subject to obtaining a use permit under the P-O (Professional Office) Zoning District. Church uses are permitted in a P- F(Public Facilities) Zoning District zoning district with a conditional use permit. Therefore, a church requires approval of a zone change and general plan amendment at this location. Such land use changes generally are not considered on a an individual lot basis and would require a significant review process. Please obtain any necessary building or electrical permits for any interior building improvements, if you wish to proceed with this office occupancy. We maintain an office and a meeting room there under a conditional use permit from the city of San Jos6. Having operated successfully and congenially at that location for three years, we have decided to purchase a building and move our offices this year. We would like to buy and occupy the building at 1136 East Hamilton in Campbell (APN: 288-011-037) and modify it to our use. Its small size suits the needs of our small community, and its location facilitates access by our more distant members. We Are Small We are a very small church, comprising sixteen members, including four children. We have been incorporated for nearly twenty years, and have maintained a community in San Jos6 for fifteen years. During that time our membership has not exceeded eighteen, including children. We Are Widely Distributed While our office and meeting room are located in San Jos6, our community covers a large geographic area. Only seven of our members live in San Jos6 proper. Four live in Milpitas, one lives in Campbell, our southern-most family lives in Monterey, and our northern-most member travels from Oakland. This membership has been stable for more than fifteen years. We Are Unobtrusive We do not proselytize, our religious meetings are simple and quiet, and we emphasize personal religious growth rather than exuberant group worship. As a result, our presence has not been an inconvenience to our neighbors. How We Operate During our normal operating hours, from 9:00 a.m. to 5:00 p.m. on weekdays, our office is occupied by our pastor, who is our sole employee. During those hours, he may counsel one or two people at a time. Up to four times per month, we have after-hours meetings from 6:30 p.m. until about 10:00 p.m. These are attended by up to six members, including our pastor. Five or six times each year we have Saturday classes from 11:00 a.m. until 5:00 p.m. These are usually attended by eight or nine members, including our pastor. What We Want to Do We want to buy the 2210 square foot building at 1136 East Hamilton and convert part of the first floor to conference room use. (SEE: The accompanying drawings) This room will be smaller than the one we presently use, but we find that what we currently have is more than we really need for our meetings. The proposed room can contain a maximum of twenty-four chairs, but will usually be set up for sixteen. The rest of the area will be used as a storage and utility area. We intend to leave the remainder of the building as it is, continuing two of the upstairs offices as leased units, while using the third office ourselves. The net effect is to reduce the current business-hour occupancy of the building by two offices. Our own meetings occur outside normal business hours, and our lease agreements with tenants will define normal business hours as being from 6:00 a.m. to 6:00 p.m. Mondays through Fridays. Parking Impact Accordingly, we will not exceed available on-site parking, either during business hours or during our meeting hours, because they do not overlap. Based on past experience, we expect to to operate with a parking surplus. In our present location, the most parking we have needed )or any meeting has been seven spaces. We would like you to make a preliminary review of our proposed use and let us know if it will be permitted under the City of Campbell's conditional use requirements.
