PLANNING DEPARTMENT Approved Project: Approval is granted for a Tentative Parcel Map allowing the creation of two (2) single family lots on property located at 1147 Hazel Avenue. The map shall substantially conform to the map prepared by Harry Babicka of Westfall Engineers, Inc. dated 2/25/97, and as received by the Planning Department on March 3, 1997, except as may be modified by the Conditions of Approval herein. Buildin~ Setbacks: Any portions of structures which do not meet the required setbacks of the zone (R-I-S) shall be removed prior to the final Parcel map recordation. Demolition work shall be done in such a way that no damage occurs to trees on the site, including no consolidation of the soil under the trees due to heavy equipment, which would remove oxygen from the soil, and thus to the tree roots. ..' Property Maintenance: The property shall be maintained free of any combustible trash, debris and weeds, until the time that actual construction commences. All vacant existing structures shall be secured by having ~vindows boarded up and doors sealed shut, or be demolished or removed from the property. 5. Park In-Lieu Fee: Applicant to pay a fee in-lieu of park dedication prior to recordation of the final subdivision map ($8,242.50 per additional parcel). 6. Building Approval: Approval of a Site and Architectural Review Permit by the Planning Commission is required for any new residences on these parcels. Tree Report: A report by a licensed arborist shall be submitted to the City as part of any development application for either parcel. The report shall survey the health and characteristics of the trees on the site. No trees are to be removed prior to approval of a development plan for the site, which shall determine which trees are to be retained. The current application fee for a final map is $1,110. 10. Title Report: The applicant shall provide a current title report. 11. Parcel Map Recordation: The Parcel Map must be recorded prior to issuance of any grading or building permit for construction of new houses. 12. Monumentation: Prior to recordation of the Final Parcel Map, the applicant shall provide secmdty guaranteeing the cost of setting all monuments as shown on the final parcel map. 13. Standard Street Improvements HAZEL AVENUE is classified as a minor collector and street improvements will be required. Prior to issuance of any grading or building permits for this site, the applicant shall prepare plans, pay fees, post securities, and provide insurance as required to obtain an encroachment permit to construct public street improvements as required by the City Engineer. Public street improvement plans shall be prepared by a registered Civil Engineer licensed in the State of California, and shall include the following: a. Concrete curb and gutter installed 20 feet from centerline including the curb return on Pecan Way. b. Asphaltic concrete pavement from concrete gutter to centerline plus additional width to conform to existing pavement. c. A 4.5 foot sidewalk adjacent to the curb. d. Street trees and irrigation at about 40 feet on center installed behind the sidewalk. e. Intersection improvements on Hazel Avenue and Pecan Way. A topographical survey is needed to determine the scope of the work. f. It appears existing street lighting may be in conformance with the City's Street Lighting Policy. This will need to be verified. PECAN WAY is classified as a minor local access street. The right of way and street improvements are consistent with other improvements in the block. Soils Report: The applicant shall provide a soils report prepared by a registered Geotechnical or Civil Engineer in order to determine the structural section of the pavement. Storm Drain Area Fee: Prior to issuance of any grading or building permits for the site, the applicant shall pay the required storm drain area fee of $2,000 per acre. Grading and Draina~,e Plan: Prior to issuance of any grading or building permits, the applicant shall conduct hydrology studies, as necessary, prepared grading and drainage plans, and pay fees required to obtain necessary grading permits. Underground Utilities: All new on-site utilities shall be installed underground per Section 20.36.150 of the Campbell Municipal Code for any new or remodeled buildings or additions. Applicant shall provide evidence fi.om all utility companies that the application as proposed can be served. Applicant shall comply with all plan submittals, permitting, and fee requirements of the serving utility company. Applicant shall submit a Utility Coordination Plan and Schedule for approval by the City Engineer for installation of all utilities. The plan shall minimize the damage to Bedal Lane and all public improvements. CITY OF CAMPBELL Community Development Department December 26, 1996 Babette Baes 947 West Campbell Ave. Campbell, CA 95008 FAX: 379-1726 Subject: Pre-application comments regarding proposed 2 lot division of 1147 Hazel Ave. (APN 406-02-063) Dear Ms. Baes, The members of the Development Review Committee examined the plan submitted, and present the following preliminary comments. The diagram submitted had no scale and an examination of an aerial indicates that the proportions of the buildings are inaccurate. Not all of the buildings are indicated, nor are their uses. Therefor the following comments are preliminary. Planning Department The division of land should not result in the creation or aggravation of Zoning or Uniform Building Code non-conformities, nor should it prohibit the ability of any existing non- conformities from being ameliorated. Separate from this, the Planning Department must pursue any Building or Zoning Code violation it encounters in reviewing a formal application. 1. Parking The existing lot is of a size which could accommodate the minimum parking arrangement required by code, one covered and one uncovered parking space per dwelling unit. A two car garage is an expected amenity and the more common single family house feature. The question is, "Could the division result in difficulty in providing the parking required by code, and/or could it result in a future request for a variance to build a two car garage.within setbacks?" Any application submitted would be wise to indicate how this would be addressed. It appears from aerials in City files that a carport has been added to the rear of the building since 1988. The City has no record of a permit for the carport, and it appears to be located within the required rear setback. F^X408.866.8381 ' TDD408.866.2790 Page 2 Zoning Code requires a minimum of 25' between the face of garage or carport and the property line, to allow for off-street parking. Setbacks This property is within the San Tomas Neighborhood, and is thus subject to all standards in the adopted Plan for that area. The required rear setback is 20'. As the front door and address are on Hazel Avenue, the front of the lot is considered to be the wide portion facing Hazel. Portions of the house fall within the rear 20' setback. Records indicate that the house was built in 1940 in the County. Aerials indicate that, except for the carport, all buildings existed in their present outline in 1976. The County should have building records which can establish if a building had a building permit, and thus whether it is now legally non-conforming. A legal non-conforming building does not need to be changed to meet code unless it is substantially destoyed. Park Fees The park impact fee for the creation of a new lot shall be paid prior to recordation of the parcel map. The in-lieu fee will be $10,990.00. Public Works Department 4. The hearing will be to consider the following project: ADMINISTRATIVE PUBLIC HEARING: Application of Ms. Rachel Frame and Ms. Babette Baes for a parcel map (PM 97-03) to divide property at 1147 Hazel Avenue into two parcels. This project is Categorically Exempt, under the California Environmental Quality Act. FUTURE HEARINGS: Architectural Approval: The specific design and proposal for the construction of single family homes on this site will require approval of a Site and Architectural Application which is considered before the Planning Commission at a Public Hearing.
