COMMUNICATIONS AGENDA MODIFICATIONS OR POSTPONEMENTS ORAL REQUESTS This is the point on the agenda where members of the public may address the Commission on items of concern to the Community that are not listed on the agenda this evening. People may speak up to 5 minutes on any matter concerning the Commission. PUBLIC HEARING 1 . Appeal of Director's Interpretation Janoff, J. 2. PLN2007-98 Ushomirsky, I. Continued Public Hearing (from the Planning Commission meeting of July 24, 2007) to consider the Appeal of Mr. Jeffrey Janoff, Esq., on behalf of Support Systems Homes, of an Official Interpretation of the Zoning Code by the Community Development Director pertaining to a use in operation at 889 Scott Court in an R-1-6 (Single Family Residential) Zoning District. The interpretation is that this property is being operated as a Residential Service Facility, Large, which use is neither a permitted nor conditional use in that R-1-6 Zoning District. Planning Commission action final. Project Planner: Jackie C. Young Lind, Acting Director Public Hearing to consider the application of Mr. Igor Ushomirsky, on behalf of Starbright School, Inc., for a Modification (PLN2007-98) to a previously-approved Conditional Use Permit (UP 95-03) to allow for the expansion of the Starbright School into the immediate adjacent tenant space on property owned by Kirkorian Properties, LP, located at 1806 W. Campbell Avenue in a C-1-S (Neighborhood Commercial) Zoning District. Staff is recommending that this project be deemed Categorically Exempt under CEQA. Planning Commission action final unless appealed in writing to the City Clerk within 10 calendar days. Staff Public Hearing to consider City-initiated amendments to the City of Campbell Zoning Code as follows: 1. A new subsection "d" to Chapter 21.12.030.G.1 (Planned Development Zoning District) to require that any late-night use in the Planned Development Zoning District obtain an Administrative Planned Development Permit pursuant to Sections 21.12.03.G.6 and 21.12.03.G.7. 2. A new subsection "3" to Section 21.58.040.8 requiring that existing late-night uses without an Administrative Planned Development Permit obtain said permit within 24 months of the effective date of the Ordinance codifying these changes. 3. A modification to the definition (Section 21.72) of "late night activities" to clarify the meaning of the term. Staff is recommending that this project be deemed Categorically Exempt under CEQA.
