We have researched our files and present the following information in the mann r in which it was requested: 1. The subject parcels have a General Plan Land-Use designation of Genera Commercial and are currently zoned General Commercial (C-2-S). Development is subj ct to the site development standards of this Zoning District, which is included for your re erence. Please note: these parcels are not located in the Planned Development P-D) Zoning District, and therefore were not developed pursuant to a Planned Developm nt Permit. 2. The Overlay District has not been applied to the subject parcels. 3. The subject properties are improved with a commercial retail center (Pa cell - APN 288-11-059) and an auto-oriented service center (Parcel 2 - APN 288-11- 58), recently approved for demolition and redevelopment, see below. These land-uses ar permitted in the General Commercial (C-2-S) Zoning District. 4. Our office does not possess the original approval documents for the H milton Plaza shopping center, as its development predates our Department's record. The most recent Site and Architectur I approval, for an expansion and remodel of the center, was granted in 1990. This appr val, which succeeds previous Site and Architectural approvals, allowed for a significant r model and expansion of the shopping center resulting in its current configuration. lnclud d with this letter are Planning Commission Resolutions No. 2671 and 2674, which codifi d the 1990 Site and Architectural approval, and associated staff reports. Please note it is City policy not to release or provide copies of approved site plans, as they are subject t copyright restrictions. Parcel 2 (APN 288-11-058) of the development site was recently subject 0 Site and Architectural permit allowing demolition of an existing auto-oriented servic center and construction of new commercial retail building. Planning Commission Res lution No. 3881, and the associated staff report are included for your reference. 5. The subject parcels are currently surrounded by the following Zoning Distr'cts/General Plan Land Use designations: . North: City of San Jose - Commercial retail building. . South: Planned Development (P-D) - General Commercial . East: Multiple-Family Residential (R-2-S) - Medium Density Reside units/Gr. Acre) . West: Planned Development (P-D) - Commercial/Prof. Office/Resid ntial (up to 27 units/Gr. Acre) 6. There is one active Code Compliance case (COD 2007-00172) for ge eration of excessive noise in the parking lot in violation of the City's Noise Ordin ceo Code Compliance questions may be directed to the Code Enforcement Officer at (408) 866- 2760. 7. No Variances have been issued for the subject parcels. Conditional Use ermits, for specific uses (not for the establishment of the shopping center itself) have be n approved for existing and defunct business establishments. You may request the Use P rmit status of specific businesses by address and business name. 8. Copies of Certificates of Occupancy, as well as Building Permits, may be ob ained from the Building Division at (408) 866-2130. 9. There are no pending or anticipated changes to the Zoning designations of the two subject properties.
